Resolution No. 74-03
THE STATE OF TEXAS X COUNTY OF GALVESTON X CITY OF FRIENDSWOOD X On this , the llth day of March, 1974 , at 7 : 30 o ' clock P.M. , the City Council of the City of Friendswood, Texas , convened for a special meeting in the City Hall within said City, which meeting was at all times open to the public , and the roll was called of the duly constituted officers and members of said City Council, namely: RALPH L. LOWE MAYOR MILTON L. WINDLER COUNCILMAN WILLIAM B. PATTON, SR. COUNCILMAN RALPH G. GONZALES COUNCILMAN EDWARD O. ZEITLER COUNCILMAN BENNY BAKER COUNCILMAN RICHARD L. HAKEN COUNCILMAN AND BOBBIE C . HENRY CITY SECRETARY and all of said persons were present/ J / with the exception of the following: `��l/1/9 L (N�/�/cl[`e , thus constituting a quorum. Whereupon , among other business , the fol- lowing was transacted at said meeting : A written resolution CALLING A BOND ELECTION was introduced for the consideration of the Council and read in full . It was then duly moved and seconded that said resolution be adopted; and, after due discussion , said motion, carrying with it the adoption of said resolution, prevailed and carried by the following vote : AYES : All members of said City Council shown present above voted "AYE" NOES : None. A RESOLUTION BY THE CITY COUNCIL OF THE CITY OF FRIENDS- WOOD, TEXAS , CALLING A BOND ELECTION TO BE HELD IN SAID CITY ON THE 6TH DAY OF APRIL, 1974, FOR THE PURPOSE OF AUTHORIZING THE IS- SUANCE BY SAID CITY OF $ 7e2D,f,©O STREET IMPROVEMENT GENERAL OBLIGATION BONDS ; PRO- VIDING FOR THE NOTICE OF SAID ELECTION; AND ENACTING CERTAIN OTHER PROVISIONS INCIDENT AND RELATING TO THE SUBJECT AND PURPOSES OF THIS RESOLUTION. ****************************************************.************ WHEREAS , the City Council of the City of Friendswood, Texas , has determined to call an election for the purpose of sub- mitting the hereinafter set forth proposition for the grant of the authority therein contained; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FRIENDSWOOD, STATE OF TEXAS : I That an election be held in the City of Friendswood, Texas , on the 6th day of April, 1974 , which is not less than fif- teen (15) nor more than thirty (30) days from the date of this resolution, .at which election there shall be submitted to all resident qualified electors of said City who own taxable property in said City and who have duly rendered the same for taxation, and to all other resident qualified electors of said City, voting sepa- rately, for their action thereupon , the following Proposition, . to-wit : PROPOSITION "Shall the City Council of the City of Friendswood, Texas , be authorized to issue bonds i' / nthe principal amount of ctey/N -/4)(1/1110d( / sn N /- DOLLARS ($ NOD 0 ) , for the purpose of constructing permanent street improvements in said City; said bonds to mature serially or otherwise , as may be determined by the City Council of said City, the maximum maturity being not more than forty (40) years from their date ; and any is- sue or series of said bonds ,to bear interest per annum (payable annually or semi-annually) at any rate or rates to be determined within the discretion of the City Coun- cil of said City, provided that such rate or rates shall not exceed the maximum rate per annum authorized by law at the time of the issuance of any issue or series of said bonds; and shall the City Council be authorized to levy an annual ad valorem tax on all taxable property in said City sufficient to pay the interest on said bonds as the same accrues , and to create a sinking. fund sufficient to pay the principal thereof as the same matures , as authorized by the Constitution and laws of the State of Texas?" II ` That for the purpose of holding said election, the following City Election Precincts are hereby established; and the polling places hereby designated for holding said election in each such City Election Precinct; and the Presiding Judge and Alternate Presiding Judge hereby appointed for holding said elec- tion in each such City Election Precinct, hereby established, shall be as follows , to-wit: (a) A City Election Precinct is hereby established com- prising all or such portion of Galveston County Election Precinct No. 57 that lies within the corporate limits of the City of Friendswood, Texas , which City Election Precinct is hereby desig- nated as City Election Precinct No. 1; and the polling place hereby designated for the holding of said election in said City Election Precinct No. 1 shall be at the COUNCIL CHAMBERS , CITY `��• . ' HALL, 109 Willowick , Friendswood, Texas , with , . c57kAe, as Presiding Judge and ,�. / /(,ag � . �-4 as Alternate Presiding Judge; and all voters residing within said City Election Precinct No. 1 who are qualified to vote in said election shall vote at the aforesaid polling place. (b) A City Election Precinct is hereby established com- prising all of the territory within the corporate limits of the City of Friendswood, Texas , which does not lie within the terri- tory designated above as City Election Precinct No. 1 , which City Election Precinct is hereby designated as City Election Precinct No. 2 ; and the polling place hereby designated for the holding of said election in said City Election Precinct No. 2 shall be at the CAFETERIA, JUNIOR HIGH SCHOOL CAMPUS, Friendswood,. Texas , with - �taXicia e°J�R ,e(f,t/ as Presiding Judge and E ' gRs, Jea4 as Alternate Presiding Judge; and all voters residing within said City Election Precinct No. 2 who are qualified to vote in said election shall vote at the aforesaid polling place . ' — That the Alternate Presiding Judge above named, for each of the City Election Precincts , in the absence of the Presiding Judge for such City Election Precinct, shall perform the duties of the Presiding Judge for such City Election Precinct in such election,; and the Presiding Judge for each of the above, City -Elec- tion Precincts shall appoint three (3) qualified voters who are residents of such City Election Precinct to serve as Clerks in said election , the appointment of such Clerks to include the Alternate Presiding Judge , who, if present, shall be appointed and counted as one of the election clerks. III That the polls of said election shall be open on the day of said election from 7 :00 o' clock A.M. to 7 :00 o'clock P.M. IV That the ballots to be used in said election shall be . prepared in conformity with the Texas Election Code , as amended, and in such manner that the voters may cast their ballots either "FOR" or "AGAINST" the following ballot proposition: The issuance of $ 7o,0290 Street Improve- ment Bonds and the levy and pledge of the tax in payment thereof, as submitted in the Proposition. V. That voting machines shall be used in the holding of said election on the day of said election in both of the City Election Precincts , hereinabove established. That absentee voting shall be conducted by paper ballot, and that said ballots shall also be prepared in conformity with the Texas Election Code, . as amended, and in such manner that the votersmay cast their ballots either "FOR" or "AGAINST" the above ballot proposition. VI That absentee voting in said election shall be conducted at the City Hall of the City of Friendswood, Texas , and BOBBIE C . HENRY, City Secretary, is hereby charged with the duty of conduc- ting absentee voting in said election , as required by law. VII / /� That 1f !' J;mes 1 b7�ja/y) /' L, - ,V ///�e_ and obl/ 77)9, /.0,-(4 are hereby appointed las a special canvassing board charged with the duty of casting, counting , can- vassing and recording the absentee ballots in said election, and with making due return and statement of canvass of all absentee ballots cast in said election , as provided by law. VIII (a) That at said election all resident qualified elec- tors of the City of Friendswood, Texas , who own taxable property in said City and who have duly rendered the same for taxation , voting separately, shall be permitted to vote ; and that at each of the polling places designated for the holding of said election a separate voting machine shall be provided upon which the votes of all such voters shall be cast ; and the votes cast at each said polling place by all such voters shall be recorded, returned and canvassed separately. (b) That also at said election all other resident qualified electors of the City of Friendswood , Texas , shall be permitted to vote , that is , all of those persons who are resident qualified electors of said City but who do not meet the require- ment of owning taxable property in said City which has been duly rendered for taxation shall be permitted to vote in said election; and that at each of the polling places designated above for the holding of said election a separate voting machine shall be pro- vided upon which the votes of all such voters shall be cast; and the votes cast at each such polling place by all such voters shall be recorded , returned and canvassed separately. (c) That in conducting absentee voting in said election, separate ballot boxes will be maintained for each said class of voters ; and the votes cast by each said class of voters shall be recorded , returned and canvassed separately. (d) Each eligible person voting in said election shall be per:r.1 :ted to vote once , and only once . IX That notice of said election shall be given by posting copies of a notice containing a substantial copy of this resolu- tion at the City Hall and at the Cafeteria on the Junior High School Campus (the above designated polling places) and at two (2) other public places within said City not less than fifteen (15) days prior to the date of said election ; and by publishing notice of said election on the same day in each of two (2) suc- cessive weeks in the FRIENDSWOOD JOURNAL , a newspaper of general circulation published within said City, the date of the first publication to be not less than fourteen (14) days prior to the date set for the holding of said election. X That except as otherwise provided herein and in Article 704, Vernon ' s Annotated Texas Statutes , as amended , the manner of holding said election shall be governed by the applicable laws governing general elections . XI That this resolution was read once by the City Council and shall take effect immediately. XII That it is hereby officially found and determined that the need of the City for such financing creates an emergency and an urgent public necessity for the holding, at the scheduled time , of the meeting of the City Council at which this resolution is adopted, and for the adoption of this resolution ; and the NOTICE OF MEETING relating to said meeting and heretofore posted by the City Secretary , and the posting hereof , are hereby authorized, approved , adopted , ratified and confirmed.
