HomeMy WebLinkAboutResolution No. 73-10 RESOLUTION CANVASING RETURNS AND DECLARING RESULTS OF ELECTION THE STATE OF TEXAS 0 COUNTY OF GAL VE ST ON 0 CITY OF FRIENDSWOOD 0 WHEREAS, an election was held in the CITY OF FRIENDSWOOD on August 11, 1973, at which three propositions relating to the issuance of bonds of the City, as fully set out in the resolu- tion calling said election, were submitted in accordance with law; and WHEREAS, said election was held and conducted as two separate but simultaneous elections, to-wit: one election at which only the resident, qualified electors of the City who owned taxable property within the City and who had rendered the same for taxation were entitled to vote on the propositions and another election at which all other resident, qualified electors of the City were entitled to vote on the propositions; and WHEREAS, the votes cast by each of the two classes of voters described above were recorded and returned separately and were as follows: I. The resident, qualified electors of the City who owned taxable property within the City and who had rendered the same for taxation cast 499 votes as follows: PROPOSITION 1 FOR THE ISSUANCE OF $250 ,000 SANITARY SEWER SYSTEM REVENUE BONDS . . 312 - votes AGAINST THE ISSUANCE OF $250 ,000 SANITARY SEWER SYSTEM REVENUE BONDS . . 187 votes c I PROPOSITION 2 FOR THE ISSUANCE OF $50 ,000 PARK BONDS 218 votes AGAINST THE ISSUANCE OF $50 ,000 PARK BONDS .. . 273 votes PROPOSITION 3 FOR THE ISSUANCE OF $100 ,000 DRAINAGE IMPROVEMENT BONDS 286 votes AGAINST THE ISSUANCE OF $100 ,000 DRAINAGE IMPROVEMENT BONDS 213 , votes II. All other resident, qualified electors of the City cast 25 votes as follows: PROPOSITION 1 FOR THE ISSUANCE OF $250 ,000 SANITARY SEWER SYSTEM REVENUE BONDS . . 18 ' votes AGAINST THE ISSUANCE OF $250 ,000 SANITARY SEWER SYSTEM REVENUE BONDS . 7 votes PROPOSITION 2 FOR THE ISSUANCE OF $50 ,000 PARK BONDS 11 votes AGAINST THE ISSUANCE OF $50 ,000 PARK BONDS.. 14 votes PROPOSITION 3 FOR THE ISSUANCE OF $100 ,000 DRAINAGE IMPROVEMENT BONDS 16 votes AGAINST THE ISSUANCE OF $100 ,000 DRAINAGE IMPROVEMENT BONDS 9 votes and - WHEREAS, the above totals are shown in the official election returns heretofore submitted to the City Council and filed with the City Secretary; and WHEREAS, the election was called and held in all respects under and in strict conformity with the constitutions and laws of the State of Texas and of the United States of America; THEREFORE , BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FRIENDSWOOD THAT : Section 1. The matters and facts recited in the above preamble of this resolution are found to be true and correct. Section 2. The election held in the City on the 11th day of August, 1973 , and which is more fully described in the preamble of this resolution, and which was held and conducted as two separate but simultaneous elections, was called and notice thereof given in accordance with law; the election was held in all respects in conformity with law; only resident, qualified electors of the City voted at the election; the votes of the resident, qualified electors of the City who owned taxable property within the City and who had rendered the same for taxation, voting at the election, were recorded, returned, and are canvassed here separately from the votes of all other resident, qualified electors of the City who voted at the election; returns of the election have been lawfully made by the proper officers; the election has resulted favor- ably to the issuance of the bonds described in Propositions 1 and 3 submitted at said election; and more than the necessary majority of the qualified voters voting at the election have voted in favor thereof. Section 3. The City Council of the City is authorized to issue all of the bonds described in Propositions 1 and 3. The City Council is authorized to issue revenue bonds as described in Proposition 1 payable from a lien on and pledge of the net a revenues of the City' s waterworks and sanitary sewer system. The City Council is authorized to issue tax bonds described in Proposition 3 and to levy taxes in payment thereof. Section 4. None of the bonds described in Proposition 2 shall be issued. Section 5. It is hereby found and determined that the need of the City for such financing creates an emergency and an urgent public necessity for the holding, at the scheduled time, of the meeting at which this resolution is adopted and for the adoption of this resolution; and the NOTICE OF MEETING relating to said meeting and heretofore posted by the City Secretary, and the posting thereof, are hereby authorized, approved, adopted, ratified, and confirmed. The City Council of the CITY OF FRIENDSWOOD, TEXAS, convened in SPECIAL MEETING, ON THE 13th DAY OF AUGUST , 1973, in the City Council Room of the City Hall , within the City; and the roll was called of the duly constituted officers and mem- bers of said Council , to-wit: Ralph L. Lowe Mayor Milton L. Windier Councilman William B. Patton, Sr. Councilman Ralph G. Gonzales Councilman Edward 0. Zeitler Councilman Benny Baker Councilman Richard L. Haken - Councilman Bobbie C. Henry City Secretary and all of said persons were present except the following absentees: William B. Patton, Sr. 7 thus constituting a quorum. Whereupon, among other business, the following was transacted at said meeting: a written RESOLUTION CANVASSING RETURNS AND DECLARING RESULTS OF ELECTION was duly introduced for the consideration of said Council and read in full. It was then duly moved and seconded that said resolution be adopted; and, after due discussion, said motion, carrying with it the adoption of said resolution, prevailed and carried by the following vote: AYES: All members of said Council shown present above voted "Aye." NOES: None. 2. That a true, full, and correct copy of the aforesaid resolution adopted at the meeting described in the above and foregoing paragraph is attached to and follows this certificate; that said resolution has been duly recorded in said Council ' s minutes of said meeting; that the above and foregoing paragraph is a true, full, and correct excerpt from said Council ' s minutes of said meeting pertaining to the adoption of said resolution; that the persons named in the above and foregoing paragraph are the duly chose, qualified, and acting officers and members of said Council as indicated therein; that each of the officers and members of said Council was duly and sufficiently notified . officially and personally, in advance, of the time, place, and purpose of the aforesaid meeting and that said resolution would be introduced and considered for adoption at said meeting, and each of said officers and members consented, in advance, to the holding of said meeting for such purpose; that said meeting was open to the public as required by law; and that public notice of the time, place, and subject of said meeting was given as required by Vernon' s Article 6252=17, as amended. 3. The Mayor of said City has approved, and hereby approves, the aforesaid resolution; the Mayor and the City Secretary of said City have duly signed said resolution; and the Mayor and City Secretary of said City hereby declare that their signing of this certificate shall also constitute the signing of the attached and following copy of said resolution for all purposes.
