Recitals
The Servient Estate Property and Dominant Estate Property are defined below. In 1995,
Grantor built a house and other improvements (metal barn building) on the tract of land
of the Dominant Estate Property. The sanitary sewer line to the house and metal barn
building runs across and is buried and located underground at the back of the Servient
Estate Property,as more fully shown in Exhibit B,and connects to a City of Fnendswood
sewer line tap that is outside the property line of the Servient Estate Property.No pump
station was installed or required to be installed by Grantor. At the time of creating and
recording this Easement, Grantor is the owner of the Servient Estate Property, and the
Servient Estate Property is unimproved and is fenced on three sides with a gate at the
back of the property. On or about Apnl 26,2007,the above-named Grantee became the
owner of record of the Dominant Estate Property
Servient Estate Property
A 4.6212 acre tract of land out of Lot Two (2), Block One (1) of Fnendswood, a
subdivision in Galveston County,Texas,according to the map or plat thereof recorded in
Volume 254A, Page 18 of the Map Records in the office of the County Clerk of
Galveston, County, Texas, and transferred to Plat Record 7, Map 20, both of the map
records of Galveston County, Texas, and more particularly described by metes and
bounds on Exhibit A (four pages), attached hereto and incorporated herein by reference
for all purposes At the time of the granting and recording of this Grant of Easement for
Sanitary Sewer Line,the Servient Estate Property was owned by Grantor

Dominant Estate Property.
A tract of land being the Southwest '/z of the Northwest % of Lot 2, in Block 1 of
Fnendswood Subdivision,Galveston County,Texas, accordmg to the map or plat thereof
recorded in Volume 238,Page 14 in the office of the County Clerk of Galveston County,
Texas and being more particularly described in Exhibit B which is attached hereto and
incorporated herein by reference for all purposes The Dominant Estate Property includes
the improvements on the tract of land being the Southwest Y2 of the Northwest'/2 of Lot 2,
in Block 1 of Fnendswood Subdivision,Galveston County,Texas,as shown in Exhibit B.
Easement Property.
The sanitary sewer easement granted out of the Servient Estate Property as defined above
and more particularly described in Exhibit A (four pages), attached hereto and
incorporated herein by reference for all purposes.
Easement Purpose:
For the installation, construction, operation, maintenance, replacement, repair, upgrade,
and removal of the sanitary sewer line referenced in the recitals and any related facilities
such as a pump station(collectively,the"Facilities")on the Servient Estate Property and
to provide to Grantee and Grantee's heirs,successors,and assigns and subsequent owners
of the Dominant Estate property ingress and egress to the Servient Estate Property for the
installation, construction, operation, maintenance, replacement, repair, upgrade, and
removal of the Facilities. The sanitary sewer line must at all times be maintained and
installed underground, and the Facilities must comply with any applicable codes and
ordinances of the City of Fnendswood.
Reservations from Conveyance Any and all easements, restrictions, covenants, conditions and
other matters of record which may affect the Easement Property, but only to the extent
same are valid and currently subsisting.
Exceptions to Warranty: None.
Grant of Easement Grantor, subject to the Reservations from Conveyance and Exceptions to
Warranty,grants and conveys to Grantee and Grantee's heirs,successors,and assigns and
subsequent owners of the Dominant Estate property a ten(10) feet wide easement over,
on, and across the Servient Estate Property for the Easement Purpose, together with all
and singular the nghts and appurtenances thereto in any way belonging(collectively,the
"Easement"), as shown on Exhibit A hereto. Grantor, by and through this Grant of
Easement, binds Grantor and Grantor's heirs, successors, and assigns and subsequent
owners of the Servient Estate Property to warrant and forever defend the title to the
Easement for the benefit of Grantee and Grantee's heirs, successors, and assigns and
subsequent owners of the Dominant Estate Property against every person whomsoever

lawfully claiming or to claim the Easement or any part of the Easement,except as to the
Reservations from Conveyance and Exceptions to Warranty,to the extent that such claim
arises by,through,or under Grantor but not otherwise This grant of easement is a grant
of a private easement over private property
Terms and Conditions- The following terms and conditions apply to the Easement granted by
Grantor
1 Character of Easement The Easement is appurtenant to,runs with, and inures to
the benefit of all or any portion of the Dominant Estate Property,whether or not the Easement is
referenced or described in any conveyance of all or such portion of the Dominant Estate Property
The Easement is nonexclusive and irrevocable The Easement is for the benefit of Grantee and
Grantee's heirs,successors, and assigns and subsequent owners of the Dominant Estate Property
and the subsequent owners'heirs,successors,and assigns who at any time own any interest in the
Dominant Estate Property(as applicable,the"Holder")
2 Duration of Easement The duration of the Easement is perpetual, unless the
Facilities are relocated off the Servient Estate Property. In the event of relocation,the easement
terminates
3 Reservation of Rights Holder's right to use the Easement Property for the
Easement Purpose is nonexclusive, and Grantor reserves for Grantor and Grantor's heirs,
successors,and assigns and subsequent owners of the Servient Estate Property the right to use all
or part of the Easement Property in conjunction with Holder,as long as such use by Grantor and
Grantor's heirs, successors, and assigns and subsequent owners of the Servient Estate Property
does not interfere with the use of the Easement Property by Holder for the Easement Purpose.
4 Secondary Easement. Holder has the right (the "Secondary Easement") to use a
reasonable amount of the surface of the property that is adjacent to the Easement Property
("Adjacent Property") as may be reasonably necessary to accomplish the Easement Purpose,
However,Holder must promptly restore the Adjacent Property to its previous physical condition
if changed by use of the rights granted by this Secondary Easement At all times,Holder must
give notice to the owner of the Servient Estate Property that Holder needs to gain ingress and
egress to the Easement Property to accomplish the Easement Purpose and notice of the work and
duration of the work to be performed.
5 Improvement, Repair, and Maintenance of Easement Property Improvement,
repair, and maintenance of the Facilities will be at the sole expense of Holder Holder has the
right to eliminate any encroachments into the Easement Property, with notice to and mutual
agreement with the owner of the Servient Estate Property The owner of the Servient Estate
Property must maintain the surface of the Easement Property in a neat and clean condition.
Holder has the right to construct,install,maintain,replace,relocate,and remove the Facilities on
any portion of the Easement Property, subject to notice to the owner of the Servient Estate
Property, agreement on ingress and egress, and requirement that the sanitary sewer line is

maintained underground All matters concerning the Facilities and their configuration,
construction, installation, maintenance, repair, replacement, and removal are at Holder's sole
discretion, subject to performance of Holder's obligations under this Grant of Easement,
including notice and agreement with the owner of the Servient Estate Property and requirement
that the sanitary sewer line be maintained underground With notice to the owner of the Servient
Estate Property, Holder has the right to remove or relocate any fences within the Easement
Property or along or near its boundary lines if reasonably necessary to construct,install,maintain,
replace, or remove the Facilities, subject to replacement of the fences to their original condition
on the completion of the work Holder may not interfere with the property rights of the owner of
the Servient Estate Property, and the Servient Estate Property owner may not interfere with the
Holder's reasonable use of the Easement Property for the Easement Purpose. As long as the
sewer line that is the subject of this Easement is operating properly, it is contemplated that
Holder will not need ingress or egress to the Easement Property on a regular or continuing basis.
The owner of the Servient Estate Property has no duty to repair or maintain the sanitary sewer
line that is in the Easement Property. The owner of the Servient Estate Property shall not grow
trees or other plants or place structures or other improvements on the Easement Property that
would interfere with the Easement Property for the Easement Purpose.At all times,Holder must
give notice to the owner of the Servient Estate Property that Holder needs to gain ingress or
egress to the Easement Property to accomplish the Easement Purpose Holder and owner of the
Servient Estate Property shall mutually agree on any relocation of Facilities and on arrangements
for ingress and egress and any relocation of the Facilities Grantor shall have no responsibility,
obligation,or involvement in the relocation of Facilities.
6. Equitable Rights of Enforcement. This Easement may be enforced by restraining
orders and injunctions (temporary or permanent) prohibiting interference and commanding
compliance. Restraining orders and injunctions will be obtainable on proof of the existence of
interference or threatened interference, without the necessity of proof of inadequacy of legal
remedies or irreparable harm, and will be obtainable only by the parties to or those benefited or
bound by this Grant of Easement; provided, however, that the act of obtaining an injunction or
restraining order will not be deemed to be an election of remedies or a waiver of any other rights
or remedies available at law or in equity
7 Attorney's Fees Any party to litigation or arbitration of a dispute to enforce this
Easement, to declare their rights with respect to the Easement, or concerning this Easement,
including the relocation of Facilities, shall be entitled to recover its reasonable attorney's fees
and court and other costs if it prevails in the litigation or arbitration.
8 Choice of Law. This Grant of Easement shall be construed and interpreted under
the laws of the state of Texas,without regard to choice-of-law rules of any jurisdiction Venue is
in Galveston County,Texas,which is the county in which the Easement Property is located.

9. Legal Construction If any provision in this Grant of Easement is for any reason
unenforceable,to the extent the unenforceability does not destroy the basis or intent of the Grant
of Easement, the unenforceability will not affect any other provision hereof, and this Grant of
Easement will be construed as if the unenforceable provision had never been a part of the Grant
of Easement
10 Waiver of Default It is not a waiver of or consent to default if the Grantor or
Grantor's heirs,successors,and assigns and subsequent owner(s)of the Servient Estate Property
party fails to declare immediately a default or delays in taking any action.Pursuit of any remedies
set forth in this Grant of Easement does not preclude pursuit of other remedies by Grantor or
Grantor's heirs,successors,and assigns,and subsequent owner(s)of the Servient Estate Property
or Holder available under the law.
11. Amendment This Grant of Easement may be amended only in writing by the
person(s)who are the owner(s) of the Servient Estate Property and the Holder at the time of the
proposed amendment
12 Notices.Any notice required or permitted under this Grant of Easement must be in
wntmg Any notice required by this Grant of Easement will be deemed to be delivered(whether
actually received or not) when deposited with the Umted States Postal Service,postage prepaid,
certified mail, return receipt requested, and addressed to the intended recipient at the address
shown in this agreement Notice may also be given by personal delivery, courier delivery,
facsimile transmission, or other commercially reasonable means and will be effective when
actually received.Any address for notice may be changed by written notice delivered as provided
herein. Notice to the owner of the Dominant Estate Property shall be sent to 407 W Edgewood
Dnve,Fnendswood,Texas 77546 The owner of the Servient Estate Property shall send a notice
to the owner of the Dominant Estate Property, within 90 days of acquiring title to the Servient
Estate Property, providing the address at which notices may be sent. Otherwise, notice to the
Servient Estate Property shall be sent to the mailing address of the owner of the Servient Estate
Property,as reflected among the records of the Galveston County,Texas Appraisal District
13. Recitals. Any recitals in this Grant of Easement are represented by Grantor to be
accurate and constitute a part of the substantive agreement.
14. Time Time is of the essence Unless otherwise specified,all references to"days"
mean calendar days. Business days exclude Saturdays, Sundays,and legal public holidays If the
date for performance of any obligation falls on a Saturday, Sunday, or legal public holiday,the
date for performance will be the next following regular business day.

15. Miscellaneous. Headings following numbered paragraphs are for reference only
and are not intended to define or restrict the text of the paragraph This Grant of Easement may
be executed in multiple counterparts or originals, and signed counterparts will have the same
effect as if all signatory parties had signed the same document.All counterparts will be construed
together and will constitute one and the same instrument. This Grant of Easement shall be
recorded with the County Clerk of Galveston County,Texas
