ORDINANCE NO. 2008-05 AN ORDINANCE AMENDING CITY OF FRIENDSWOOD, TEXAS, ORDINANCE NO. 2000-01, AS AMENDED, ORIGINALLY ADOPTED THE 17TH DAY OF DECEMBER, 2000, BEING APPENDIX B OF THE FRIENDSWOOD CITY CODE, AND BEING AN ORDINANCE PROVIDING RULES AND REGULATIONS GOVERNING PLATS AND THE SUBDIVISION OF LAND, BY AMENDING SECTION III(D) BY INCREASING THE MINIMUM RIGHT-OF-WAY WIDTH FOR MAJOR THOROUGHFARE AND COLLECTOR STREETS; PROVIDING A j PENALTY OF AN AMOUNT NOT TO EXCEED $2,000 FOR EACH DAY OF VIOLATION OF ANY PROVISION HEREOF; AND PROVIDING FOR SEVERABILITY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FRIENDSWOOD, STATE OF TEXAS: Section 1. City of Friendswood, Texas, Ordinance No. 2000-01, as amended, originally adopted the 17th day of December, 2000, same being Appendix B of the Friendswood City Code, same also being an ordinance providing rules and regulations governing plats and the subdivision of land, is hereby amended by amending Section III(d) table inset as follows: "Section III. General requirements and design criteria. d. Buffering major thoroughfares. 1. Where a subdivision abuts or contains an existing or proposed arterial street, the commission may require marginal access streets, reverse frontage with screen planting contained in nonI access reservation along the rear property line, deep lots with rear service alleys, or such other treatment as may be necessary for adequate protection of residential properties and to afford separation of through and local traffic. If landscaping or berming is used as a buffer between thb major thoroughfare and residential property uses, the subdivider shall provide a ten-foot landscape easement along the major thoroughfare according to the major thoroughfare plan and shall construct sidewalks thereon in accordance with this chapter and the current design criteria. 2. Reserve strips controlling access to streets shall be prohibited except where their control is ' definitely placed in the city under conditions approved by the commission. 3. Street right-of-way widths shall be as shown in the general plan for the City of Friendswood, and where not shown therein shall be not less than as follows: TABLE INSET: Street type Minimum right-of-way width Major thoroughfare 490 120 feet Collector 60 80 feet Minor(private and public) 60 feet Commercial streets 80 feet i Boulevards 80 feet i Section 2. Any person who shall violate any provision of this Ordinance shall be deemed guilty of a misdemeanor and, upon conviction, shall be fined in an amount not to exceed - $2000. Each day of violation shall constitute a separate offense. Section 3. In the event any clause phrase,provision, sentence, or part of this Ordinance or the application of the same to any person or circumstances shall for any reason be adjudged invalid or held unconstitutional by a court of competent jurisdiction, it shall not affect, impair, or invalidate this Ordinance as a whole or any part or provision hereof other than the part declared t be invalid or unconstitutional; and the City Council of the City of Friendswood, Texas, declare that it would have passed each and every part of the same notwithstanding the omission of aw such part thus declared to be invalid or unconstitutional,whether there be one or more parts.
