ORDINANCE NO. 2007-20 AN ORDINANCE AMENDING THE CODE OF ORDINANCES OF THE CITY OF FRIENDSWOOD, TEXAS, BY DELETING FROM CHAPTER 34 THEREOF ALL OF SECTION 34-24 AND SUBSTITUTING THEREFOR A NEW SECTION 34-24; PROVIDING FOR ADOPTION OF THE FLOOD INSURANCE STUDY FOR HARRIS COUNTY, TEXAS AND INCORPORATED AREAS," DATED JUNE 18, 2007; PROVIDING A PENALTY OF AN AMOUNT NOT TO EXCEED $2,000 FOR EACH DAY OF VIOLATION HEREOF; AND PROVIDING FOR SEVERABILITY. WHEREAS, the latest flood hazard mapping for Harris County by the Federal Emergency Management Agency ("FEMA") is based in part on the analysis of data collected during Tropical Storm Allison; and, WHEREAS, the adoption of the latest flood hazard mapping was one of the recommendations in FEMA's recent Community Assessment Visit to the City; and WHEREAS, the City Council deems it necessary and appropriate to update the basis used to establish the areas of special flood hazard in the Harris County portion of the City, said basis being consistent with that used by other entities in Harris County; now,therefore, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FRIENDSWOOD, STATE OF TEXAS: i i Section 1. The facts and matters set forth in the preamble of this Ordinance are hereby found to be true and correct. Section 2. Chapter 34 of the Code of Ordinances of the City of Friendswood, Texas, said Chapter 34 being the Flood Damage Prevention Ordinance of the City, is hereby amended as set forth below. Words being deleted are indicated by brackets and strike-throughs, as follows: "[delete I." Words being added are indicated by underline, as follows: "underline." Additions to words or phrases underscored in the existing ordinance text are indicated by a double underline, as follows: "ordinances." A. Section 34-24 of Division I or Article II of Chapter 34 is hereby amended as follows: i Section 34-24. Basis for establishing the areas of special flood hazard. The areas of special flood hazard identified by the Federal Emergency Management Agency in a scientific and engineering report entitled, "The Flood Insurance Study for Friendswood, Texas, Galveston and Harris Counties," dated September 22, 1999, with accompanying Flood Insurance Rate Map and Flood Boundary-Floodway Maps (FIRM and FBFM), and any e s t are- hereby ....,,r.,,d b, r as revised by "The Flood Insurance Study for Harris County Texas and Incorporated Areas," dated June 18 2007 with accompanying Flood Insurance Rate Ma Ds and Flood i Boundary-Floodway Maps (FIRM and FBFM) and any revisions thereto are hereby adopted by reference and declared to be a part of this Article. Section 3. Any person who shall knowingly,, willingly, or with criminal negligence violate any provision of this Ordinance shall be deemed guilty of a misdemeanor and upon conviction, shall be fined in an amount not to exceed $2,000.00. Each day of violation shall constitute a separate offense. Section 4. In the event any section, paragraph, subdivision, clause, phrase, provision, sentence, or part of this Ordinance or the application of the same to any person or circumstance shall for any reason be adjudged invalid or held unconstitutional by a court of compete)t jurisdiction, it shall not affect, impair, or invalidate this Ordinance as a whole or any part or provision hereof other any part or provision hereof other than the part declared to be invalid or unconstitutional; and the City Council of the City of Friendswood, Texas, declares that it would have passed each and every part of the same notwithstanding the omission of any and every part of the same notwithstanding the omission of any such part thus declared to be invalid or unconstitutional, or whether there be one or more parts.
