HomeMy WebLinkAboutResolution No. 01-68 • RESOLUTION NO. 1-68 RESOLUTION CALLING BOND ELECTION; PROVIDING DETAILS RELATING THERETO; AND CONTAINING OTHER PROVISIONS RELATING TO THE SUBJECT THE STATE OF TEXAS § COUNTY OF GALVESTON § The City Council of the City of Friendswood, Texas , con- vened in regular session, open to the public , at the City Hall within said City on the 26th day of February, 1968 , with the following members , and the City Secretary, present , to-wit : Ralph L . Lowe Mayor Marvin L . Childers Alderman Wiley W. Murrell Alderman Ralph W. Somers Alderman Thomas F . Woods Alderman Edward F. Stuart Alderman Mrs . Artha Wright City Secretary and the following member(s ) absent , to-wit : NONE when, among other business , the following was transacted : A resolution was introduced which was read in full . Councilman SOMERS made a motion that the resolution be adopted. Councilman WOODS seconded the motion for adoption of the resolution. The motion, carrying with it the adoption of the resolution, prevailed by the following vote : AYES : Aldermen Childers , Murrell , Somers Woods, Stuart and Mayor Lowe . NOES : None . The Mayor thereupon announced that the resolution had been duly and lawfully adopted . The resolution thus adopted follows : a . • RESOLUTION CALLING BOND ELECTION; PROVIDING DETAILS RELATING THERETO; AND CONTAINING OTHER PROVISIONS RELATING TO THE SUBJECT WHEREAS, the City Council of the City of Friendswood, Texas , deems it necessary and desirable that an election be called and held within said City for the purpose of voting on a proposition relating to the issuance of natural gas system revenue bonds , all as hereinafter set forth; Therefore BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FRIENDSWOOD : Section 1 : That an election shall be held in and throughout the City of Friendswood, Texas, on the 23rd day of March, 1968 , at which election the following proposition shall be submitted to the duly qualified resident electors of said City who own taxable prop- erty within said City and who have duly rendered the same for taxa- tion, for their action thereupon, to-wit : SHALL THE CITY COUNCIL OF THE CITY OF FRIENDSWOOD, TEXAS, BE AUTHORIZED TO ISSUE THE REVENUE BONDS OF SAID CITY IN THE AMOUNT OF $750 ,000 , MATURING SERIALLY WITHIN THIRTY ( 30) YEARS FROM THEIR DATE OR DATES, AND BEARING INTEREST AT A RATE NOT TO EXCEED SIX PER CENT (6% ) PER ANNUM, FOR THE PURPOSE OF PURCHASING, CONSTRUCTING , IMPROVING OR EXTEND- ING A NATURAL GAS SYSTEM FOR SAID CITY; SAID BONDS TO BE ISSUED IN ACCORDANCE WITH AND SECURED IN THE MANNER PROVIDED IN ARTICLES 1111 TO 1118 , BOTH INCLUSIVE, VERNON'S TEXAS CIVIL STATUTES, AS AMENDED; AND TO SECURE THE PAYMENT OF THE INTEREST ON SAID BONDS AS IT ACCRUES AND THE PRINCIPAL OF SAID BONDS AS IT MATURES BY PLEDGING THE NET REVENUES FROM THE OPERATION OF SAID NATURAL GAS SYSTEM; EACH BOND TO BE CONDITIONED THAT THE HOLDER THEREOF SHALL NEVER HAVE THE RIGHT TO DEMAND PAYMENT OF SAID OBLIGATION OUT OF ANY FUNDS RAISED OR TO BE RAISED BY TAXATION? Section 2 : That said election shall be held in accor- dance with the provisions of the Constitution and laws of the State of Texas , and only duly qualified resident electors of said City who own taxable property within said City and who have duly rendered the same for taxation shall be qualified to vote . Section 3 : That the entire City is hereby established as one election precinct , and the City Hall within said City is hereby designated as the polling place for said election. The following named persons are hereby appointed officers to conduct said election: JAMES B. SHORE Presiding Judge OTTO HAARDT Alternate Presiding Judge The Presiding Judge shall appoint two qualified voters who are residents of the City to serve as election clerks and shall ap- point as many additional clerks as he deems necessary for the proper conduct of the election in said precinct , not to exceed the maximum number of FIVE (5 ) . Section 4 : That it is hereby determined that voting at said election shall be by the use of voting machines , and the ballots of said election shall conform to the Election Code of the State of Texas , and shall have printed thereon the follow- ing: OFFICIAL BALLOT PROPOSITION 0 FOR THE ISSUANCE OF BONDS 0 AGAINST Each voter desiring to vote in favor of a proposition shall pull the voting pointer down indicating "For" such proposition, and each voter desiring to vote against a proposition shall pull the voting pointer down indicating "Against" such proposition. Section 5 : That as to absentee voting, however, paper ballots shall be used, and absentee voting shall be conducted by a clerk for absentee voting, namely, Mrs . Artha Wright , City Secretary , and the place at which absentee voting shall be con- ducted is designated as the City Hall within said City, which is also the absentee voting clerk' s mailing address to which ballot applications and ballots voted by mail may be sent . Said clerk shall keep said office open for at least eight ( 8 ) hours , that is , from 8 : 00 a .m. to 5 : 00 p .m. on each day for absentee voting which is not a Saturday, a Sunday or an official state holiday . Section 6 : That notice of said election shall be given by posting a substantial copy of this resolution at the City Hall and at one additional public place within said City not less than fourteen (14 ) days prior to the date set for said election, and by publication of said notice on the same day in each of two (2) consecutive weeks in TRI COUNTY SUN PROGRESS a newspaper of general circulation within said City , the first of said publications to be made not later than fourteen (14 ) days prior to the date set for said election. Section 7 : That this resolution shall become effective and be in full force and effect upon and after its adoption. PASSED AND APPROVED this 26th day of February , 1968 .
