ORDINANCE NO.2007-11
AN ORDINANCE AMENDING APPENDIX C OF THE CODE OF
ORDINANCES OF THE CITY OF FRIENDSWOOD, TEXAS, SAID
APPENDIX C BEING THE ZONING ORDINANCE OF THE CITY,
BY ADDING TO THE PERMITTED USE TABLE FOLLOWING
PARAGRAPH 5 OF SUBSECTION P OF SECTION 8 THEREOF A
NEW CATEGORY 531120, ENTITLED "LESSORS OF
NONRESIDENTIAL BUILDINGS," TO AUTHORIZE BANQUET
AND EVENT CENTER USE IN THE SINGLE FAMILY
RESIDENTIAL (SIR) DISTRICT, SUBJECT TO THE GRANTING
OF A SPECIFIC USE PERMIT THEREFOR; PROVIDING A
PENALTY IN AN AMOUNT NOT TO EXCEED $2,000 FOR EACH
DAY OF VIOLATION OF ANY PROVISION HEREOF; AND
PROVIDING FOR SEVERABILITY.

WHEREAS, the City Council has determined that the use of certain residential
estates are appropriate sites within the single family residential district for the holding of
certain non-residential special events purposes, such as banquets, meetings, weddings,
receptions and other similar uses, subject to a determination that the specific site and
facility would not be injurious to adjacent and neighboring residential uses; and
WHEREAS, the Planning and Zoning Commission and the City Council
conducted a joint public hearing to consider proposal; and
WHEREAS, the hearing was duly called as provided by the laws of the State of
Texas and Appendix C of the Code of Ordinances of the City, and that in such hearing all
persons attending who desired to be heard; and
WHEREAS, the Planning and Zoning Commission has filed its written report
with City Council which recommends approval of the proposed amendment, subject to
any such use being contingent upon the granting of a specific use permit under the
procedures of the Zoning Ordinance for the granting of such permits; and
WHEREAS, as a result of the said public hearing and the recommendation of the
Planning and Zoning Commission, the City Council hereby finds and determines that the
proposed amendment to the Zoning Ordinance would not be detrimental to the
community, and is in conformance with the zoning ordinance and comprehensive plan for
development of the City; now,therefore
BE IT ORDAINED BY TBE CITY COUNCIL OF THE CITY OF
FRIENDSWOOD,STATE OF TEXAS:
Section 1. The facts and matters set forth in the preamble of this Ordinance
are hereby found to be true and correct.
Section 2. City of Friendswood, Texas, Ordinance No. 84-15, as amended,
originally adopted the 190' day of November, 1984, same being Appendix C of the
Friendswood City Code, and also being the zoning ordinance of the City, is hereby
amended by adding to the permitted use table following Paragraph 5 of Subsection P of
Section 8 thereof a new category, entitled "Lessors of Nonresidential Buildings," under
the 1997 NAICS code number 531120, with the notation of"S"under the column entitled
SFR,with the limitation of"Banquet and Event Center Use Only."
Section 3. No use of land for Banquet and Event Center purposes within the
SFR zone as set forth above shall be authorized unless a specific use permit has been
granted therefor in accordance with Subsection G of Section 9 hereof. No specific use
permit shall be authorized hereunder except for the use of property for special events
purposes, such as banquets,meetings,weddings,receptions and other similar uses.
Section 4. In the event any section, paragraph, subdivision, clause, phrase,
provision, sentence, or part of this Ordinance or the application of the same to any person
or circumstance shall for any reason be adjudged invalid or held unconstitutional by a
court of competent jurisdiction, it shall not affect, impair, or invalidate this Ordinance as
a whole or any part or provision hereof other any part or provision hereof other than the
part declared to be invalid or unconstitutional; and the City Council of the City of
Friendswood, Texas, declares that it would have passed each and every part of the same
notwithstanding the omission of any and every part of the same notwithstanding the
omission of any such part thus declared to be invalid or unconstitutional, or whether there
be one or more parts.
Section 5. Any person who shall willfully, intentionally, or with criminal
negligence violate any provision of this Ordinance shall be deemed guilty of a
misdemeanor and, upon conviction thereof, shall be fined in an amount not to exceed
$2,000.00. Each day of violation shall constitute a separate offense.
