I ORDINANCE NO.2007-15 AN ORDINANCE APPROVING AND ADOPTING THE CITY OF FRIENDSWOOD, TEXAS, GENERAL BUDGET FOR THE FISCAL YEAR 2007/2008; MAKING APPROPRIATIONS FOR THE CITY FOR SUCH FISCAL YEAR AS REFLECTED IN SAID BUDGET, AND MAKING CERTAIN FINDINGS AND CONTAINING CERTAIN PROVISIONS RELATING TO THE SUBJECT. WHEREAS, on July 31, 2007, the City Manager presented to the City Council a proposed Budget of the expenditures of the City of Friendswood for the fiscal year 2007/2008, a summary copy of which is attached hereto as Exhibit'W'and is made a part hereof; and WHEREAS,pursuant to notice as required by law, public hearings on such Budget were held in the Council Chambers in the City Hall, at which hearings all citizens and taxpayers of the City had the right to be present and to be heard and those who requested to be heard were heard; `-" and WHEREAS, the City Council has considered the proposed budget and has made such changes therein as in the City Council's judgment were warranted by law and were in the best interests of the citizens and taxpayers of the City; and WHEREAS, a copy of the Budget has been filed with the City Secretary and the City Council desires to adopt the same; and WHEREAS, in accordance with Section 8.03 (a) of the City Charter, the City Council has reviewed estimates of revenue to be derived by the City during the 2007/2008 fiscal year) and has determined that the proposed budgeted expenditures will not exceed total estimated income; now,therefore, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FRIENDSWOOD� STATE OF TEXAS: Section 1. The facts and matters set forth in the preamble of this Ordinance are i hereby found to be true and correct. Section 2. In accordance with Section 8.03 (e) of the City Charter, the City Council hereby approves and adopts the Budget described above, the same being on file with the City Secretary. The City Secretary is hereby directed to place on said budget and to sign an endorsement reading as follows: "The Original General Budget of the City of Friendswood, Texas, for the fiscal year 2007/2008," and to keep such Budget on file in the City Secretary's Office as a public record. Section 3. In support of said Budget and by virtue of the adoption thereof, there are hereby appropriated out of available cash funds and out of the general and special revenues of the City that will be received in the treasury during the fiscal year 2007/2008, the amounts set forth in said approved Budget for the various purposes stated therein. Ordinance No. T2007-15: First and final reading of an ordinance adopting the, City of Friendswood, Texas, General Budget for the FY2007-08; making appropriations for the City for such fiscal year as reflected in said budget, and making certain findings and containing certain provisions relating to the subject. 2. Ratify the property tax revenue increase reflected in the FY2007-08 budget The Charter requires the City's budget for the fiscal year to be adopted as close to September 15 as possible. This action item is designed to accomplish this. City Charter provisions also call for the adoption of the budget to be approved on first and final reading of the ordinance. All notices have been issued and posted and two public hearings were held August 27 and September 10. Item 2, ratification of the property tax revenue increase, is a new requirement under HB 3195. House Bill 3195 amends provisions of the Local Government Code to add certain disclosure, posting, and voting requirements for a proposed municipal or county budget that raises more property taxes than the previous year's budget. House Bill 3195 also requires the adoption of a budget that requires a property tax revenue increase to be achieved by a separate vote of the governing body to specifically ratify the increase. Recommendation. Approve, on first and final reading, Ordinance T2007-15, adopting the FY2007-08 Operating Budget. Attachments 1. Ordinance T2007-15 2. Exhibit A-Budget Summary B. Ordinance No. T2007-16: First and final reading of an ordinance providing for the levy, and collection of ad valorem taxes of the City of Friendswood, Texas, for the year 2007 (Tax Rate $0.5764); providing the date on which such taxes shall be due and payable; providing for penalty and interest on all taxes not timely paid; providing for severability; and repealing all ordinances or parts of ordinances inconsistent or in conflict herewith. 1. Vote to approve Maintenance and Operation tax rate of$0.5016/$100 evaluation 2. Vote to approve the Debt Service tax rate of$0.0748/$100 evaluation 3. Vote to adopt Ordinance T2007-16 on first and final reading This year's budget includes a decrease in the current tax rate. The current rate is $.5821/$100 evaluation. The proposed rate is $.5764/$100 evaluation. This rate is three percent above the effective tax rate, $0.55968. According to our City Attorney, the Texas Tax Code requires separate votes for each of the tax rates—Maintenance and Operations and Debt Service. As a result, three votes are Agenda2007109.21TSY02 required to approve this action. This ordinance is prepared for first and final reading, in accordance with Charter provisions. Recommendation. Staff recommends approval of all three votes, ultimately approving Ordinance T2006-25, on first and final reading, providing for the assessment and levy of Ad Valorem taxes at the rate of $.5764/$100 evaluation: $.5016/$100 evaluation for maintenance and operations of the General Fund; and $.0748/$100 evaluation for the payment of debt service of general obligation tax debt. 1. Vote to approve M&O tax rate of$.5016/$100 evaluation. This vote sets the Maintenance and Operation tax levy that supports the General Fund operations. 2. Vote to approve the Debt Service tax rate of$.0748/$100 evaluation. This vote sets the tax rate to levy taxes to pay the General Obligation Tax Debt of the City. 3. Vote to adopt Ordinance T2007-16. This vote authorizes assessment of taxes based on the combined tax rate of $.5764/$100 evaluation. Attachment 1. Ordinance T2007-16 Agenda2007109.21TSY02
