EASEMENT
That Polly Ranch Estates, Inc. ,
hereinafter called "Grantor," for a good and valuable consideration,
paid by the City of Friendswood, of the County of Galveston, Texas, here-
inafter called "Grantee," does hereby grant, sell, and convey unto
Grantee an easement and right-of-way upon and across the following de-
scribed property of the Grantor: A 20 ft. wide permanent easement
across the air strip of Polly Ranch Estates, a subdivision lying within
the Sarah McKissick or J. R. Williams League, Abstract 151, and John
Dickinson League, Abstract 15, replat of said Polly Ranch Estates.

The easement and right-of-way hereby, conveyed shall be a 20 ft.
wide.permanent easement across.the air strip,of. Polly Ranch Estates.
and more particularly described as follows:
BEGINNING at the common southerly corner of the air strip and easterly
corner of reserve "J" in the northwesterly line of the 60' right-of-
way of Airline Drive or Pine Drive, said point lying S 36004'03' 14
90.92' from the PC of the most easterly curve of the northwesterly line
of the 60' right-of-way of Airline Drive or Pine Drive, as set forth on
the said replat of Polly Ranch Estates;
THENCE N.62006' W 3401.39' with the southwesterly line of the air strip
and northeasterly line of reserve "J" and lots numbers 141 through 170
to the common westerly corner of the air strip and northerly corner of
lot 170 in the southeasterly ,line of the 80' right-of-way of Oak Drive;
THENCE N 37035' E 20.29' with the southeasterly line of the 80' right-of-
way of Oak Drive to a point for corner;
THENCE S 62006' E 3403.15' to a point in the northwesterly line of the
60' right-of-way of Airline Drive or Pine Drive;
THENCE 20.66' with a curve to the right having a radius of 320' to the
place of beginning;
SAID boundary enclosing an area of 1.562 acres out of the John Dickinson
League, Abstract 15, and the Sarah McKissick or J. R. Williams League,
Abstract 151.

The right-of-uay, easement, rights, and privileges herein granted
shall be used for the purpose of placing, constructing, operating,
repairing and maintaining pipelines for the transmission of water and
sewerage.
The easement, rights, and privileges herein granted shall be
perpetual. Grantor hereby binds himself, his heirs, and legal representa-
tives to warrant and forever defend the above described easement and
rights un Grantee, its successors, and assigns, against every person whom-
soever lawfully claiming or to claim the same or any part thereof.
This instrument shall be binding upon the heirs, executors, admini-
strators, successors, and assigns of the parties hereto.
In addition to the easement, rights, and privileges herein conveyed,

Grantee shall have the right to use so much of the surface of the hereto-
fore described property of Grantor as nay be reasonably necessary to
contruct and install within the right-of-way granted hereby the facilities
contemplated by this grant. Upon the completion of such construction and
installation, Grantee shall replace and restore all fences, walls, or
other structures which may have been relocated or removed during the con-
struction period, and Grantee shall pay Grantor reasonable ocmpensation
for such fences, walls, or structures which may not be replaced.

Re: A 15 foot wide permanent sanitary sewer easement with 35 foot
wide temporary construction easement across reserve "F" of
Polly Ranch Estates. Being an easement for trunk line to
serve the Blackhawk Regional Wastewater Treatment Plant.
Dear Mr. Morgan:
In reply to your letter dated November 9, 1978 concerning the ex-
tension of sanitary sewer easempn` across the site of Frenchman's
Creek Townhouses (same being ressrv-: of Polly Ranch Estates),
we have made preliminary investigations for the re-routing of said
easement across reserve "G" (being Park Reserve) in lieu of extending
the lines thru Reserve "F". The preliminary investigations included
both field work and office evaluation.
Special emphasis had been placed by the architects and engineers on
this project in order to save the aesthetic natural value of the site
thereby providing a nice environment for the residents of the French-
man's Creek Townhouses.
The alignment of the proposed sanitary sewer easement as delineated
on the attached exhibit shows the following:
1. The 15 foot wide easement in addition to the 35 foot wide
temporary easement will cut through the site of Frenchman's
Creek Townhouses. As a result, several important trees will
be removed.
2. The overhead crossing supporting the lines across Clear Creek
will damage the natural look sought for in the original design,

and land planning os the project.
3. The location of the 15 foot wide sanitary sewer easement will
interfere with the location of the proposed facilities for
the recreational and amenity area for Frenchman's Creek Town-
houses. In addition, the 35 foot wide temporary construction
easement will interfere with the physical location of the Units
in Frenchman's Creek Townhouses.
From the cost standpoint, we have found the following:
Re-routing the lines thru reserve "G" as indicated on the
attached exhibit will result in savings of approximately 350
lineal feet of force main. This will amount to approximately
$20,000 in savings.
The alignment thru reserve "G" will lend itself to better
working conditions, which will help eliminate the use of
sheathing and well pointing. This will amount to additional
savings of approximately $10,000.
3. The easement will be offered to the City of Friendswood thru
reserve "G" at no cost. However, the owner, Mr. John Hook
is in the process of making agreement with the owner of a tract
of land to the East of the treatment plant to, grant the necessary
easements. The City will only be obliged to pay for the 400'±
easement North of Clear Creek immediately East of the Treatment
Plant.
4. We are in the process of evaluating the underground crossing in
lieu of the proposed overhead crossing. Based on our preliminary
investigations of this part of the project, we feel that a possible
savings of approximately $50,000 can be realized.
On several occassions we have discussed the above changes with Mr. David
Guggemos, with Engineering Science, Inc. He has indicated that they will
be willing to work with us,on this project should the alternative scheme
prove to be more economical.
Due to the above mentioned reasons, we hereby respectfully request the
Honorable Mayor and City Councilmen of the City of Friendswood to approve
our alternative scheme for rerouting the sanitary sewer easement. We are
eager to trork with the City of Friendswood in order to produce the necessary
construction documents expeditiously. We do realize the time table the City
of Friendswood has to keep; and we promise to work with the City of Friends -
wood in order to keep up with the time table.
