That Pony.Ranch Estates, Inc.
hereinafter called "Grantor," for a good and valuable consideration,
paid by the City of Friendswood, of the County of Galveston, Texas, here-
inafter called "Grantee," does hereby grant, sell, and convey unto
Grantee an easement and right-of-way upon and across the following de-
scribed property of the Grantor: A 15 ft. wide permanent easement across
Reserve "1)of Polly Ranch Estates, a subdivision lying within the Sarah
McKissick or J. R. Williams League, Abstract 151, and John Dickinson
League, Abstract 15, replat of said Polly Ranch Estates.
AS APPEARS OF RECORD IN MAP BOOK NO. 15 AT PAGE, NO. 4. OF THE RECORDS OF
GALVESTON COUNTY.

The easement and right-of-way hereby'conveyed shall be a 15 ft.
wide.permanent easement across Reserve "H',' of Polly Ranch Estates.

and more particularly described as follows:
BEGINNING at a point in the southeasterly line of the 60' right-of-way
of Pine Drive or Airline Drive at the common northwesterly corner of
reserve "G" and reserve' °H" as set forth on the said replat of Polly
Ranch Estates;
THENCE S 62°06' E 15.0' with the common line of the said reserve "G" and
reserve "H";
THENCE S 27 54' W 35.0' to the PC of a curve;
THENCE 90.80' around a curve to the right having a radius of 395'.0' to
a point for corner, said point lying S 34°25'39" W 90.39' from the PC
of the curve;
THENCE N 62 06' W 15.32' to a point in the southeasterly line of the 60'
right-of-way of Pine Drive or Airline Drive, said point also lying in `
an extension to the southeast of the southwesterly line of an air strip
as shown on the said replat of Polly Ranch Estates;
THENCE 90.86' around a curve to the left with the common southeasterly
line of the 60'. right-of-way of Pine Drive or Airline Drive and
northwesterly line of reserve "H" as set forth on the said replat of
Polly Ranch Estates to the PT of the curve, said PT lying N 34°45' E
90.65' from the previous point;
THENCE N 27°54' E 35.0' with the common line of the 60' right-of-way
of Pine Drive or Airline Drive and reserve "H" as set forth on the said
replat of Polly Ranch Estates to the place of beginning;
SAID boundary enclosing an area of 0.043 acres out of the John Dickinson
League, Abstract 15.

The right-of-way, easement, rights, and privileges herein granted
shall be used for the purpose of placing, constructing, operating,
repairing and maintaining pipelines for the transmission of water and
sewerage.

The easement, rights, and privileges herein granted shall. be
perpetual. Grantor hereby binds himself, his: heirs, and legal representa-
tives to warrant and forever defend the above described easement and
rights un Grantee, its successors, and assigns, against every person whom-
soever lawfully claiming or to claim the same or any part thereof. ,.
This instrument shall be binding upon the heirs, executors, admini-

strators, successors, and assigns of the parties hereto.
— In addition to the easement, rights, and privileges herein conveyed;
Grantee shall have the right to use so much of the surface of the hereto-
fore described property of Grantor as may be reasonably necessary to •
contract and install within the right-of-way 'granted hereby the facilities
contemplated by this grant. Upon the completion of such construction and

installation, Grantee shall replace and restore all fences, walls, or
other structures which may have been relMzted or removed during the con-

struction period, and Grantee shall pay Grantor reasonable compensation
for such fences, walls, or structures which may not be replaced.
