MINUTES OF A SPECIAL MEETING OF THE FRIENDSWOOD CITY COUNCIL THAT WAS HELD ON
MONDAY, JUNE 4, 2007 AT 5:30 PM AND A REGULAR MEETING AT 7:00 PM AT FRIENDSWOOD
CITY HALL COUNCIL CHAMBERS, 910 S. FRIENDSWOOD DRIVE, FRIENDSWOOD, TEXAS, WITH
THE FOLLOWING PRESENT CONSTITUTING A QUORUM:

Councilmember Ewing was absent from the meeting.
Mayor Smith called the meeting to order.
CLOSED EXECUTIVE SESSION
Council convened into Executive Session in Accordance with the Texas Government Code, pursuant to
Section 551.071 — Consultation with Attorney concerning pending or contemplated litigation; a settlement
offer; or a matter in which the duty of the Attorney requires it and Section 551.072 — Deliberation
regarding Real Property.
Council convened into Regular Session at 7:00 pm with no action taken later in the meeting.
RECONVENE INTO OPEN SESSION
7:00 PM— REGULAR SESSION
The invocation was given by Pastor Charles Quiroz with Calvary Chapel.
Mayor Smith led the Pledge of allegiance to the United States and to the State of Texas.
Best wishes were given to Councilmember Peden on his 19t"wedding anniversary and to Councilmember
Ewing who was out of town with her family.
SPECIAL RECOGNITION AND ACKNOWLEDGEMENTS
A presentation was given of the International Institute of Municipal Clerk's (IIMC) Quill Award and was
presented by Mayor Smith in lieu of IIMC Vice President Mary Lynne Stratta, City Secretary of Bryan, to
recipient Friendswood City Secretary Deloris McKenzie. Deputy City Secretary Melinda Welsh presented
a plaque from the City Secretary's office's past and present Staff and presented a PowerPoint of pictures
taken at the awards ceremony held in New Orleans, Louisiana.

COMMUNICATIONS FROM THE PUBLIC
Dan Illerich, Friendswood resident, was on the agenda scheduled to speak regarding the Friendswood
War Memorial and was not present.
Bea Morris, Friendswood resident, stated she is in support of the acceptance of a proposal for the
acquisition of an easement for the Clover Acres Drainage Project. Ms Morris stated Clover Acres
drainage has been an ongoing problem for over 30 years and has serious problems with a dam created
by the Texas Department of Transportation (TxDOT) at FM 2351.
CITY MANAGER'S REPORT
City Manager Bo McDaniel reported on the disposition of RFP 2006-15 for the Outsourcing of Information
Technology (IT) Services, presented results of Staff's research into the possibility of outsourcing
Information Technology services to an independent third party provider versus an in-house/on-site Staff.
The City Manager reported on the monthly Capital Projects status and it is on progress with the current
capital projects.
The City Manager reported on the update of the Glenshannon Drainage Project and read a memo from
the Community Development Department addressing the requirement to secure a permit from the U.S.
Army Corps of Engineers and stated Council was advised of this possibility in January. Once access to
the property is acquired, this process may take four to six months before the actual construction bid can
be awarded and the work to install the drainage system can begin. The City Manager stated the City
Attorney advises that both parties have reached agreement on the terms of the negotiated acquisition and
that closing is to be set shortly with transfer of the City's acquisition and use rights to follow thereafter.
The City Manager reported on the Public Safety Building (PSB) Project. The PSB is nearing completion
with an official ribbon cutting ceremony targeted for the end of June followed by an Open House.
Friendswood Police Chief Wieners reported on an updated timeline for the project.
The City Manager reported on the status of the National Economic Development (N ED) review by Halff
and Associates. Halff and Associates is set to meet on June 4 with the U.S. Army Corps of Engineers,
consulting engineers and Dannenbaum Engineering, who has designed this project. This meeting is for
Dannenbaum Engineering to explain the report prior to Halff's review.
ACTION ITEMS
**Councilmember Rivera moved to approve the award of Bid No. B2007-08 to Repipe Construction, LTD,
for the 2007 Sewer Rehabilitation Project and authorizing the Mayor to execute the contract.
Seconded by Councilmember LeCour. The motion was approved 5-0.
**Councilmember LeCour moved to approve an agreement with Friendswood Lakes Homeowner's
Association for installation and future maintenance of fence adjacent to the new Public Safety Building.
Seconded by Councilmember Hill. The motion was approved 5-0.
**Councilmember Hill moved to approve and accept easements for the Deepwood Force Main Project
and appreciate cooperation and help from Friendswood Citizen to obtain this easement.
Seconded by Councilmember Rivera. The motion was approved 5-0.

**Councilmember Hill moved to approve the acceptance of a proposal for the acquisition of an easement
for the Clover Acres Drainage Project.
Seconded by Councilmember Reid. The motion was approved 5-0.
**Councilmember LeCour moved to approve a settlement agreement with the Office of the Attorney
General regarding an open records request.
Seconded by Councilmember Rivera. The motion was approved 5-0.
**Councilmember Reid moved to approve Resolution R2007-24- A Resolution of the City Council of the
City of Friendswood, Texas, making findings concerning certain land described in such resolution;
determining that such land is needed for construction of the South Friendswood Force Main Project for
the City of Friendswood, Texas; ratifying final offer by City Manager, and authorizing City Attorney to bring
eminent domain proceedings.
Seconded by Councilmember Hill. The motion was approved 5-0.
COMMUNICATIONS FROM THE MAYOR AND COUNCILMEMBERS
Councilmember LeCour stated he attended the Keep It Sold for Space Exploration in Washington, DC,
along with Councilmembers Peden and Ewing, he had encouraged the City to send citizens, he went to
protect the Space Program and noticed that many elected officials did not know the true benefits of the
Space Program and it was very beneficial to attend to help educate the elected officials, thanked his
company, MI Technology, for sending him. The City sends representatives and it is very rewarding and
very enlightening.
Councilmember Hill reported that he met with the Texas Department of Transportation (TxDOT) from the
La Marque district regarding drainage, other issues, and flooding in front of Friends Church, along with
City Manager Bo McDaniel, President of Galveston County Consolidated Drainage District Harold
Whitaker, past Councilmember Jay Horecky and Interim Director of Community Development Frank
Manigold. Councilmember Hill stated TxDOT showed up in Friendswood this week and is putting in a
new inlet on FM 518 in front of the Friends Church which will hopefully give some relief from the flooding
and stated he appreciated the quick response.
Councilmember Rivera stated he is in a steep learning curve and learning more about the City.
Councilmember Reid stated she appreciates that her first Council meeting was less than one hour long.
Mayor Smith acknowledged the comments regarding the grand opening of the new Public Safety Building
and knows that everyone is looking forward to getting the Police Department, Municipal Court and the
Fire Marshal's office into the building, the building has been built by the people that are going to use it
and will serve the citizens well for many years, reminded everyone that school is out and there are a lot of
teen drivers, keep a watchful eye and keep them safe.
CONSENT AGENDA
**Councilmember Hill moved to approve the Consent Agenda as presented A. Accept Emergency
Management Performance Grant and authorize the Mayor to execute the grant documents. B. Approval
of the April, 2007 Property Tax Report. C. Approve Minutes of April 16, May 7, and May 21, 2007
Meetings.
Seconded by Councilmember Rivera. The motion was approved 5-0.
A motion was made and approved to adjourn at 7:54 PM.
