A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
FRIENDSWOOD, TEXAS, MAHING FINDINGS CONCERNING A
CERTAIN 31,664 SQUARE FOOT TRACT OF LAND, MORE OR LESS,
DESCRIBED IN SUCH RESOLUTION; DETERMINING THAT AN
EASEMENT OVER,ACROSS AND UNDER SUCH LAND IS NEEDED FOR
CONSTRUCTION AND MAINTENANCE OF STORM DRAINAGE
FACILITIES INCIDENTAL TO THE GLENSHANNON DRAINAGE
PROJECT; RATIFYING AND CONFIRMING THE FINAL OFFER MADE
BY THE CITY MANAGER TO THE OWNERS OF SUCH LAND; AND
AUTHORIZING THE CITY'S ATTORNEYS TO ACQUIRE SUCH LAND
THROUGH EMINENT DOMAIN PROCEEDINGS.

WHEREAS, the City Council of the City of Friendswood finds and determines that public
convenience and necessity require that the City acquire a storm drainage easement(the"Easement")
over, across and under a certain 31,664 square foot tract of land, more or less, located in the Central
Park Subdivision, Friendswood, Galveston County, Texas, said tract being mare particularly
described by metes and bounds in Exhibit "A" attached hereto and made a part hereof for all
purposes; and
WHEREAS, the City of Friendswood, through its duly authorized representative, has
negotiated with the owners of said tract of land for the purchase of such Easement for the herein
stated purpose and has been unable to agree with such owners as to the fair market value thereof and
damages, if any; and
WHEREAS, the City Council of the City of Friendswood has authorized the City Manager
of the City to make a final offer to the owners of said tract for the purchase of said Easement based
upon its appraised value, and such final offer has been made and the owners have refused to accept
such final offer; now,therefore,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FRIENDSWOOD,
TEXAS:
Section 1. The facts and matters set forth in the preamble of this Resolution are hereby
found to be true and correct.
Section 2. The City Council of the City of Friendswood finds that bona fide
negotiations have been conducted by authorized representatives of the City for the acquisition of the
Easement over the herein described tract of land, and that said negotiations were not successful and
have failed, and that the only way for the City of Friendswood to acquire such Easement is through
the filing of eminent domain proceedings.
Section 3. The heretofare described Easement is needed for construction and
maintenance of storm drainage facilities, including, but not limited to, an underground storm sewer
having a diameter that varies from sixty inches(60")and ninety inches (90").
Section 4. The final offer heretofore made by the City Manager for the purchase of said
Easement is in all things hereby ratified, confirmed,and approved.
Section 5. The attorneys for the City are hereby authorized to bring eminent domain
proceedings on behalf of the City of Friendswood under applicable provisions of law, whether as
provided by Chapter 21 of the TEXAS PROPERTY CODE, Chapter 251 of the LOCAL GOVERNMENT
Code, ar by any other provision of law, against the owner or owners of said tract, to-wit: Virginia
G. Boone, C.R. Boone and Family, Ltd. and C. Robert Boone and Barry D. Boone as
Independent Co-Executors of the Estate of Carroll L. Boone, deceased, or against the real and true
owner, owners, claimant, or claimants if the said Virginia G. Boone, C.R. Boone and Family, Ltd.
and C. Robert Boone and Barry D. Boone as Independent Co-Executors of the Estate of Carroll
L. Boone, deceased, are not the owners of said tract. All actions heretofore taken by the attorneys
for the City to initiate eminent domain proceedings as aforesaid are hereby in all things ratified,
confirmed, and approved.
