MINUTES OF A SPECIAL MEETING OF THE FRIENDSWOOD CITY COUNCIL THAT WAS HELD ON
MONDAY, JANUARY 15, 2007, AT 5:00 PM AND A REGULAR MEETING AT 7:00 PM AT
FRIENDSWOOD CITY HALL COUNCIL CHAMBERS, 910 S. FRIENDSWOOD DRIVE, FRIENDSWOOD,
TEXAS, WITH THE FOLLOWING PRESENT CONSTITUTING A QUORUM:

Mayor Smith called the meeting to order.
5:00 PM —SPECIAL SESSION
Discussion was held regarding the City of Friendswood Water and Sewer Capital Improvements Program.
City Manager Bo McDaniel provided an overview of the program and process. Staff will be prepared to
address the following phase of work sessions on the Capital Improvement Project (CIP) dealing with
Water and Sewer issues. Mr. McDaniel stated Council will recall that we are trying to focus on the next
phase and project priorities consistent with Council's direction, within funding and management capacity
to administer effectively and efficiently. Staff clearly understands that Council wants as many of these
projects committed, in process as soon as possible without mismanaging the taxpayer's resources.
Considering our interim staffing needs and this work level, we have contracted with Dan Johnson, former
Community Development Director to assist coordinating and overseeing the process given his institutional
knowledge, experience and value provided during his employment. Mr. McDaniel stated he has also
asked Dan Johnson to provide a proposal for CIP project oversight services as provided by him and his
new firm Ryan Civil Engineering, LLC. Dan Johnson led the discussion, but did not speak for Public
Works Director Kaz Hamidian professional recommendation to Council. Mr. McDaniel stated they will
also explain where we are on financial status of these projects, including what data we are preparing for
your review and when you can expect that financial status report. Dan Johnson presented an impact
analysis of water and sewer projects, reviewed a projects list of thirty projects by priority, Vision 2020
goals, ranking, status, consistent with Council goals, included in the 2006 project ranking were external
mandates, recipient of benefits, decreases operations and maintenance and external funding available,
specifically the first eight projects identified, those eight projects are Deepwood Force Main, Deepwood
lift station expansion, South Friendswood Force Main diversion, water distribution replacement and
upgrade-Blackhawk, Sunmeadow lift station, water distribution replacement and upgrade sixteen inch
line, additional surface water purchase and Bay Area Boulevard waterline. Dan Johnson stated that this
analysis may need to be expanded or decreased and may need to be adjusted if the Millennium project
came along with water and sewer projects, determined it is not on the radar screen, but if added that
would be project number thirty one at end of project, still a lot of unknown about the Millennium project,
could not wait on this project. Councilmember Peden stated he would like to see another line drawn for
additional projects using reserve amounts or capital funds available and add another column to the

analysis regarding if project generates revenue, commercial, or other.

The invocation was given by Father Thomas Vellappallil with Mary Queen Catholic Church.
Mayor Smith led the Pledge of Allegiance to the United States and to the State of Texas.
COMMUNICATIONS FROM THE PUBLIC
Fred Krch, 209 Dawn Hill, addressed Council and stated he has been a resident for over forty years, the
City needs to look at recovering treated water from the Blackhawk Treatment Plant, addressed
immigration on criminal trespass, read letters from several politicians regarding immigration reform and
criminal trespass, and addressed the League of United Latin American Citizens (LULAC) recent
appearance before Council, stated that if you do not do what LULAC wants they will sue the City.
Kathy Bradley, 501 N. Sarah Deel, Webster, addressed Council and stated she is a volunteer for the City
of Seabrook and would like to invite the City Council to participate in the Bay Area Fitness Challenge,
would be a chance to market the City and would be a fitness challenge between elected officials is
October 26, 27, and 28, 2007, if the City chooses to participate, would ask for a representative to serve
on the committee from each City, and events will include Police Departments and Fire Departments.
Judy Kimball 802 W. Edgewood, addressed Council and referred to an article in the Houston Chronicle, a
blood drive for military, volunteer blood donors are needed, need to support our troops, spoke on the
number of injuries and deaths in Afghanistan and Iraq, would like to see Friendswood push this drive over
their goal, would like to see positive on Friendswood instead of negative.
Kathy Gibb, 1909 DeSota, addressed Council and stated she is trying to build her dream home on two
acres of land in Friendswood, had no idea the magnitude of the process to build in Friendswood, the
requirements have destroyed the dream, please pass agenda item C and do not put people through what
she has been through.
Faye Roberson, 422 W. Castleharbour, addressed Council and stated she would like to make Council
aware of a big problem in Sunmeadow Subdivision, there is a proposed development of hundreds of
homes planned off of a stub-out street of Point Royal, ask developer to have street off of FM 528, meeting
tomorrow night.
Deidre Carey Brown, 3554 Prince Edwards, addressed Council and stated after reviewing the agenda
today she recognized that something was missing, the observance of Martin Luther King (MLK) Day, read
quotes from MLK, was taught by her family to be active, to be involved, has resigned from the Community
Economic Development Committee, will continue to be a volunteer in Friendswood, will offer her service
to the City, thank you for allowing service and appreciates Council's service.

COMMUNICATIONS FROM COMMITTEES AND SPECIAL REPORTS
Leola Hill Hancock, Chairman of Charter Review Commission, introduced the members of the
Commission, presented the final Charter Review Commission Report, outlined the sixteen proposed
amendments unanimously submitted by the Commission, the Commission will be available to workshop
proposals if needed. City Secretary Deloris McKenzie stated it was an honor to work with this
Commission with diverse personalities and City Manager Bo McDaniel stated he was impressed by the
Commission, City Attorney John Olson stated it was a pleasure working with the Commission and it was
the best Commission he has ever worked with, Mayor and Council gave comments to Commission,
thanked them for their hard work and fourteen meetings and time spent, appreciates Commission, there
were diverse personalities, strong opinions, passion, different views, respect, and due diligence, looks
forward to working further with the Commission, thank you and appreciates their hard work.
CITY MANAGER'S REPORT
City Manager Bo McDaniel reported on the Glenshannon Drainage Project and gave an update to Council
and stated Council is aware that a regular mail and certified mail informal request was sent to Dr. Boone
to request a direct meeting with him and his wife, Mayor Smith and myself. As of Wednesday afternoon,
January 10, 2007 we heard from Dr. Boone who agreed to meet with Mayor Smith and I Friday afternoon,
January 12, 2007. This is the only time he was available that his attorney could attend. The City Attorney
John Olson attended to represent the City's interests. Based on the results of this meeting, Mayor Smith
and I will be able to advise Council accordingly regarding options for procurement. We are encouraged
that Dr. Boone responded in a timely manner. Hopefully, this is a positive indication we can reach a
mutually beneficial negotiated agreement without considering condemnation.
City Manager Bo McDaniel reported on the Friendswood Rotary Club that recognized Friendswood Police
Department Officer Archie Mizell as Officer of the Year for 2006 at their December luncheon. This award
was made in recognition of Officer Mizell's exemplary service above and beyond the call of duty. Officer
Mizell demonstrates the commitment and selfless actions that Texas law enforcement officers are faced
with each and every day. Officer Mizell is a 1999 graduate of Friendswood High School. He began his
law enforcement career in December 2002 as a Friendswood Police Officer shortly after graduating from
the Alvin Community College Law Enforcement Academy. In May 2004, he became a certified SWAT
officer. In April 2005, Mizell received his Intermediate Peace Officer Certification and became a Field
Training Officer. In March 2006, he earned his certification as a police instructor. In October 2006, he
became certified as a sniper. Officer Mizell is a valuable member of the Friendswood Police Department
and continues to demonstrate leadership qualities. Officer Mizell is recognized for his actions in response
to several critical incidents as a SWAT team member, his response to dangerous calls for service, which
resulted in felony arrests, and his recognized skills in the detection of DWI drivers and suspects involved
in illegal narcotics activity. Officer Mizell has demonstrated tremendous bravery and courage throughout
his career as a Friendswood Police Officer. The City proudly recognizes Officer Mizell as a dedicated
professional who represents the highest model of what a police officer should be.
City Manager Bo McDaniel reported on the State designated advanced level of preparedness. State law
requires that each city and county in Texas be covered by an emergency management plan and update
the plan every five years. The State of Texas maintains a jurisdictional preparedness profile that rates
each city and county's emergency planning efforts. For the past five years the City of Friendswood has
maintained the City's Emergency Management Plans at the Advanced Level. The latest profile received
last month has rated Friendswood as having met the requirements for the Advanced Level of
Preparedness once again. The City's Emergency Management Plan and all 22 annexes have been
updated to meet all state and federal requirements. These plans provide the framework for operations in
the event of a major emergency. By meeting the advanced level of preparedness, the City is eligible for
consideration for the Emergency Management Performance Grant program in 2007. The City has been
receiving funding from this program for the past eight years and last year received $42,600. After

Tropical Storm Allison in 2001, the City of Friendswood found itself eligible for several funding
opportunities because the Emergency Management Plans were in place and they were rated as having
met the advanced level of preparedness. The advanced level rating will also assist in getting a better
ranking for any future pre-disaster mitigation projects that the City may be interested in. City Manager
Thanked Fire Marshal and Emergency Management Terry Byrd for his good work.
City Manager Bo McDaniel reported on the status of a joint use facility with Galveston County
Consolidated Drainage District (GCCDD) for soccer fields, presented information to Council for
consideration, fields would be used at least 95% of the time, need to make some determination, safety is
the main issue on ingress and egress, parking, report is based on the status and what the next step is,
recommendation for the next step would be for Council to direct the City Manager to pursue further to
develop implementation plan for Council to consider, get input from the Parks and Recreation Board
regarding use. Council appreciates City Manager's work on the feasibility of this, help to respond to
Galveston County Consolidated Drainage District (GCCDD) if interested in use, thinks should express if
City is interested, does not want to spend funds on this and not be able to use, City has other sports clubs
that are in dire need, more so than soccer, appreciates work that has been done, another issue would be
restroom facilities, could be a win/win situation, all coming out of the same pocket, anytime there is a
partnership it is a win for both parties, parking is going to be a problem, may need to look at parking on
some of the retention area, need to make it handicap accessible, suggests turning it over to the Parks
and Recreation Board to look at and bring back with associated costs and recommendation, could have
jogging trails, agrees this is something to pursue and get into schedule to consider later on, suggested
not send to the Parks and Recreation Board without a budget, needs to be done with quality, not halfway,
how can the Parks and Recreation Board give us the best bang for our buck, does not do citizens good to
have athletic fields if they have water in their living room, important issue is drainage, if going to build,
then build quality, should not commit funds right now, ask the Parks and Recreation Board to get
feedback as to what fields are most important at this time, not to plan it just to advise next critical need,
GCCDD has already designed and put in pilot channels for soccer fields and will be available if needed,
look at applying grant in varying options to help fund development and would have to look at
management cost to maintain facility, possibly check with local sports groups to participate and check
with National Soccer Organization for a grant match, consensus of Council is to bring back with more
detail and then consider commitment, consensus of Council is that the City does want the use of this
property and thanked GCCDD for this offer and joint participation, this area would meet the Parks Master
Plan for a park in this area, funds are available through Houston-Galveston Area Council (HGAC), plan to
flush out more potential opportunities that exists for resources such as volunteering and grants, rough
implementation plan, proposal for consultant to help with grant program and bring back in a couple of
months with this information, thanked GCCDD for this proposal.
ACTION ITEMS
**Councilmember Hill moved to award RFP No. 2006-18 for Fiber Optic Cable Installation for the new
Public Safety Building to Christian Telecommunications & Cabling, Inc.
Seconded by Councilmember Ewing. The motion was approved unanimously.
**Councilmember Measeles moved to award Bid No. B2006-21 for a Diesel Powered Tractor with a 20.5
ft. Boom to Brookside Equipment Sales, Inc.
Seconded by Councilmember Hill. The motion was approved unanimously.
**Councilmember Peden moved to amend authorizing the temporary suspension of code enforcement
action concerning sign regulations, pending review for possible amendments of all or part of Ordinance
2005-08, especially those sections dealing with Portable Signs, Reader Board Signs and Temporary
Signs. Amended motion propose to have an ordinance prepared to strike Section 12 - 2 from the sign
ordinance and forward to the Planning and Zoning Commission for process. Consensus of Council that
Staff will continue to enforce ordinance as written until sign is changed.

Councilmember Ewing left Council Chambers.
**Councilmember Measeles moved to award Bid No. B2006-19 for two new Pickup Trucks for Public
Works to Tommie Vaughn Motors, Inc.
Seconded by Councilmember Hill. The motion was approved 6-0.
**Councilmember Peden moved to award Bid No. B2006-20 for Water and Sewer Supplies for 2007 to
HD Supply and authorize the Mayor to execute the contract.
Seconded by Councilmember Hill. The motion was approved 6-0.
Councilmember Ewing returned to Council Chambers at this time.
**Councilmember Horecky moved to approve authorizing the Mayor to execute an amendment to the
contract with LJA Engineering for design of the Blackhawk Boulevard Waterline replacement and
upgrade.
Seconded by Councilmember LeCour. The motion was approved unanimously.
**No action was taken on the negative recommendation from the Planning and Zoning Commission in
response to a Zone Change Request for 24.62 acres off FM 528 from SFR to CSC due to the applicant
withdrawing the request.
**Councilmember Horecky made a motion to consider a change to Galveston County Tax Collector for tax
collection services.
Seconded by Councilmember Peden. The motion was approved 4-3, with Mayor Smith,
Councilmember Ewing, and Councilmember Measeles opposed.
Councilmember Horecky placed this item on the agenda, the contract with Friendswood independent
School District (FISD) expires in March with a prior 30 day notice, after meeting with FISD, need to have
an answer by the end of January, would be a savings to the City, Galveston County Judge James D.
Yarbrough stated he would like to see the County collect all taxes and provide free of charge.
Councilmember Peden stated it would be a savings to the City, was in a meeting and heard Judge
Yarbrough state that he would like the County to collect taxes for FISD and for the City of Friendswood.
Councilmember Measeles asked who collects taxes for Harris County with Councilmember Peden stating
that FISD currently collects taxes for Harris County. Mayor Smith stated this would be a savings to the
City but not to the citizens, FISD is not going to use Galveston County, over 70% of taxpayers will have to
pay for both collection services, school taxes may go up to pay for Staff and to collect for the school
district. Councilmember Peden stated people on the Harris County side of City of Friendswood would be
saving money. Mayor Smith stated the real cost savings is when we have one entity collecting taxes for
everybody. Councilmember Ewing stated she talked to Judge Yarbrough who expressed concerns about
the new computer system and getting the bugs out, would recommend to wait at least one year, would
like to correct that FISD deposits daily not weekly, it is a big deal to have a local office open every day,
citizens get accustomed to this kind of service. Councilmember LeCour stated he heard the rate of
deposits weekly or daily saves or gains this City money, would like to see the numbers, could not be
produced at the FISD meeting. Director of Administrative Services Roger Roecker stated the City gains
money from interests by depositing daily. Councilmember Horecky stated the Galveston County proposal
would deposit daily, Councilmember LeCour stated another issue is having a tax office here, Judge
Yarbrough stated he would entertain the idea of putting an office here, how do you pay Galveston County
taxes without leaving the City of Friendswood, sees a potential positive, would like to work with Judge
Yarbrough to get an office here and work with FISD to save $100,000 to put back into the classroom, it is
a win, win, win. Councilmember Hill stated he has always mailed his check to the County and has had no
problems, uses annex off of Calder Road, if want to pay in person could go to Calder Road, did not

appreciate FISD meeting thought it was bogus, FISD should let County collect taxes and hire two new
teachers. Councilmember Measeles stated he would like to get a written proposal from Galveston County
and FISD to compare apples to apples. Councilmember Peden stated it was mentioned there was a
meeting with Judge Yarbrough, requested if the meeting had been done in writing, not in a recording.
Mayor Smith stated there was a difference in collection rate between FISD and Galveston County.
Councilmember Peden stated he was appalled at the FISD meeting, their mind had already been made
up, they were not interested in savings for their school children, hopes the School Board does the right
thing and goes with Galveston County for the cost savings. Councilmember Horecky stated he would like
to clarify the motion to change to Galveston County, negotiate with Galveston County and see what is
offered. Mayor Smith stated we are not saving money until FISD changes too.
ORDINANCE
**Councilmember Peden moved to approve the second reading of Ordinance No. T2006-28, An
Ordinance amending Appendix C of the Code of Ordinances of the City of Friendswood, Texas, said
Appendix C being the Zoning Ordinance of the City, by changing the zoning classification of a 0.8953
acre tract of land, more or less, same being located at 301 Laurel Lane, from Original Business District
(OBD) to Planned Unit Development District (PUD); providing for the granting of a Specific Use Permit to
authorize the use of property within said PUD for Office Park Uses; providing for the amendment of the
Official Zoning Map; imposing certain conditions; providing a penalty in an amount not to exceed $2,000
for each day of violation of any provision hereof; and providing for severability.
Seconded by Councilmember Horecky. The motion was approved unanimously.
COMMUNICATIONS FROM THE MAYOR AND COUNCILMEMBERS
Councilmember Ewing had requested to speak on Builder without Borders Sister City Program and
presented a brief PowerPoint presentation, did research and found Sister City International is a partner in
the congressional campaign for citizen diplomacy, is good for economic development, membership would
be $509, would like to partner with Builders without Borders of Texas in Carboneras, Mexico, with
Friendswood Community Church and Methodist Church taking groups, presented photos of City located
on Gulf of Mexico, it is a fishing village, the goal would be to have some conversation with their City
Council, there is only one Councilmember in the Village, it is a neighboring community of San Fernando.
Mayor Smith had requested to speak on the tax appraisal approval process. Mayor Smith questioned the
process, only 15% of property owners in Texas protest value, what would ramification be if not approve.
Councilmember Peden mentioned getting a legal opinion, thinks it may be illegal if do not accept
individually, state law says you cannot look at them. Mayor Smith stated he will continue to research to
see if doing the correct thing, check to see what would ramification be if City does not approve,
Councilmember LeCour stated his experience was that he was treated rudely, would like the City to offer
training sessions on how to protest, learned this by attending a training at the library last year held by Tax
Assessor Collector Cheryl Johnson, would like to see input from citizens, build a complaint file, gather up
input letters and then get Mr. Ken Wright with the Galveston Appraisal District to attend meeting to
address, City should not be paying to have citizens treated like garbage. Councilmember Horecky stated
he agreed, went there a couple of years ago with a professional, was treated awful, when spoke to Chief
Appraiser and Deputy they took care of the problem, some are rude. Councilmember Peden stated he
protests when taxes go up and for clients, has never been mistreated by anyone, thinks should allow Mr.
Wright to correct, should invite Mr. Wright annually and let him know if not treated right and let him correct
it. Mayor Smith stated he had no complaints about the people, Council concur to investigate how to do
this with help from City Attorney John Olson, what would be the step legally if want to not approve
process and how to do it.
Councilmember Horecky had requested to speak on amending the City Codes, Ordinances, procedures,
etc., such that Texas Department of Transportation (TxDOT) and/or Galveston County Consolidated

Drainage District (GCCDD) approvals are no longer required in the building or platting application
process. This shall apply to all parcels of five acres or less, regardless of location within the City, so long
as they are not divided into more than two lots. Parcels of fives acres or less shall not require on or off-
site detention/retention. Councilmember Horecky stated we have got to do something to stop destroying
the town, it is time we do something, there are a whole lot of little lots that nothing can be done with.
Councilmember Hill prepared a pie chart and presented to Council and to the public, has heard over the
last couple of months about a property owner that is trying to build in Friendswood, we are forcing them to
destroy property, tear down trees, engineering for plans run $20,000 to $50,000 to prepare, why do we
require TxDOT and GCCDD to approve plans for property less than five acres, pie charts show that the
City did not cause the flooding in Friendswood, others upstream and Harris County did, Harris County
Flood Control District has done absolutely nothing, they continue to let their people flood Friendswood
and have yet to move the first shovel of dirt to improve the flow of water in Clear Creek, the Corp of
Engineers has done nothing but spend millions on studies over the last four years and allowing others to
flood us while stopping our local drainage district every time they try to help the flooding problem in
Friendswood. The proposal of Councilmember Horecky is a small step in the right direction, exempting
five acres and smaller lots will have no effect on Clear Creek. The total amount of land is probably less
than 250 acres if we exempt five acre lots and less, would not have a problem exempting 500 acres
because it is still insignificant to the level of the water in the creek, 250 acres is fifteen hundredths of one
percent of the Clear Creek watershed, this will not effect flood insurance, Insurance Service Office (ISO)
ratings is overdue, we have spent millions relocating our citizens, destroyed both residential and
commercial land and trees, not to mention the City's tax base over a problem we did not create nor can
we solve. The situation is critical and it demands immediate action. This Council has an obligation to the
citizens of Friendswood to take action at the next Council meeting, let us stop destroying Friendswood
now. Mayor Smith mentioned the effect it has on people, touching the floodway it may still have to go to
the Corp of Engineers for approval. Councilmember Peden stated to give Council's questions to Staff to
get answers and schedule a workshop for January 22, 2007. City Manager Bo McDaniel with consensus
of Council as to legality of removing Corp of Engineers and Galveston County Consolidated Drainage
District (GCCDD) from this project. Harold Whitaker, board member of GCCDD, responded that GCCDD
is chartered by the state law, will be glad to dialogue with Council, but cannot exclude GCCDD from the
process nor can be removed, need to look at the best interest of the community, we are looking at a
criteria plan and cannot have completed by next week.
Councilmember Measeles reported on the Clear Creek Environment Foundation and if we are going to
assist financially in any way may need to place it on the next agenda for action, clean up on Clear Creek.
There was a recent report from Dannenbaum Engineering on rain received on October 06, 2006, an
impact of overall rainfall, throughout watershed the rain does not fall consistently, provided map of
floodplain and showed houses that are impacted showing 18 or 19 homes that are in the floodplain and
had water in their homes, need to consider to look at the possibility of another buyout at another time and
look at funding for this type of project.
Councilmember Peden stated he hopes everyone had a good holiday and happy New Year, enjoyed the
New Years party at Councilmember Horecky's home and really enjoyed it, was invited to Washington to
attend the Whitehouse briefing on the President's agenda for next year, was honored leaving this evening
for Austin for Governor Perry's inauguration and ball, was excited to serve as Mayor for three days.
Councilmember Hill stated over the holidays Kaz Hamidian, Public Works Director, was Acting City
Manager and there were no incidents, lost two town treasures, longtime resident and election helper, Pat
Hart and Jack Jeter who came to Friendswood in 1936, highlight of holidays was getting together to give
Steven Shultz, an injured Iraq soldier, a Subaru Golf Cart.
Councilmember Ewing stated there will be a tree giveaway on January 20, 2007 starting at 8:OOAM and
will end when they run out of trees.

CONSENT AGENDA
**Mayor Smith moved to approve the Consent Agenda with the exception of Item A1- Resolution
R2007-01, A Resolution of the City Council of the City of Friendswood, Texas, authorizing the
Friendswood Police Department to use unmarked vehicles in order to facilitate police undercover work
and other official duties of the police department. A2. Resolution R2007-02, A Resolution approving that
certain "addendum to certificates of authority" for the purpose of adding City Manager Robert T. McDaniel
and removing Deputy Director of Administrative Services Cindy Edge to the list of persons authorized to
act as signatories on city accounts at Wells Fargo Bank N.A., the City's banking depository. B. Approve
Street Banner Permit Application for the Knights of Co�umbus Annual Fish Fry. C. Approval of December,

Seconded by Councilmember Peden. The motion was approved unanimously.
**Mayor Smith moved to approve Item A1 - Resolution R2007-01, A Resolution of the City Council of the
City of Friendswood, Texas, authorizing the Friendswood Police Department to use unmarked vehicles in
order to facilitate police undercover work and other official duties of the police department.
Seconded by Councilmember Measeles. The motion was approved unanimously.
The unmarked units assigned to the following categories of duties in the police department are Police
Chief, Deputy Police Chief, Staff Services Commander, Patrol Division Commander and Criminal
Investigations Division personnel (detectives).
A motion was made and approved to adjourn at 10:08 PM.
