WHEREAS, Sunmeadow Development Co., by instrument recorded in Volume 10, Page 75 of the Map Records of Galveston County, Texas, granted to
0the City of Friendswood, an unobstructed easement across, over, along,�upon and under that certain tract of land more particularly described r-in said instrument; and,
U,.J. .• c,::>. .... ... ?5 .. WHEREAS, General Homes, Inc. (hereinafter referred to as "Owner", Lryh�ther one or more) is now the owner of said property; and,
� '.j ·· WHEREAS, Said instrument provides that Owner, its successors, as-�ig_ns, agents or licensees, shall not have the right to cause or permit gany·obstruction except property line fences to be placed on, constructed, c::oor to grow within the area of said easement without the express consent of the City of Friendswood; and,
WHEREAS, Owner now desires to construct and maintain structures within the area of said easement;
NOW, THE REFORE, KNOW ALL MEN BY THESE PRESENTS: THAT, the City of Friendswood-hereby consents to the construction and maintenance of Owner of the following structure within said easement area:
Driveway on and across the most Southeasterly portion of said easement affecting the property described in Exhibit "A" attached hereto,
said structure located solely within the portion of said easement as shown on the survey attached hereto as Exhibit "B".
In consideration of the consent hereinabove granted by the City of Friendswood to Owner, and in consideration of the use of said portion of said easement area Owner obtains hereby, owner binds itself, its successors and assigns, agents and licensees to indemnify and hold the City of Friendswood, its successors and assigns, harmless from all claims, lawsuits, costs and damages for injury to any person or property arising out of or in any way connected with the erection and use of said structure on said portion of said easement area except where such injuries are caused solely by the negligence of the City of Friendswood, its agents, employees, successors or assigns.
The exercise and enjoyment, by the Owner's successors, assigns, agents or licensees, of the rights and privileges to which the City of Friendswood has herein granted its consent shall constitute affirmative acceptance by such successors, assigns, agents or licensees of the terms and conditions herein contained; provided, however, that the City of Friendswood reserves the right to require that any such successor, assign, agent or licensee further signify in a recordable instrument acceptance of such terms and conditions and, should any such successor, assign, agent or licensee refuse upon written request to execute such instrument, the rights and privileges herein consented to shall thereupon automatically terminate.

AN ORDINANCE CLOSING AND ·VACATING THE UTILITY EASEMENT IN LOT 6, Ai.�D RESERVE A, BLOCK 9, SUNMEADOW ADDITION, SECTION TWO, GALVESTON COUNTY, TEXAS; AND PROVIDING FOR THE REVERSION OF THE FEE TO SAID LAND.

BE IT ORDAINED BY THE· CITY COUNCIL OF THE CITY OF FRIENDSWOOD, STATE OF TEXAS:
Section 1. The hereinafter described public utility
easement in Lot 6, and Reserve A, Block 9, Sunmeadow Addition,
Section Two, Galveston County, Texas, be and the same is -here
by extinguished, vacated, closed and permanently abandoned as
an easement for public utilities:
An easement ten feet in width across Reserve A, Block 9, Sunmeadow Addition, Section Two, as shown on the recorded map of said addition, recorded in Volume 10, Page 75 of the Map Records of Galveston County, Texas, the southerly and easterly li'ne of which is described as follows: Beginning at the most easterly corner of Reserve A· I Thence North 46 degrees 54 minutes 10 seconds West along the southerly line of Reserve A 123.89 feet to a point for an interior corner in said Reserve A; Thence South 43 degrees 5 minutes 50 seconds West a distance of 74.89 feet to the most southerly corner .of said Reserve A and the ,end of this ten foot utility easement.
Section 2. The fee to the land in said easement above
descr'ibed is hereby released and will revert to the owners as
provided by law.
Section 3. All ordinances or parts of ordinances in
conflict herewith are hereby repealed.
