Date: December 21, 1999 Subject: Quitclaim Deed for First Baptist Church of Friendswood The title company handling the plat for the First Baptist Church has requested that the City execute a quitclaim deed for the northeasterly six feet of the tract. It was noted during the platting stage, that the right-of-way for Morningside Drive was shown to be 66-feet wide rather than the customary 60-feet as is required by ordinance. I found no record of the City ever requesting or having dedicated more than 60-feet of right-of-way. Consequently, I informed the surveyor handling the plat of this matter. He changed the plat to reflect only the 60-feet of width. All existing public facilities (i.e. streets,public utilities, etc.)were located within the 60-feet of right-of-way indicated on the plat and were not at issue. The plat has been approved by the Planning and Zoning Commission and filed of record at the Galveston County Clerk's Office. The title company, as part of the process of issuing title insurance for the tract of land, has requested that the City execute the quitclaim deed to tie up any loose ends that might be left. I have discussed this matter with the City Attorney and she sees no problems with having Council take action on this item. I would recommend that this be placed on the next possible agenda for approval and be executed by the mayor.- Please let me know if I can be of any further assistance.
