HomeMy WebLinkAboutElectric Distribution Line Easement - Texas-New Mexico Power Company 03/13/1987 Form 603 ' (Rev. 6-S I) 8709434 ELECTRIC LINE EASEMENT 005-13-2598 THE STATE OF TEXAS Mar. 13, 1987 Authorization No. 6113-87010 COUNTY OF GALVESTON RECEIVED KNOW ALL MEN BY THESE PRESENTS: SEP 887 That City of Friendswo4. and CITY OF FRIENDSWOOD (Grantor, whether one or more) of LL1VPS ton County, Texas, for and in consideration of the sum of ^"r Dollars (% 1_of .) to it in hand paid by TEXAS-NEW MEXICO POWER COMPANY (a corporation), have granted, sold and conveyed and by these presents does grant, sell and convey unto TEXAS-NEW MEXICO POWER COMPANY, hereinafter called "Grantee", and its successors and assigns,an easement or right of way for an electric transmission line,together with all necessary appurtenant facilities in, on, upon, through, over,across,under and along the following described lands located in Galveston County, Texas, to-wit: All those two (2) certain tracts or parcels of land containing 2.89 acres and 1.2 acres and being respectively described as Recreation Reserve "A" and Recreation Reserve "B" on the plat of Regency Estates Subdivision, a sub- division out of the Sarah McKissick League in Galveston County, Texas, according to the map or plat thereof recorded in Volume 15 at Page 146 et seq. of the Map Records of Galveston, County being more particularly described on Microfilm Number 001-43-1i68 as recorded in Galveston County, Texas, Deed Records and conveying the same to the City of Friendswood. Commencing at the most westerly corner of said Recreation Reserve "A" being 2.89 acres Thence, N4453'36"E , along the southeast R-O-W of Briarmeadow Drive a distance of 269.2 feet to a point being the Point of ingress of the herein described centerline. Thence, S45 06'24"E, a distance of 100.00 feet to a point being Turning Point 'A' of the herein described centerline. Thence, commencing from Turning Point 'A' , S44°53' 36"W, a distance of 20.00 feet to a point being the Endpoint of the heretofore described centerline. • The sketch attached hereto is incorporated by reference as a part of this easement. together with the right of ingress and egress to or from said right of way for the purpose of constructing, reconstructing, inspecting, maintaining, adding to, and removing said line and appurtenances; the right to relocate along the same general direction of said lines; the right to remove from said lands all trees and parts thereof or other obstructions, which endanger or may interfere with the efficiency of said line, or its appurtenances; and the right of exercising all other rights hereby granted. Grantor reserves the right to use the land under and near Grantee's electric line not physically occupied by Grantee's electric transmission line and other facilities, but Grantor agrees that he will maintain minimum horizontal and vertical clearances required by the National Electrical Safety Code between his own future structures and the nearest electric conductor of Grantee. TO HAVE AND TO HOLD the above described easement and rights unto the said Company, its successors and assigns, until said line shall be abandoned.
