WOLFE of the County of Galveston, State of Texas, hereinafter referred to as Grantors, for and in consideration of the sum of ONE ($1.00) DOLLAR to Grantees in hand paid by the City of Friendswood, Texas acting by and through the City Council of the City of Friendswood, Texas, receipt of which is hereby acknowledged, and for which no liem is retained, either expressed or implied, have this day Sold, and by these presents do Grant, Bargain, Sell and Convey unto the City of Friendswood, Texas all that certain tract or parcel of land in Galveston County, Texas, and being more particularly described as follows, to-wit: Part of Lot Sixteen (16) , in Block Five (5) of Friendswood, a subdivision out of the J. R. Williams League, in Galveston County, Texas, according to plat of said Friendswood of record in Vol. 238, Page 14, and Vol. 254, Page 37, in the office of the County Clerk of Galveston County, Texas, as more particularly described by metes and bounds as follows: Commencing at the North corner of said Lot 16, Block 5; Thence South 46° 25' West and along and with the North- westerly line of said Lot 16 and with the centerline of a 40 foot Road, a distance of 294 feet; Thence South 43° 35' East and parallel with the Northeast line of said Lot 16, a distance of 20 feet to the place of beginning of the herein described tract; Thence from said beginning point continuing South 43° 35' East, a distance of 10 feet to a point for corner; Thence South 46° 25' West and parallel with the North- westerly line of said Lot 16, a distance of 173 feet to a point for corner; Thence North 43° 35' West and parallel with the Northeasterly line of said Lot 16, a distance of 10 feet to a point for corner; Thence North 46° 25' East and parallel to the Northwesterly line of said Lot 16, a distance of 173 feet to the Place of Beginning. No liquor, beer or intoxicating drinks of any kind shall ever be sold or stored upon the hereinabove described premises, and this shall be a covenant running with the land. Grantors reserve all of the oil, gas and sulphur in and under the land herein conveyed but waives all rights of ingress and egress to the surface thereof for the purpose of exploring, developing, mining or drilling for same; however, nothing in this reservation shall affect the title and rights of the City to take and use all other minerals and materials thereon, therein and thereunder. TO HAVE AND TO HOLD the above described premises herein conveyed together with all and singular the rights and appurtenances thereto in any wise belonging unto the City of Friendswood, Texas, its assigns forever; and Grantors do hereby bind ourselves, our heirs, executors, administrators, successors and assigns, to Warrant and Forever Defend all and singular the said premises herein conveyed unto the City of Friendswood and its assigns against every person whomsoever lawfully claiming or to claim the same or any part thereof.
