Defined Terms. The Planning and Zoning Commission approved the site plan at its regular meeting on February 25, 2004. Brizendine . 1.Authorize the transfer of ownership of Lot 39 in Imperial Estates Subdivision to the Galveston County Consolidated Drainage District! You may recall, the Galveston County Consolidated Drainage District (GCCDD) · and the City participated equally in the purchase of a lot in Imperial Estates Subdivision that was not subject to the federal FEMA Buyout Program. Lot 39 in Imperial Estates was purchased from Mr. Charlie Brown, and we will share equally in the cost with GCCDD. The Council's purpose and intended use of these lots is first for improvements to drainage. This lot is key to the GCCDD for the development of a comprehensive drainage improvement plan in the Imperial Estates area, along Clear Creek and Mary's Creek. GCCDD is ready to accept the responsibility for the maintenance and any drainage improvements to this lot. This city will be working toward transferring several more lots that were a part of the Buyout Project once the FEMA grant program is closed out. We are nearing completion of that grant project, and as soon as FEMA conducts their final audits, we will work toward the transfers. The City and GCCDD will equally share the costs of the transfer. Recommendation. Authorize the transfer of Lot 39 in Imperial Estates Subdivision to Galveston County Consolidated Drainage District, and authorize the Mayor to sign the documents associated with the transfer. Several weeks ago, we discussed with Council, in Executive Session, the request by Mr. Daniel Gage to purchase a small portion of property he now has under lease from the city. The leased property is a portion of the paved parking area adjacent to his business at Sheer Pleasure Hair Salon, next to the City Hall property. Mr. Gage has been planning an expansion of his building. Given the size of his property, he cannot make an adequate expansion, and meet the set back requirements per the Zoning Ordinance, without the use of this additional minimal amount of property. The property is being sold for market value, and all expenses associated with this sale are being borne by Mr. Gage. The property is a 19-foot by 70-foot parcel, consisting of 1,330 square feet. The property is appraised at $3 .17 per square foot, for a total of $4,216. Agenda2003/05.3/tsm02 Recommendation. It was ultimately determined that Mr. Gage would need to purchase a parcel of property from the city with the dimensions of 19' x 70' to expand his business. In order to determine the value of the subject property, I commissioned Southland Title Company to obtain an appraisal on the property. On behalf of Southland Title Company, The Wilkenfeld Company performed an appraisal on the subject tract. The recommended appraised value of the property is $3 .17 per square foot. Should Council decide to sell this parcel of property to Mr. Gage, it is my recommendation that the sale price be set at $3.17 per square foot as determined by the appraisal or $4,216 for the subject partial. It is also recommended that the closing costs including the survey, the appraisal and all incidental costs to complete the transaction be the responsibility of Mr. Gage. I believe that we acquired the property via donation and purchase in 1986 from Ralph Lowe. The property in question is described as 3.8393 acres of land from ASST 1514, Page 6, Lot E (5-1). The original taxes due on the property in 1986 were $1,118.61 and have grown to $3,962.12 with late fees and interests. In order to move forward with the sale, we either need to pay the back taxes or show proof that they were paid in 1986. Do we have a title policy for this transaction and if so, can I get a copy of it to show that the taxes were paid in 1986? Please let me know what you find out. File No. . 97 44 DEFINITION OF MARK.ET VALUE: The most probable price which a property should bring in a competitive and open market under all conditions requisite to a fair sale, the buyer and seller, each acting prudently, knowledgeably and assuming the price is not affected by undue stimulus. Implicit in this . definition is the consummation of a sale as of a specified date and the passing of title from seller to buyer under conditions whereby: (1) buyer and seller are typically motivated; (2) both parties are well informed or well advised, and each acting in what he considers his own best interest; (3) a reasonable time is allowed for exposure in the open market; (4) payment is made In terms of cash in U.S. dollars or in terms of financial arrangements comparable thereto; and (5) the price represents the normal consideration for the property sold unaffected by special or creative financing or sales concessions• granted by anyone associated with the sale. *Adjustments to the comparables must be made for special or creative financing or sales concessions. No adjustments are necessary for those costs which are normally paid by sellers as a result of tradition or law in a market area; these costs are readily identifiable since the seller pays these costs in virtually all sales transactions. Special or creative financing adjustments can be made to the comparable property by comparisons to financing terms offered by a third party institutional lender that is not already· involved in the property or transaction. Any adjustment should not be calculated on a mechanical dollar for dollar cost of the financing or concessions but the dollar amount of any adjustment should approximate the market's reaction to the financing or concessions based on the appraiser's judgment.
