THAT I, J. BROWNING and wife, , for and ----------------
in consideration of One ($1. 00) Dollar cash to me in hand paid by the City of
Friendswood, Texas, receipt of which is acknowledged, and the further con
sideration of the benefits to be derived by me on account of the construction, and
maintenance by the City of Friendswood, Texas of said sanitary sewer in and
through my certain premises as hereinafter described, do hereby give and
grant to the said City of Friendswood, Texas, a Municipal Corporation of
Galveston County, Texas, the right to construct, reconstruct and perpetually
maintain a sanitary sewer line upon and across the hereinafter described
easement out of Lot 67 of Imperial Estates, Section 2, a subdivision out of
Lot� i_ Block _L_ of Friendswood in the Sarah McKissick or J. R.
Williams League Abstract 151, Galveston County, Texas, as recorded in
Volume 254 A. Page 87 of the Map Records of said County, and being further
described as follows:
BEGINNING at a 1 11 iron pipe at the most southerly corner of
said Lot 67, said pipe also being the mo st easterly corner of Lot
66 of Imperial Estates Section 2;
THENCE N 45 ° 001 00 11 W along the common line dividing
Lot 66 and Lot 67 a distance of 190. 00 feet the most westerly cor
ner of said Lot 67;
THENCE N 33 ° 3!1 05 11 E along the common line dividing Lot
67 and Lot 68, a distance of 10. 20 feet to a point;
THENCE S 45 ° 00' OO" E parallel and 10. 00 feet at right angles
to the southwest line of said Lot 67, a distance of 190. 27 feet to
a point;
THENCE S 55° 021 44 ir E a distance of 1. 79 feet to a point in
the southeast line of said Lot 67;
' THENCE S 45° 00 1 00 11 W along the southeast line of said
Lot 67, a distance of 10. 26 feet the Place of Beginning and con
taining 0. 044 acres of land, more or less, including a 5. 0 foot
utility easement along the southeast line of Lot 67; and a 10. 00
foot utility easement along the northwest line of Lot 67.
To have and to hold the same perpetually to the City of Friendswood,
Texas and its successors, together with the rights and privileges at any and
all times to enter said premises, or any part thereof, for the purpose of
constructing, reconstructing, and maintaining said sewer, and for making
connections therewith; all upon the conditions that the City of Friendswood,
Texas will, at all times, after doing any work in connection with the con=
struction, reconstruction, repair or removal of said sewer, or any lateral
thereof, restore said premises to the condition in which same were found
before such work was undertaken, and that in the use of said rights and
privileges herein granted, the City of Friendswood, Texas will not create
a nuisance or do any act that will be detrimental to said premises.
Further, during the installation of said sewer line, or any laterals
thereof, the City of Friendswood shall have the unconditional right to use
a strip of land adjacent to the above described permanent easement Twenty
(20) feet in width; said 20' strip being measured from the southeast extreme
of $heherein described easement. The grantee, City of Friendswood, shall
confine its operations herunder, including its rights of ingress and egress,
to the said described Twenty (20) foot strip and easement.
