KNOW A.L L MEN BY THESE PRESENTS:
THAT I, A. J. PETERSON, of the County of Galveston, State of Texas,
for and in consideration of THIRTY -THREE THOUSAND TWO HUNDRED
SIXTY AND NO/ 100 ($33,260. 00) Dollars to me in hand paid by the City of
Friendswood, Texas, th e receipt of which is hereby acknowledged, have
GRANTED, SOLD and CONVEYED, and by these presents do GRANT, SELL
and CONVEY unto the said City of Friendswood of the County of Galveston,
State of Texas, all that certain piece or parcel of land situated, lying and
being in the County of Galveston, State of Texas, and described as follows:
Being parts of lots 4 and 5, all of lots 11 throug h
20 in block 1, and part of lot 2, and lots 3 through
16 in block 2, all in "Renwick Village'' according to a plat or map thereof recorded in volume 10 page 82 in the records of maps filed in the County Clerk's
office of Galveston County, Texas, above said tract being more particularly described by metes and bounds,
as follows:
Beginning at a 1" iron pipe set in the Northeasterly
line of St adium Drive, said point being the South corner of "Renwick Village" according to a map or plat thereof recorded in volume 10 page 82 in the records of maps
filed in the County Clerk's office of Galveston Coun ty, Texas, said point being the West corner of a 10 acre
tract of land conveyed by the Friendswood Independent
School District, to the City of Friendswood, according to a deed filed in volume 2391 page 190 in the deed records of Galveston County, Texas;
THENCE, N. 45 degrees E. along the Southeasterly line of said "Renwick Village" a distance of 960. 00 feet
to a l II iron pipe set for the East corner of said "Renwick
Village", said point being the North corner of said 10. 00
acre tract conveyed by the Friendswood Independent School
Dis trict, to the City of Friendswood;
THENCE, N. 45 degrees W. and along the Northeasterly
line of said "Renwick Village" a distance of 294. 00 feet to
a point for corner, said point being S. 45 degrees E. 125. 79 feet from the Southeasterly line of Mary Ann Drive;
THENCE, S. 45 degrees W. and 125. 79 feet at right angles
and parallel to the Southeasterly line of Mary Ann Drive a distance of 444. 95 feet to a point set in the Southeasterly extension of the· Northeasterly line of Avondale Lane;
THENCE,. N. 45 degrees W. and along the Southeasterly
extension of the Northeasterly line of said Avondale Lane a

unto the said City of Friendswood, Texas, its successors and assigns for
ever, and I do hereby bind mys�lf, my heirs, executors and administrators,

unto the said City of Friendswood, Texas, its successors and assigns,
against every person whomsoever lawfully claiming or to claim the same

EARNEST MONEY CONTRACT
This is a contract whereby A. J. Peterson Builder, Inc., a
Texas corporation, hereinafter called SELLER, agrees to sell to City
of Friendswood, Texas, a municipal corporation, hereinafter called
PURCHASER, which agrees to purchase, upon the terms and provisions
hereof, the following described real property in its present condition,
situated in Galveston County, Texas, and being more specifically de
scribed as follows:
Being parts of lots 4 and 5, all of lots 11 through
20 in block 1, and part of lot 2, and lots 3 through 16 in
block 2, all in "Renwick Village" according to a plat
or map thereof recorded in volume 10 page 82 in the
records of maps filed in the County Clerk's office of
Galveston County, Texas, above said tract being more
particularly described by metes and bounds, as follows:

THENCE, S. 45 degrees E. along the North-
easterly line of Stadium Drive and the Southwesterly
line of "Renwick Village" a distance of 294. 00 feet
to the place of beginning;
Containing 6. 652 acres of land, more or less.
The purchase price and consideration which Purchaser shall
pay to Seller for the above described property is THIRTY-THREE
THOUSAND TWO HUNDRED SIXTY AND N0/100 ($33, 260. 00) DOLLARS,
payable as follows: $33, 260. 00 cash, of which Purchaser agrees to
forthwith deposit with Stewart Title Company, Dickinson, Galveston
County, Texas, Escrow Agent, the sum of $2, 100. 00 as Earnest Money,
to bind this sale.
Seller is to furnish Purchaser an Owner's Policy of Title
Insurance issued by Stewart Title Company of Dickinson, Texas.
Seller shall furnish tax certificates showing payment of taxes
for all previous tax years.
Current taxes, rents, interest and insurance, if any, are to
be prorated as of the date of delivery of the deed of conveyance here-
under. Conveyance hereunder shall be by deed containing covenants
of general warranty, conveying good and marketable title.
The Owner's Policy of Title Insurance to be furnished hereunder
is to be delivered as and when the sale is closed. The sale is to be
closed within thirty (30) days from the date hereof unless attorneys for
Purchaser discover objections to title, in which case sale is to be
closed when objections are removed, provided the objections are re-
moved within a reasonable time, which in no event shall extend beyond
sixty (60) days from the date hereof. It is agreed that by the delivery
of Owner's Policy of Title Insurance under the terms of this contract,
issued to Purchaser in the amount of the total sales price and guaran-
teeing Purchaser's title to be good and marketable, all duties of the
Seller as to sufficiency of title required hereunder shall be deemed
to be fully performed by Seller; however, Seller shall not thereby be
released from the warranties of its deed.
Time is of the essence in this contract.
Upon failure of Purchaser to comply herewith, Seller shall
be entitled to retain $300. 00 of the Earnest Money as liquidated
damages and return the remaining $1, 800. 00 to Purchaser. If title
is found objectionable and is not cleared within the time herein pro-
vided, or upon failure of Seller to comply herewith for any reason,
Purchaser may demand back the Earnest Money, thereby releasing
Seller from this contract, or Purchaser may either enforce specific

performance hereof or seek such other relief as may be provided by
law.

A RESO LU TION OF THE CI TY COUNCIL OF THE CITY OF FRIENDSWOOD AUTHORIZING THE MAYOR TO EXECUTE AN EARNEST MONEY CON TRACT BY AND BETWEEN THE CITY OF FRIENDSWOOD AND A. J. PETERSON BUILDER , INC.
WHEREAS, to promote and protect the health, safety, and wel
fare of the citizens of the City of Friendswood, the City Council deems
it desirable and appropriate to purchase lands for use as a public park;
and
WHEREAS, A. J. Peterson Builder, Inc., a Texas corporation,
owns a tract of land containing 6. 652 acres, more or less, in 11Renwick
Village, 11 lying and situated in the City of Friendswood, Galveston
County, Texas, and desires to sell such tract of land; now there fore
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
FRIENDSWOOD, STATE OF TEXAS:
That the Mayor be and he is hereby, authorized to execute
for and in behalf of the City of Friendswood an Earnest Money Contract
by and between the City of Friendswood and A. J. Peterson Builder,
Inc., regarding the pu rchase of 6. 652 acres, more or less, for pub
li c park purposes� :A copy of such contract is attached hereto and made
a part hereof for all purposes.
