COUNTY OF GALVESTON KNOW ALL MEN BY THESE PRESENTS:
That PENELOPE ANN BURKE, CAROLYN SUZANNE DICKSON, RALPH
LAWRENCE LOWE, JR., JANIS NELL LOWE, MEGAN EILEEN MCGHEE, MARY
LISA ABEL, SHANA LAURIE APPEL, and ALAN BLAKE LOWE, TRUSTEES,
under Trust Agreement dated May 18, 1988, known as "THE RALPH Ai'lD
MARJORIE LOWE CHILDREN 1988 TRUSTS," hereinafter referred to as
"Granters," for and in consideration of the sum of ten dollars
($10.00) and other good and valuable consideration, to us in hand
paid by the City of Friendswood a duly and legally chartered
municipal corporation of the Counties of Galveston and Harris,
State of Texas, hereinafter called "Grantee," the receipt and
sufficiency of which is hereby acknowledged, have GRANTED, SOLD,
and CONVEYED and by these presents do HEREBY GRANT, SELL, and
CONVEY unto the said Grantee, its successors and assigns, two
ten-foot (10') easements and rights-of-way for the purpose of
constructing, installing, repairing, and maintaining a potable
water transmission line along, across and under those certain
easements and rights-of-way in Galveston County, Texas, described
as follows:
See Exhibit "A" and Exhibit "B" attached hereto and made a part hereof.
The Grantee may do and perform all acts necessary to
construct, install, repair, and maintain the water transmission '
line within said easements and rights-of-way.
Nothing herein contained shall affect the right of Granters,
their heirs, legal representatives, and assigns to use and enjoy
the easements and rights-of-way granted hereby and in particular
the surface thereof, for any purpose, to the extent such use will
not interfere with Grantee's use of the easements and
rights-of-way granted hereby for its intended purposes as stated
herein.
TO HAVE AND TO HOLD the above-described easements and
rights-of-way together with, all and singular, the rights and

appurtenances thereto in anywise belonging, including all
necessary rights of ingress and egress, unto the said Grantee,
its successors, and assigns, for so long as said water
transmission line and these easements are actively used for the
purposes provided for herein, and Grantors do hereby bind
themselves, their heirs, legal representatives, and assigns to
warrant and forever defend, all and singular, said easements and
rights-of-way unto the Grantee, its successors, and assigns
against every person whomsoever lawfully claiming or to claim the
same or any part thereof, by, through or

FIELD NorES ON A 0.161 ACRE STRIP OF LAND, Said tract being a ten foot wide strip northwest of the right-ofway of F.M. 528, said strip being entirely located within a 154.826 acre tract of land owned by Penelope AnnBurke, Carolyn Suzanne Dickson, Ralph Lawrence Lowe, Jr., Janis Nell I.J:Jwe, Megan Eileen McGhee, Mary Lisa Abel, Shana Laurie Appel, and Alan Blake Lowe, Trustees, under Trust Agreement dated May 18, 1988, known as "The Ralph and Marjorie Lowe Children 1988 Trusts," as recorded under Clerk's File No. 8902216 in the Galveston County Clerk's Office.
BEGINNING at the point of intersection of the existing westerly right-of-way of F.M. 528 and the northeastern most boundary of the above described parcel of land owned by "The Ralph and Marjorie LoweChildren 1988 Trusts";
THENCE southerly along and with the existing westerly right-of-way of F.M. 528 and following a curve to the right having a radius of 1382.84feet, the tangent bearing S 12° 21' 15" W, a distance of 10.06 feetto a point for corner;
'IHENCE N 83°33' 22" W a distance of 69.53 feet to a point for corner;
THENCE S 8° 45' 42" w a distance of 247.83 feet to the point of cw:vature of a curve to the right;
THENCE southerly along the curve to the right having a radius of 5649.58 feet, the tangent bearing S 8° 45' 42" W, a distance of 312.94 feet to a point for corner, same point being on the existing westerly right-of-way of F.M. 528;
'IHENCE S 17° 02' 43" W along and with the existing westerly right-of-way of F.M. 528 a distance of 128.61 feet to a point for corner;
THENCE northerly along a curve to the left having a radius of 5639.58 feet, the tangent bearing N 13° 14' 13" E, a distance of 440.50 feet to the point of tangency of the curve;
THENCE N 8° 45' 42" Ea distance of 257.43 feet to a point for corner;
