Eades, hereunto duly authorized, hereinafter referred to as II Gran tor, 11 for and in consideration of the sum of ten dollars ($10.00) and other good and valuable consideration, to us in hand paid by the City of Friendswood, a duly and legally chartered municipal corporation of the Counties of Galveston and Harris, State of Texas, hereinafter called "Grantee," the receipt and sufficiency of which is hereby acknowledged, has GRANTED, SOLD, and CONVEYED and by these presents does HEREBY GRANT, SELL, and CONVEY unto the said Grantee, its successors and assigns, a ten-foot ( 10') easement and right-of-way for the purpose of constructing, installing, repairing, and maintaining a potable water transmission line along, across and under that certain easement and right-of-way in Galveston County, Texas, described as follows: See Exhibit "A" attached hereto and made a part hereof. The Grantee may do and perform all acts necessary to construct, install, repair, and maintain the water transmission line within said easement and right-of-way. Nothing herein contained shall affect the right of Grantor, its heirs, legal representatives, and assigns to use and enjoy the easement and right-of-way granted hereby and in particular the surface thereof, for any purpose, to the extent such use will not interfere with Grantee's use of the easement and right-of-way granted hereby for its intended purposes as stated herein. TO HAVE AND TO HOLD the above-described easement and right-of-way together with, all and singular, the rights and appurtenances thereto in anywise belonging, including all necessary rights of ingress and egress, unto the said Grantee, its successors, and assigns, for so long as said water transmission line and this easement are actively used for the K 006-46-2241 purposes provided for herein, and Granter does hereby bind itself, its heirs, legal representatives, and assigns to warrant and forever defend, all and singular, said easement and right-of-way unto the Grantee, its successors, and assigns against every person whomsoever lawfully claiming or to claim the same or any part thereof, by, through or under them.
