§ KNOW ALL MEN BY THESE PRESENTS :
COUNTY OF GALVESTON §
THAT Standard Pacific of Texas , Inc . , a Delaware corporation
(herein referred to as "Grantor" ) , for Ten and No/100 Dollars and
other good and valuable consideration, the receipt and sufficiency
of which are hereby acknowl,,dged, does hereby grant unto the City
of Friendswood, Texas whose address is 910 S. Friendswnod nriva
(herein referred to as "Grantee") , a perpetual easement over the
hereinafter specified portion of Lot 64 in Block 3 of Wilderness
Trails, Section 3, a subdivision of land in Galveston County,
Texas, according to the plat thereof recorded in Plat Record 18 ,
Page 293 of the Map Records in Galveston County, Texas .
The easement hereby granted is over the portion of said lot
which is at the front of the lot and within fifteen ( 15) feet of
the right-of-way of Lost River (60 ' ROW) as shown on the plat of
said subdivision (the "Easement Tract" ) .
The easement hereby granted shall be used only for the
purposes of installing, repairing, replacing, maintaining and
operating a storm sewer line and related appurtenances . Grantee,
its agents, employees, workmen and representatives, shall have the
right and privilege of ingress and egress across the Easement Tract
as may be necessary to install, repair, replace, maintain and
operate such storm sewer line and appurtenances .

It is expressly understood and agreed by and between the
parties that this Storm Sewer Easement shall be subject to and
governed by the following provisions :
( 1) The easement, rights and privileges granted herein are
non-exclusive and the Grantor reserves and retains the right to use
the Easement Tract for all purposes which do not unreasonably
interfere with the rights hereby granted. Grantor specifically
reserves the right to construct sidewalks and driveways across the
Easement Tract, the right to cross the Easement Tract with utility
facilities, and the right to maintain landscaping.
(2 ) The easement, rights and privileges herein granted shall
be perpetual or for so long as Grantee shall utilize the easement
for the purposes intended.. The easement, rights and privileges
granted herein shall terminate when, or at such time, as the
purposes hereof cease to exist, are abandoned by Grantee, or become
impossible of performance .
( 3) During or immediately after any work on the Easement
Tract pursuant to the rights granted hereby, the party performing
such activities, at its sole cost and expense, shall take all
reasonable measures to restore the grounds, surfacing materials,
and other facilities of the owner of the Easement Tract, including
driveways , sidewalks , and landscaping situated on the Easement
Tract, to the condition which existed prior to such operations .
( 4 ) The easement, rights and privileges herein granted shall
be subject to all valid and subsisting encumbrances, conditions,
covenants, restrictions, reservations, exceptions, rights-of-way

and easements of record, including all laws, regulations, and
restrictions by municipal or other governmental authority
applicable to and enforceable against the Easement Tract.
TO HAVE AND TO HOLD the above described easement for the said
purposes, together with all and singular, the rights, privileges,
and appurtenances thereto as described above in anywise belonging
to the said Grantee, its successors and assigns forever, subject to
the limitations, conditions and restrictions set forth hereinabove.
IN WITNESS WHEREOF, this instrument is executed this 4-9 O day

Subject: Storm Sewer Easement in Wilderness Trails, Section 3, Phase II I
Date: January 10, 1996
When a previous section of Wilderness Trails was constructed, a section of storm
sewer pipe and a manhole were inadvertently placed in the wrong location. This
occurred near the intersection of Lost River Dr. and Cambridge Dr. The storm sewer
pipe was placed only a few feet outside of the 60' right-of-way.
The developer, Standard Pacific Homes, has prepared the necessary easement
document. The proposed 15' easement across the front of the lot is more than
sufficient to provide a permanent resting place for the pipe.
