IMMINENT CONSEQUENCES/BENEFIT TO COMMUNITY The easement appears to be an unused easement. Therefore,abandoning it would cause no detriment to existing or future utilities. The utility companies have provided letters of no objection to the abandonment. RECOMMENDATIONS The Planning and Zoning Commission considered this item and recommended approval on January 17,2013. Note 1 of the plat provides for the dimensions of"all guy easements(G.E.)" as being 3'X 35' but no specification as to whom the easement is dedicated. As best I can tell, the general dedicatory language of the plat dedicates to public use the"streets, alleys, parks, and easements shown thereon." It is perhaps this language which suggests to the applicant that a city abandonment is necessary. If you are confident that the easement is not public, a quitclaim from the city would not be necessary and, likewise, a companion ordinance would not be necessary. Section 70-25(c) of the Code of Ordinances provides for passage of an ordinance and preparation of a quitclaim when abandoning a public right of way or easement. I can certainly prepare but just wanted to make you aware that there is an indication by Mona that the easement in question is not public. Thanks. It was dedicated by plat as a guy wire easement for the utility companies. I'll attach a copy of the plat for your reference (see Lot 13, Block 12).
