HB/nlb Enclosures ctyfiles\mckenzie. ltr • Upon motion of Commissioner Johnson, seconded by Commissioner Pegues , and carried; It is Ordered by the Court that the following Resolution authorizing the resale of a 4 . 821-acre tract of land located in Empere Chateau, Section 2 , Friendswood be and is approved: WHEREAS, on the 10th day of March 1987 , in the 56th Judicial District Court of Galveston County, Texas, in Cause No. 85-CV-1059 , the Friendswood Independent School District, the City of Friendswood, the Clear Creek Drainage District, and the County of Galveston obtained a judgment from the District Court of Galveston County, Texas, authorizing the forced sale of a certain 4 . 821 acre tract of land to satisfy the payment of delinquent ad valorem taxes; and WHEREAS, the Sheriff of Galveston County conducted such forced sale, in accordance with law, at which sale only one bid was received; and WHEREAS , the lone bidders at such forced sale were Charles Talbot, et ux Anne J. Talbot, the abutting property owners of the tract subject to such sale; and WHEREAS, the Sheriff of Galveston County refused to award such bid and execute documents conveying such property to the lone bidders for the reason that the amount bid was less than the amount of outstanding delinquent taxes on such tract; and WHEREAS, the County Commissioners ' Court of Galveston County, Texas has been advised that the appraised value of such tract is $2 , 000 . 00, which is considerably less than the total amount of delinquent taxes owed on such tract; and WHEREAS, the County is desirous of having such property sold at its market value; and WHEREAS , the City of Friendswood has by Resolution dated February 1, 1988 , approved the sale of this tract for $2 , 000 . 00 . If I am successful in purchasing this property I intend to give approximately 3/4 of an acre of the land along Clear Creek to the Clear Creek Drainage District in support of the Corps of Engineers Clear Creek project. The "park area" located in Empere Chateau has been on the delinquent tax rolls since 1966. The property was in the name of Imperial Development Co. aka Leon Brown Enterprise, a defunct corporation. A petition was filed against the company on the school district's behalf on July 10, 1985, and on September 17, 1986 a notice was given in the Friendswood Journal regarding delinquent taxes. I purchased the property at the Sheriff's sale in the Galveston County Courthouse on June 2, 1987 for $2,000.00. In July I was notified that due to a technicality the sale was not legal and the property would revert to the three taxing entities, FISD, CCDD and the City of Friendswood. I am still interested in this property and would like to ask for your concurrence to purchase it for the price of $2,000.00. a/44.GL / („e,,C41 Charles H. SCHOOL BUS PURCHASE APPROVED Penelope Burke moved to approve the purchase of a 71-passenger school bus to include specifications for 2 seatbelts per seat ; and that seatbelts be specified on all further bus purchases . Motion died for lack of second . Gary Taliaferro moved to purchase a 71-passenger diesel school bus , outfitted so seat belts can be added . Larry McClaugherty seconded . Motion carried ( 7-0) INTRODUCTION OF SCHOOL PSYCHOLOGIST Karen Perry, Associate Psychologist for the district , introduced herself to the Board , relating her educational background , her past experience , and discussed her goals for her current position . Bran City Manager Date: February 22, 1988 Re: Eznpere Chateau Metes and Bounds Description Deloris, I met with Duane Hengst and John Giblin on this issue Thursday, February 18, the day I received your memo. This misunderstanding came fran different perceptions in the original communication, both as to the nature of the request and the person to whom the request was made. Since you asked the question of John, rather than Duane, John's perception was that you were asking him to do this as a favor to Mr. Talbot and you. He reports that his response to you was to the effect that he would take a look at it and see what he could do. John also reports that he has done favors for you in the past, as he has for other people in the city, working the requests in between his regularly assigned work. Since you made the request to John, and not to Duane as head of the department, or to me, the request never became a part of the regularly scheduled work in Community Development and was never evaluated as to the time required to do the metes and bounds and what priority it would take. It has naw been evaluated. This is not a simple task to accanplish: The recorded plat description is very poor. For a metes and bounds description to be done correctly, it will require field work. There are three options: 1. To plot the parcel on the map, very loosely, will take one-half day. 2. To plot the parcel on the map approximately will take one day. 3. To provide an accurate, precise description of the parcel will require field work, hiring a survey crew. This can be done in two to three weeks and will cost a few thousand dollars. Deloris McKenzie February 22, 1988 Page 2 Mr. Talbot has spoken to me about this parcel in the past, and especially his desire to avoid any conflict of interest. I am sure he would not be amenable to the City spending perhaps twice as much as he is paying for the land in field survey crew fees. Duane can work this project into the Community Development work schedule, and we can give it a high priority--as we have on projects you've needed before--but I don't want to do this until I have spoken with Chuck Talbot about his wishes and his reaction to the City's incurring costs on his behalf. I see the first step, however, as being one of us checking with John Olson about the absolute necessity for metes and bounds. Do you want to or shall I? If I am successful in purchasing this property I intend to give approximately 3/4 of an acre of the land along Clear Creek to the Clear Creek Drainage District in support of the Corps of Engineers Clear Creek project. The "park area" located in Empere Chateau has been on the delinquent tax rolls since 1966. The property was in the name of Imperial Development Co. aka Leon Brown Enterprises, a defunct corporation. A petition was filed against the company on the school district's behalf on July 10, 1985, and on September 17, 1986 a notice was given in the Friendswood Journal regarding delinquent taxes. I purchased the property at the Sheriff's sale in the Galveston County Courthouse on June 2, 1987 for $2,000.00. In July I was notified that due to a technicality the sale was not legal and the property would revert to the three taxing entities, FISD, CCDD and the City of Friendswood. In the sale of the respective /, lots in said subdivision by Mr. Leon Brown and Imperial Development Company, it was represented to us that an area within our subdivision consisting of approxi- mately four and one-half (4 1/2) acres, more fully described in Exhibit "A" attached hereto, was set aside as a common area for a park and lake for our subdivision. It was further represented that this park and lake area would be conveyed to the property owners' association of EMPERE CHATEAU at some future date when all of the property in said subdivision was sold by the developer. At this time the said subdivision has been completely sold out by the developer, however, the developer has failed and refused to convey the park and . lake area described in Exhibit "A" to the property owners ' association. MAYOR TO EXECUTE A QUITCLAIM DEED TO CHARLES TALBOT TO CONVEY ANY AND ALL INTEREST THE CITY MAY HAVE IN A CERTAIN 4 . 821 ACRE TRACT OF LAND; AND PROVIDING OTHER MATTERS RtLATING TO THE SUBJECT. WHEREAS , the City of Friendswood has obtained a judgement from the District Court of Galveston County , Texas , authorizing the forced sale of a certain tract of land to satisfy the payment of delinquent ad valorem taxes ; and WHEREAS , the Sheriff of Galveston County conducted such forced sale, in accordance with law, at which sale only one bid was received ; and WHEREAS , the lone bidder at such forced sale was Charles Talbot , the abutting property owner of the tract subject to such sale ; and WHEREAS , the Sheriff of Galveston County refused to award such bid and execute documents conveying such property to Charles Talbot for the reason that the amount bid was less than the amount of outstanding delinquent taxes on such tract ; and WHEREAS , the City Council has been advised that the appraised value of such tract is less than the total amount of • delinquent taxes owed on such tract ; and WHEREAS , the City is desirous of having such property sold at its market value ; now therefore BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FRIENDSWOOD, STATE OF TEXAS : Section 1 .
