Robert Vorpe , builder , for a variance of 2.6 feet on a side yard setback. In the audienee were the owner of the property, Lr. S. L. Jarnagon; iir. Jim Nowlin, past member of the architictural committee and neighbor to the property; and Leigh North. Later The Roard called Bobbie Henry, city secretary; and Jim Lorgn, city manager , to come down and help clear some of the loose ends up in procedures in the building inspector' s office. The Building Inspector could not be reached. Confusion over front yard setack of (30 ) feet or ( 40 ) feet on front yard was cleared up by a survey done at the builder' s request. Setback lines are ( 40 ) feet front yard , and (10) feet side yard setback. This is aldo stated on the uaker ' s L ndi g I platt of 1967, Ir. S. L. Jarnagon submitted plot plan of house location and the approved architictural plans to buildiig inspector for building permit. Permit was granted , but we could not find any of the building inspector' s records to confirm this . Six or more large trees would die if this plan had been continued. The owner asked the builder to adjust the house on the lot after Cook' s Tree Service recommended 4 to 6 feet be left to allow the trees to live . Forms for the slab , reinforce- ment and plumbing were stub in , and the building inspector was called. New house location was not submitted to the building inspector or the architictural committee. The 2.6 feet sideyard setback was not approved or found by the building inspector, or architictural committee. A slab survey called for by the Loan Co. brouht it to the builder ' s attention and he brought the problem to the Board of Adjustment. CITY OF FRIENDSWOOD 109 Willowick Avenue FRIENDSWOOD, TEXAS 77546 482 . 3323 Mr. Jim Nowlin, neighbor , had no complaint about the new location of the house to save the trees. He did address his remarks to the deed restriction violations. Mr. Bruce Foster advised him that the Board could not rule on deed restrictions. This was confirmed by Jim Morgan, city manager. Question on which setback requirement had to be enforced came up. Vie referred to the Ordinance 174, page 33, parag. 7 , "The City of Friendswood is bound by covenants included in previously platted subdivisions approved prior to December 31, 1972: The 10 feet side yard setback is in accourdinance. There was found to be no obstruction to traffic or well being of the neighborhood at the corner. The location of the house is not noticeable in comparison with the other homes on the street. It was still not clear as to the error on the part of the building inspector or if there was an error on his part. His proceedure was never established as to how far he should go in rechecking the location of the house on the property. Hardship shown: Saving of trees , mistake made in replacing of house and possible error by building inspector in not recognizing the relocation of the house. Slab is poured and would have to be reconstructed or a corner cut off which would look even mote outstanding in the neighborhood. The house is located 28.3 feet froi:: the street paving accourding to the builder and his survey. Ed Dykes made a motion to grant the variance of 7.6 setback from property line due to mistakes made undue to builder and unintentionally by builder and hardship was shown. Bernice Box seconded the motion. Vote was called ; (4) votes for motion (1) vote against Motion carried, variance granted. Copys are to be sent to the following: Building Inspector Architietural Committee Quaker' s Landing Builder Each member Record book City Secretary Bruce Foster called for a motion to adjorn. The reason for request being to pre- serve several large old oak and pine trees. The original plot plan would have necessitated the re- moval of these, so consequently the building has been slightly shifted, resulting in 2.4 feet en- croachment on the building line. See enclosed sur- vey dated 9-20-76. We appreciate your review of this matter, and are hopeful that it can be resolved with a minimum of delay. Thank you.
