HomeMy WebLinkAboutZBOA Minutes 1986-02-25 Regular BOARD OF ADJUSTMENT REGULAR MEETING FEBRUARY 25, 1986 MINUTES OF THE ZONING BOARD OF ADJUSTMENT OF THE CITY OF FRIENDSWOOD THAT WAS HELD ON FEBRUARY 25, 1986 AT CITY HALL AT 7 :00 P.M. WITH THE FOLLOWING MEMBERS PRESENT: CHAIRMAN ED DYKES REGULAR MEMBER MAURICE ESTLINBAUM REGULAR MEMBER HAL TAYLOR ALTERNATE MEMBER STEVE JOHNSON ALTERNATE MEMBER HOWARD YEAGER BUILDING INSPECTOR NICK CAPUANO FIRE MARSHAL VANCE RILEY SECRETARY JANE TOLLETT CHAIRMAN DYKES CALLED THE MEETING TO ORDER AND APPOINTED STEVE JOHNSON AND HOWARD YEAGER AS REGULAR MEMBERS FOR THIS MEETING. CHAIRMAN DYKES CALLED TO ORDER A PUBLIC HEARING FOR THE PURPOSE OF RECEIVING TESTIMONY FROM INTERESTED PERSONS REGARDING THE REQUEST FROM BRIAN HARDY, 1210 TALL PINES, COWARD'S CREEK SUBDIVISION, FOR A VARIANCE OF SIDE BUILDING LINE AS BUILT. MR. HARDY STATED THAT THERE IS AN ERROR OF 6 INCHES ON THE BUILDING LINE AND THE VARIANCE IS NEEDED TO CLEAR THE TITLE ON THE HOME. DISCUSSION FOLLOWED. CHAIRMAN DYKES CALLED FOR TESTIMONY FROM FRED AMBURN, OF INTERGRAPH SIGNS, TO REQUEST THE SIGN "KROGER" BE INCLUDED ON MULTI-TENANT PYLON SIGN AT 108W. EDGEWOOD. MR. AMBURN STATED THAT KROGER CANNOT BE ON THE FREE STANDING SIGN BECAUSE OF THE SIGN ORDINANCE. HE SUBMITTED A LETTER FROM THE KROGER OFFICES STATING THAT IF THE VARIANCE IS GRANTED, THEY WILL WITHDRAW THEIR RIGHT TO ADD SIGNAGE. DISCUSSION FOLLOWED. CHAIRMAN CALLED FOR TESTIMONY FROM MARCUS NEISER, 420 E. CASTLE HARBOUR DRIVE, SUBNEADOW SUBDIVISION, TO REQUEST A 5 ' SIDE SETBACK TO BUILD A GARAGE. MR. NEISER STATED THAT HE IS BUILDING A GARAGE AND THAT HE NEEDS A VARIANCE OF 1 FOOT FROM THE SIDE BUILDING LINE IN ORDER TO MAKE HIS GARAGE WIDE ENOUGH FOR 2 CARS AND TO OPEN THE CAR DOORS. DISCUSSION FOLLOWED. 11 CHAIRMAN DYKES CALLED FOR CONSIDERATION AND POSSIBLE ACTION REGARDING REQUEST FROM BRIAN HARDY, 1210 TALL PINES, COWARD'S CREEK SUBDIVISION, FOR A VARIANCE OF SIDE BUILDING LINE AS BUILT. ***MAURICE ESTLINBAUM MADE THE MOTION TO GRANT THE VARIANCE OF SIDE BUILDING LINE OF 6 INCHES AS BUILT. SECONDED BY HOWARD YEAGER. MOTION CARRIED. CHAIRMAN DYKES CALLED FOR CONSIDERATION AND POSSIBLE ACTION REGARDING REQUEST FROM FRED APJBURN,OF INTERGRAPH SIGNS, TO REQUEST THE SIGN "KROGER" BE INCLUDED ON MULTI-TENANT PYLON SIGN AT 108D W. EDGEWOOD DRIVE. THERE WAS DISCUSSION FROM THE MEMBERS TO MR. AMBURN. MAURICE ESTLINBAUM STATED THAT KROGER DOES HAVE THE RIGHT TO ADD 250 MORE SQUARE FEET AND THAT IT COULD GO ON THE WALL. FIRE MARSHAL VANCE RILEY STATED THAT HE IS ENTITLED TO 261 SQUARE FEET MORE SIGNAGE, AND THAT IT IS WELL DESIGNED BRONZE SIGN WITH A GARDEN FEATURE. DISCUSSION FOLLOWED. ***HOWARD YEAGER MADE THE MOTION TO GRANT THE VARIANCE THAT THE "KROGER" BE INCLUDED ON MULTI-TENANT PYLON SIGN AT 108D W. EDGEWOOD DRIVE WITH THE PROVISION THAT NO ADDITIONAL SIGNAGE WILL BE ALLOWED ON THE FRONT OF THE BUILDING OR. ANY OTHER EXTERNALLY ALLOWED UNDER OPTION "G" OF THE SIGN ORDINANCE (OPTION FOR GREATER SIGN AREA) , WITH THE ADDITIONAL WORDING IN THE LETTER SUBMITTED FROM KROGER CORPORATION: THE KROGER MARKETING AREA OF HOUSTON WILL NOT NOR DOES IT WISH TO INSTALL ANY ADDITIONAL SIGNAGE ON THEIR FACILITY AT 110 WEST EDGEWOOD IN FRIENDSWOOD, TEXAS. AMENDMENT SECONDED BY HAL TAYLOR. MOTION SECONDED BY STEVE JOHNSON. MOTION CARRIED UNANIMOUSLY. CHAIRMAN DYKES CALLED FOR CONSIDERATION AND POSSIBLE ACTION REGARDING REQUEST FROM MARCUS J . NEISER, 420 E. CASTLE HARBOUR, SUNMEADOW SUBDIVISION, TO REQUEST A 5 FOOT SIDE SETBACK TO BUILD A GARAGE. DISCUSSION FOLLOWED AT GREAT LENGTH. ***STEVE JOHNSON MADE THE MOTION TO GRANT A ONE FOOT VARIANCE FROM THE DEED RESTRICTIONS OF SUNMEADOW SUBDIVISION. MOTION SECONDED BY HOWARD YEAGER. MOTION CARRIED. MAURICE ESTLINBAUM OPPOSED. CHAIRMAN DYKES READ THE MEMO FROM JIM MORGAN IN REGARDS TO FOREST BEND WHICH STATED THAT IF A BUILDING PERMIT IS REQUESTED FOR A LOT WHICH WAS EXISTING PRIOR TO PRESENT LOT SIZE REQUIREMENTS, THE PERMIT CANNOT BE DENIED. SETBACKS MUST BE FOLLOWED AND IF THE PERSON FEELS THAT IT IS A HARDSHIP, THEN THEY CAN BE SENT TO THE BOARD OF ADJUSTMENT FOR AN APPEAL. CHAIRMAN DYKES STATED THAT THE CITY ATTORNEY FELT THAT THE BOARD WAS MAKING THE RIGHT JUDGEMENTS AND TO GO ON AS THEY HAVE BEEN DOING. 2 IITHE MINUTES FROM DECEMBER 17 , 1985 WERE APPROVED AS PRESENTED WITH ONE CORRECTION. ***MOTION WAS MADE AND SECONDED TO ADJOURN AT 8: 00 P.M.
