HomeMy WebLinkAboutZBOA Minutes 1997-10-28 Regular 147 Regular Meeting Zoning Board of Adjustment October 28, 1997 Minutes of the Regular Meeting of the Zoning Board of Adjustment of the City of Friendswood which was held at City Hall on October 28, 1997 at 6:30 P.M. with the following members present constituting a quorum: Chairman William Hal Taylor Regular Member David O'Brien Regular Member Gary Yokum Alternate Member Thomas Rives Alternate Member Tracy Goza City Building Official Linda Taylor B.O.A. Secretary Linda Thornton Chairman Hal Taylor called the meeting to order at 6:30 p.m. . Assistant City Secretary, Linda S. Thornton administered the Oath of Office to newly appointed Alternate Member Ronald Decker. Board members convened into an Executive Session in accordance with Section 551.071-Consultation with City Attorney, concerning administrative review of request by Exxon Pipeline Company. The Board convened into a Regular meeting at 7:00 p.m. Chairman Hal Taylor appointed Thomas Rives and Tracy Goza as Regular Members for this meeting. Chairman Taylor, called a public hearing to order to receive public input regarding Exxon Pipeline Company's request for a variance to construct and operate a pipeline, 6.7 miles, 16" Ethane pipeline in a 50' easement, without obtaining a Specific Use Permit. Friendswood City Code, Appendix C-Zoning, Section 7.P.2 . Discussion followed with Exxon Pipeline Company's representative, George G. Persyn explaining the company's request. City of Friendswood Building Official, Linda Taylor explained why the City denied the permit. Chairman Hal Taylor, swore in six public speakers. Mr. Mark Young at 1309 Silverleaf, spoke for the variance. Mr. Don Claycomb at 37 Wilderness Trails, spoke against the variance. Mr. E.M. Cutworth, Senior at 5125 Maple, Bellaire, Texas 77401 a representative of the Elliott tract for the Elliot heirs, spoke to support the Planning and Zoning Commission and City Council decisions to deny Exxon's request for a Specific Use Permit. BOA.MIN/LSTO3 148 Mr. David Brakebill at 204 Woodlawn, representing the Cleaves family spoke against this variance request. Ms. Janis Lowe at 1414 South Friendswood Drive, presented that Exxon did not exhibit unnecessary hardship for this request, stated she wanted a no vote. Ms. Lowe submitted for the file, documentation from the Office of the Attorney General regarding Zoning Board of Adjustment proceedings. . Mr. Ed Driskill at 1206 Merriwood, was sworn in late, stated he wants a unanimous no vote. Mr. Bill Roth at 6510 Bayou Front Drive, Galveston, Texas, asked the board not to grant this variance. Mr. Mark Young, submitted documents for the file in support of the variance. Hearing no further input the Public Hearing was closed. *David O'Brien made a motion to DENY the variance. Seconded by Thomas Rives. Motion approved unanimously. * David O'Brien made a motion to approve the minutes from the September 23, 1997, meeting. Seconded by Gary Yokum. Motion approved unanimously.
