COUNTY OF GALVESTON ) KNOW ALL MEN BY THESE PRESENTS:
THAT I , EDWARD F. STUART, of the County of Galveston, State of
Texas, hereinafter referred to as Grantor, for and in consideration
of the sum of ONE ( 1.00) DOLLAR to Grantees in hand paid by the
City of Friendswood, Texas acting by and through the City Council
of the City of Friendswood, Texas, receipt of which is hereby
acknowledged, and for which no lien is retained, either expressed
or implied, have this day Sold , and by these presents do Grant,
Bargain, Sell and Convey unto the City of Friendswood , Texas all
that certain tract or parcel of land in Galveston County, Texas,
and being more particularly described as follows, to-wit:
A tract or parcel of land lying and being situated in
Galveston County, Texas, and being more particularly
described as follows:
A 350 foot tract in the East 2 of the East 2 of Lot
Eleven (11) , Block Three (3) , of the Town of
Friendswood, of record in Vol. 238, at Page 14, and
in Vol. 254, at Page 37, in the office of the County
Clerk of Galveston County, Texas;
BEGINNING at the South corner of Lot 11, Block 3,
Friendswood;
Thence North 43° 35' East, along and with the Southeast
line of said Lot 11, a distance of 350 feet to a point
for corner;
Thence North 46° 25' West and parallel with the
Southwest line of said Lot 11, a distance of 10 feet
to a point for corner;
Thence South 43° 35' West and parallel of 350 feet to
a point for corner in the Southwest line of said Lot 11;
Thence South 46° 25' East along and with the Southwest
line of said Lot 11, a distance of 10 feet to the place
of BEGINNING - being a total of 3500 square feet, more
or less.
Grantor reserves all of the oil, gas and sulphur in and under
the land herein conveyed but waives all rights of ingress and egress
to the surface thereof for the purpose of exploring, developing,
mining or drilling for same; however, nothing in this reservation
shall affect the title and rights of the State to take and use all
other minerals and materials thereon, therein and thereunder.
TO HAVE AND TO HOLD the above described premises herein con-
veyed together with all and singular the rights and appurtenances
thereto in anywise belonging unto the City of Friendswood, Texas,
its assigns forever; and Grantor does hereby bind himself, his heirs,
executors, administrators, successors and assigns, to Warrant and
Forever Defend, all and singular, the said premises herein conveyed.
unto the City of Friendswood, Texas, and its assigns against every
person whomsoever lawfully claiming or to claim the same or any
part thereof.
