HomeMy WebLinkAboutTemporary Construction Easement - Prengle, Ruth & H.W. 4 Ilk 8714976 005-21 -0 128 TEMPORARY CONSTRUCTION EASEMENT THE STATE OF TEXAS KNOW ALL MEN BY THESE PRESENTS COUNTY OF GALVESTON That the undersigned, Ruth Prengle and H. W. Prengle, Jr. , hereinafter called "grantors, " for and in consideration of the necessity, the requirements , and the benefits to accrue to the citizens of the City of Friendswood, Texas , have DEDICATED, GRANTED, and CONVEYED and by these presents do HEREBY DEDICATE, GRANT, and CONVEY unto the City of Friendswood, Texas , a duly and legally chartered municipal corporation of the counties of Galveston and Harris, State of Texas , hereinafter called "Grantee, " its successors and assigns , a Temporary Construction Easement over that certain tract of land being located in Galveston, Texas , and more particularly described as follows : A ten-foot wide easement running immediately adjacent to and parallel with the existing drainage easement between Lot 16 (510 Falling Leaf) and Lot 17 (512 Falling Leaf) , Imperial Gardens Subdivision. It is hereby agreed and understood that the temporary construction easement granted hereby shall expire within six months following the initiation of construction upon or within the permanent drainage easement adjacent thereto or within one year of the date hereof, whichever shall first occur. It is further agreed and understood that grantee shall restore the land within said temporary construction easement to a condition comparable to that in which it was in prior to any such construction. Grantee may do and perform all acts necessary within said temporary construction easement to construct, reconstruct, repair, relocate, remove, or maintain storm drainage improvements within the permanent easement and right of way adjacent thereto and to operate upon said temporary construction easement such machinery and equipment as is required to efficiently prosecute the work. MEWED CITY SECRETARY MAY 5 1987 GTY OF FPM WO 005-2I -0I29 TO HAVE AND TO HOLD the above described easement and right of way, together with all and singular the rights and appurtenances thereto in anywise belonging, including all necessary rights of ingress , egress , and regress , unto the said grantee, its successors and assigns, and grantors do hereby bind themselves, their heirs , executors , and administrators , to warrant and defend, all and singular, the said temporary construction easement and rights unto the said grantee , its successors and assigns , against every person whomsoever lawfully claiming or to claim the same or any part thereof.
