§ KNOW ALL MEN BY THESE PRESENTS:
COUNTY OF GALVESTON §
THAT Edward T. Perkowski, as Trustee for the Edward T. Perkowski Living Trust,
dated January 11, 1984, hereinafter referred to as "Grantor," for and in consideration of the sum
of Ten and No/100 Dollars ($10.00) and other good and valuable consideration, in hand paid by
the City of Friendswood, a Texas municipal corporation located in Harris and Galveston
Counties, Texas, and the Galveston County Consolidated Drainage District, located in Galveston
County, Texas, hereinafter referred to as "Grantees," the receipt and sufficiency of which is
hereby acknowledged, has GRANTED, SOLD, and CONVEYED, and by these presents does
GRANT, SELL, and CONVEY unto the said Grantees, their successors, assigns, and legal
representatives, a perpetual roadway access easement under, over, along, upon, and across that
certain 11,047-square foot of land, more or less, same being more particularly described in
Exhibit "A" attached hereto and for all things made a part hereof.
TO HAVE AND TO HOLD, subject to the limitations set forth below, the above-
described easement, together with all and singular the rights and appurtenances thereto in
anywise belonging, including all necessary rights of ingress, egress, and regress, unto the said
Grantees, their successors, assigns, and legal representatives forever. And Grantor does hereby
bind itself, its Successors, assigns, and legal representatives, to warrant and forever defend, all
and singular, the said easement and rights unto the said Grantees, their successors and assigns,
against every person whomsoever lawfully claiming or to claim the same or any part thereof, by,
through, or under Grantor, but not otherwise.

Grantees may do and perform all acts necessary to construct, reconstruct, repair, relocate,
or maintain said roadway within such easement and operate thereon all necessary machinery and
equipment to efficiently prosecute such work.
Notwithstanding any other provision contained herein to the contrary, the easement
granted hereby is subject to the following:
1. Grantees agree that they shall be responsible for the construction and
maintenance of all facilities within said easement, and Grantees shall further be responsible for
maintenance of the surface of such easement.
2. Grantees agree that any damage to property of Grantor adjacent to the easement
granted hereby, or to any improvement thereon, resulting from the construction or maintenance
of facilities as contemplated hereby, shall be restored to a condition equal to or better than that
which existed immediately prior to such construction.
This conveyance shall be subject to any and all matters of record that affect title to the
property referred to herein.

We have discussed this issue briefly a few months ago. I have recieved the metes and bounds description from GCCDD
for the proposed easement. I will put it in the interoffice mail and send to you. Please have O&O prepare a access
easement deed for this project(we and the GCCDD will also be constructing and maintaining a gravel drive). The access
is specifically for the City's emergency vehicles and the Drianage District's maintenance vehicles.
If you'll get Mr. Perkowski to sign, then we can get on the next available agenda.

I spoke with David Kocurek last week. He would like to see a public access easement granted by Mr. Perkowski so
that CCDD could have access to Clear Creek for maintenance purposes. I have also received e-mail from PD
indicating that response times to emergencies on the creek in this area could be reduced significantly. According to
Kocurek, they would basically build the access drive if the City provided material. I don't see that as a problem.
As to the process of securing the easement, we would have to have it surveyed to prepare a metes and bounds
description along with an easement deed prepared by the City Attorney. Both of these be coordinated by the City
Secretary's office (I hesitate to volunteer the Engineering Division because of current workload and staff shortage).
Please let me know what you would like to do.

Apparently, he has been talking with David Kocurek about this possibility, and David said they would like to have
an easement, but needed the city's help to build the road - us to donate the material for the road.
This is the first I have heard of this offer. Please check with David, to see what is going on, and what he has in
mind. Let me know what you think we should do, and let's talk about how to proceed.
