§ KNOW ALL MEN BY THESE PRESENTS:
COUNTY OF GALVESTON §
THAT I, WILLIAM F. ROSS, hereinafter called "Grantor," for and in
consideration of the sum of Ten Dollars ($10.00) and other good and
valuable consideration, to me in hand paid by the CITY OF FRIE DSWOOD,
a duly and legal chartered municipal corporation of the County of
Galveston, State of Texas, hereinafter called "Grantee," the receipt
and sufficiency of which is hereby acknowledged, have GRANTED, SOLD,
and CONVEYED, and by these presents do GRANT, SFLT,, and CONVEY unto the
said Grantee, its successors and assigns and legal representatives, an
exclusive, perpetual easement for Municipal utility purposes, including
the right to construct, operate, maintain, inspect, replace, and remove
utility facilities, along, across, over, and under the following
described property situated in Galveston County, Texas:
Being a 0.2469 acre tract of land, more or less, out of a called
84.829 acre tract conveyed to William F. Ross, by deed dated March 31,
1983, as recorded in Galveston County Clerk's File No. 8326261, and
being situated in the Sarah McKissick, Abstract No. 151, Galveston
County, Texas, which tract of land is more particularly described by
metes and bounds in Exhibit "A" attached hereto and incorporated herein
for all purposes.
TO HAVE AND TO HOLD, subject to the limitations set forth below,
the above-described easement, together with all and singular the rights
and appurtenances thereto in any wise belonging, including all
necessary rights of ingress, egress, and regress, unto the said

Grantee, its successors and assigns and legal representatives,
forever. And Grantor does hereby bind himself, his heirs, executors,
and administrators, to warrant and forever defend, all and singular,
the said easement and rights unto the said Grantee, its successors and
assigns and legal representatives, against every person whensoever
lawfully claiming or to claim the same or any part thereof.
The Grantee may do and perform all acts necessary to construct,
reconstruct, repair, relocate, remove, or maintain potable water
facilities on said permanent easement and operate thereon all necessary
machinery and equipment to efficiently prosecute the work.

TEN FOOT UTILITY EASEMENT

SARAH McKISSICK LEAGUE ABSTRACT-151
FRIENDSWOOD, GALVESTON COUNTY, TEXAS
All that certain 0.2469 acre out of that certain 84.820 acre tract described in a deed dated
3-31-1983 from Walter J. Diener, ETUX to William F. Ross, filed in Galveston County
Clerks File Number 8326261, Film Code Number 002-39-1576 and being out of the
Sarah McKissick League, Abstract 151, Friendswood, Galveston County, Texas and
being more particularly described by metes and bounds as follow (bearings based on said
Ross Deed);
Beginning at a found 1/2" iron rod marking the east corner of said 84.829 acre tract, said
point being on the existing westerly right-of-way line of F.M. 518 (right-of-way varies)
as established by that certain right-of-way deed filed in Volume 3285, Page 601
Galveston County Deed Records;
Thence N 26° 30' 34" W with the westerly right-of-way line of said F.M. 518, passing at
127.23' (0.18 right) a found Texas Department of Transportation disc and continuing a
total distance 670.11' (deed 668.35') to a call and found 1/2" iron rod for angle point;
Thence N 27° 02' 34" W passing at 105.32' (3.50' right) found Texas Department of
Transportation disc, and passing at 152.25' (4.26' right) found Texas Department of
Transportation disc and continuing a total distance 404.82 (deed 406.59')' to a point for
corner, from which a found axle bears S 84° 13' 33" W - 4.76';
Thence S 43° 27' 33" W - 10.61' with the northwesterly line of said 84.829 acre tract to
a point for corner;
Thence S 27° 02' 26" E - 403.00' to a point for corner;
Thence S 26° 30' 34" E - 671.93' to a point for corner;
Thence N 43° 30' 16" E - 10.64' with the southeasterly line of said 84.829 acre tract to
the POINT OF BEGINNING and containing 0.2469 acre (10,753 square feet) of land
more or less.

SUBJECT: SFI
Here are sane reasons why I feel there will not be any problems if
we direct a limited amount of additional flow to the SFI service
area.
1. The SFI service area originally included REGENCY ESTATES (276
lots) . WSA is now telling us it is not economically
practical to divert REGENCY ESTATES' flows into the SFI.
This will free-up 276 lots of capacity.
2. Sanitary sewer collection systems are designed with
conservative estimates of ultimate design flows. Also, there
is a peaking factor multiplier that adds a bit of "roan" to
the system.
3. In the future, I see water conservation efforts increasing.
Water conservation reciprocally reduces wastewater flows.
These items above do not constitute a study of the SFI, but are
merely sane thoughts that say we can annex a 60 acre site adjacent
to San Joaquin and include it into the service area for the SFI.
