EASEMENT DEED 3 THE STATE OF TEXAS § § KNOW ALL MEN BY THESE PRESENTS: COUNTY OF GALVESTON § WHEREAS, HENRY F. SCHELLING was the sole owner of the hereinafter described property and WHEREAS, HENRY F. SCHELLING died on June 23, 1968, tes- tate, by virtue of his last Will and Testament executed Novem- ber 17 , 1966 and WHEREAS, said instrument was filed for probate as a muni- ment of title and was admitted to probate on January 27, 1969 in the County Court at Galveston County, Texas in Cause No. 32608 and WHEREAS, HENRY M. SCHELLING and MYRON R. SCHELLING were named as the sole devisees in the aforementioned last Will and Testament which has also been recorded in Volume 2005, Page 906 of the Deed Records of Galveston County, Texas, now therefore WE, HENRY M. SCHELLING and MYRON R. SCHELLING, Grantors for and in consideration of the sum of One ($1.00) Dollar cash to us in hand paid by the City of Friendswood, Texas, receipt of which is acknowledged and the further consideration of bene- fits to be derived by us on account of the construction, and maintenance by the said City of Friendswood, Texas of said sani- tary sewer in and through our certain premises as hereinafter described, do hereby give and grant to the said City of Friends- wood, Texas, a municipal corporation of Galveston County, Texas, the right to construct, reconstruct and perpetually maintain a sanitary sewer line upon and across the hereinafter described easement out of Lots 1, 2 and 11, Block 6, of "Friendswood" in the Sarah McKissick League, Abstract 151, or J. R. Williams • League, Abstract 151, Galveston County, Texas as shown on the map recorded in Volume 254, Page 9 of the Map Records of said county and being further described as follows: COMMENCING at a 1 inch iron pipe at the most —mow easterly corner of the James Patton 2 . 31 acre tract out of Lot 2 , Block 6, of "Friends- wood" , said pipe also being N 45 ° 00 ' 00" W 390.0 feet from the most easterly corner of Lot 2 , Block 6 of "Friendswood" ; m THENCE S 18° 35 ' 38" W a distance of 29. 1 feet, more or less, to the place of Beginning; THENCE N 87° 17 ' 04" E a distance of 48. 16 feet, more or less, to a point; THENCE S 49° 48 ' 56" E a distance of 118.47 feet, more or less, to a point; THENCE S 58° 35 ' 56" E a distance of 153.67 feet more or less, to a point; THENCE S 50° 08 ' 26" E a distance of 107 . 32 feet, more or less, to a point on the west right-of-way line of F.M. 518; THENCE S 9° 56 ' 00" E along the west right- of way line of F.M. 518, a distance of 30. 98 feet, moreor less, to a point; THENCE N 50° 08 ' 26" W a distance of 129.49 feet, more or less, to a point; THENCE N 58° 35 ' 56" W a distance of 153.74 feet, more or less to a point; THENCE N 49° 48 ' 56" W a distance of 112 . 14 feet, more or less, to a point; THENCE S 87° 17 ' 04" W a distance of 48. 11 feet, more or less, to the common boundary between this tract and the James Patton Tract; THENCE N 18° 35 ' 38" E a distance of 21.47 feet, more or less, to the Place of Beginning and containing 0.200 acres of land, more or less. TO HAVE AND TO HOLD, the same perpetually to the City of Friendswood, Texas and its successors, together with the rights and privileges at any and all times to enter said premises, or any part thereof, for the purpose of constructing, reconstruct- ing and maintaining said sewer, and for making connections therewith; all upon the conditions that the City of Friends- wood, Texas, at all times after doing any work in connection with the construction, reconstruction, repair or removal of QD cz said sewer, or any lateral thereof, will restore said premises � �; to the condition in which same were found before such work was undertaken, and that in the use of said rights and privileges GJ herein granted, the City of Friendswood, Texas will not create CJ1 a nuisance or do any act which would be 9detri imental to said premises. 44. , �` , • initial Further, during the/installation of said sewer line, or any laterals thereof, the City of Friendswood, Texas shall have the unconditional right to use a strip of land adjacent to the above described permanent easement forty (40 ' ) feet in width, said forty feet being measured from the south extreme of the herein described easement. The grantee, City of Friendswood, shall confine its operation hereunder including its rights of ingress and egress to the said described forty foot strip and easement.
