§ KNOW ALL MEN BY THESE PRESENTS:
COUNTY OF GALVESTON §
THAT I, JAMES PATTON, (joined herein by my wife) for
and in consideration of the sum of One ($1.00) Dollar cash to
me in hand paid by the City of Friendswood, Texas, receipt of
which is acknowledged and the further consideration of bene-
fits to be derived by me on account of the construction, and
maintenance by the City of Friendswood, Texas of said sanitary
sewer in and through my certain premises as hereinafter descri-
bed, do hereby give and grant to the said City of Friendswood,
Texas, a municipal corporation of Galveston County, Texas, the
right to construct, reconstruct and perpetually maintain a sani-
tary sewer line upon and across the hereinafter described ease-
ment out of Lot 2 , Block 6, of "Friendswood" in the Sarah McKis-
sick League, Abstract 151, or J. R. Williams League, Abstract
151, Galveston County, Texas, as shown on the map recorded in
Volume 254, Page 9, of the Map Records of said county and being
further described as follows:
COMMENCING at a 1 inch iron pipe at the most
easterly corner of the James Patton 2 . 31 acre
tract out of Lot 2 , Block 6, of "Friendswood" ,
said pipe also being N. 45° 00 ' 00" W. 390. 0
feet from the most easterly corner of Lot 2 ,
Block 6, of "Friendswood' ;
THENCE S 18° 35 ' 38" W along the east line of
the James Patton 2 .31 acre tract, a distance
of 29.1 feet, more or less, to the Place of
Beginning of this easement being described;
THENCE S 18° 35 ' 38" W along the east line of
said James Patton tract, a distance of 21.47
feet more or less to a point;
THENCE S 87 ° 17 ' 04" W a distance of 151. 39
feet, more or less, to a point;
THENCE N 71° 21 ' 56" W a distance of 113 .29
feet, more or less, to a point;
THENCE N 35° 15 ' 56" W a distance of 60.80
C:\2 feet, more or less, to a point in the south-
east right-of-way line of Winding Way (60
feet wide) ;
THENCE N 45° 00 ' 00" E along the southeast
right-ofway line of Winding Way, a distance
° of 20.29 feet, more or less to a point;
THENCE S 35° 15 ' 56" E a distance of 57 .72
feet, more or less, to a point;
THENCE S 71° 21 ' 56" E a distance of 103.01
feet, more or less, to a point;
THENCE N 87° 17 ' 04" E a distance of 155.42
feet, more or less, to the Place of Beginning
and containing 0.147 acres of land, more or
less.
TO HAVE AND TO HOLD the same perpetually to the City of
Friendswood, Texas and its successors, together with the rights
and privileges at any and all times to enter said premises, or
any part thereof, for the purpose of constructing, reconstruct-
ing and maintaining said sewer and for making connections there-
with; all upon the conditions that the City of Friendswood, Tex-
as will, at all times after doing any work in connection with
the construction, reconstruction, repair or removal of said
sewer, or any lateral thereof, restore said premises to the
condition in which same were found before such work was under-
taken, and that in the use of said rights and privileges herein
granted, the City of Friendswood, Texas will not create a nui-
sance or do any act which would be detrimental to said premises.
Further, during the installation of the said sewer line,
or any laterals thereof, the City of Friendswood, Texas shall have
the unconditional right to use a strip of land adjacent to the
above described permanent easement forty (40 ' ) feet in width,
said forty feet being measured from the south extreme of the here-
in described easement. The grantee, City of Friendswood, shall

'No trees larger than 2 in, diameter 'Shall be cut from the 40 ft. working
easment and also trees from the 20 ft. sewer easment larger than 2 In.
in diameter shall not be cut untill we have Cleared with Mr. James Patton
confine its operation hereunder including its rights of ingress
and egress to the said described forty foot strip easement.
It is further agreed by the City of Friendswood, Texas e410 t:.,
that Grantor, as further consideration for the granting of this
easement, shall have two sewer taps into the aforesaid sewer _,
line without charge for the usual tap fee. `e.
