HomeMy WebLinkAboutEasement Deed - LaSallete Fathers (93523) 93523 EASEMENT DEED 802065 rAq 409 THE STATE OF TEXAS )( X KNOW ALL MEN BY THESE PRESENTS: COUNTY OF GALVESTON )( THAT THE LaSALLETE FATHERS, hereinafter called grantor, for and in consideration of the sum of One ($1. 00) Dollar cash in hand paid by the City of Friendswood, Texas, receipt of which is acknowledged, and the further consideration of the benefits to be derived by me on account of the construction and maintenance by the City of Friendswood, Texas of said premises as hereinafter described, does hereby give and grant to the said City of Friendswood, Texas, a municipal corporation of Galveston County, Texas the right to construct, reconstruct and perpetually maintain a sani- tary sewer line upon and across the hereinafter described easement out of Lots 1 and 10, Block 3, of "Friendswood" in the Sarah McKissick League, Abstract 151 or the J. R. Williams League, Abstract 151, Galveston County, Texas, as shown on the map recorded in Volume 254, Page 9 of the Map Records of said county, and being further described as follows: BEGINNING at a 1" square pipe at the most northerly corner of Lot 19, Block 2, of the Lori Woods Subdivision, said sub- division being recorded in Volume , Page of the map records of Galveston County, Texas; THENCE S 46° 01' 00" W (call S 45° 00' 00" W) along the most southerly northwest line of said Lori Woods Subdivi- sion, at a distance of 155. 89 feet pass a 3/8" iron rod, con- tinuing a total distance of 248. 69 feet to the point of begin- ning; THENCE N 19° 03' 00" W a distance of 280. 11 feet to a point; THENCE N 62° 31' 50" W a distance of 136. 55 feet to a point; THENCE S 47o 04' 00" W a distance of 165. 05 feet to a point; THENCE N 62° 56' 00" W a distance of 538. 15 feet to a point in an old barbed wire fence; THENCE S 45° 00' 30" E along said fence, a distance of 64. 98 feet to a point; THENCE S 62° 56' 00" E a distance of 490. 33 feet to a point; THENCE N 47° 04' 00" E a distance of 164. 95 feet to a point; THENCE S 62° 31' 50" E a distance of 114. 47 feet to a point; • • !' `. THENCE S 19° 03' 00" E a distance of 281. 41 feet to a point in the most southerly northwest line of said Lori Woods Subdivision; © THENCE N 46° 01' 00" E (call 45° 00' 00" E) along the most southerly northwest line of said Lori Woods qichi Subdivision, a distance of 22. 04 feet to the point of be- ginning and containing 0. 497 acres of land, more or less. To have and to hold the same perpetually to the City of Friends- , wood, Texas and its successors, together with the rights and privileges at any and all times to enter said premises, or any part thereof, for the purpose of constructing, reconstructing, and maintaining said sewer, and for making connections therewith; all upon the conditions that the City of Friendswood, Texas will, at all times, after doing any work in connect- ion with the construction, reconstruction, repair or removal of said sew- er, or any lateral thereof, restore said premises to the condition in which same were found before such work was undertaken, and that in the use of said _rights and privileges herein granted, the City of Friendswood, Texas will not create a nuisance or do any act that will be detrimental to said premises. Further, during the installation of said sewer line, or any laterals thereof, the City of Friendswood shall have the unconditional right to use a strip of land adjacent to the above described permanent easement, forty (40) feet in width; said 40 foot strip being measured from the northeast extreme of the herein described easement. The grantee, City of Friends- wood, shall confine its operations hereunder, including its rights of in- gress and egress, to the said described forty (40) foot strip and easement.
