Hamilton • EASEMENT DEED 93515 THE STATE OF TEXAS § § KNOW ALL MEN BY THESE PRESENTS: COUNTY OF GALVESTONon§ BOOK 4U 6J FACE 379 WHEREAS, L.B. HAMILTON, JR. owned a community interest in the hereinafter described property and WHEREAS, the said L.B. HAMILTON, JR. died leaving a last will and testament which was filed for probate on the 10th day of October, 1968 in Harris County, Texas, Cause No. 101, 676, and WHEREAS, MARGARET D. HAMILTON was named as sole devisee under the said last will and testament and also named as execu- trix of the estate of L. B. HAMILTON, JR. , now therefor I, MARGARET D. HAMILTON, widow of L. B. HAMILTON, JR. and executrix of the estate of L. B. HAMILTON, JR. , individually and in my capacity as executrix, for and in consideration of the sum of One ($1.00) Dollar cash to me in hand paid by the City of Friendswood, Texas, receipt of which is acknowledged and the fur- ther consideration of benefits to be derived by me on account of the construction and maintenance by the City of Friendswood, Tex- as of said sanitary sewer in and through my certain premises as hereinafter described, do hereby give and grant to said City of Friendswood, Texas, a municipal corporation of Galveston County, Texas, the right to construct, reconstruct and perpetually main- tain a sanitary sewer line upon and across the hereinafter de- scribed easement out of Lots 6 and 10, Block 6 of "Friendswood" in the Sarah McKissick League, Abstract 151, or J. R. Williams League, Abstract 151, Galveston County, Texas, as shown on the map recorded in Volume 254, Page 9 of the Map Records of said County and being further described as follows: COMMENCING at a point in the southeast right- of-way line of Whispering Pines Avenue (60 feet wide) , said point also being the most , .♦ northerly corner of Lot 10, Block 6, of "Friendswood" ; Cts THENCE S 45° 00 ' 00" E along the northeast 00 C7 line of said Lot 10, at a distance of 491. 0 feet passing a 3/4 inch iron pipe, said pipe also being the most westerly corner of Sew- er Plant No. 2 site, continuing a total dis- tance of 626. 9 feet, more or less, to the Place of Beginning of this easement being described; cL) THENCE S 45° 00 ' 00" E along the northeast line of said Lot 10, Block 6, a distance of 20.2 feet, more or less, to a point; THENCE S 37 ° 55 ' 10" W a distance of 374.2 feet, more or less, to a point; THENCE S 10° 13 ' 00" E a distance of 199.7 feet, more or less, to a point; THENCE S 71° 30 ' 10" W a distance of 117 . 9 feet, more or less, to a point; THENCE N 78° 05 ' 30" W a distance of 128. 1 feet, more or less, to a point in the southwest line of said Lot 10, said point also being N 45° 00 ' 00" W 44.6 feet from a 1" iron pipe at the most southerly corner of said Lot 10; THENCE N 45° 00 ' 00" W along the southwest line of said Lot 10, a distance of 36.6 feet, more or less, to a point; THENCE S 78° 05 ' 30" E a distance of 153 .4 feet, more or less, to a point; THENCE N 71° 30 ' 10" E a distance of 95.1 feet, more or less, to a point; THENCE N 10° 13 ' 00" W a distance of 191. 3 feet, more or less, to a point; THENCE N 37 ° 55 ' 10" E a distance of 385.6 feet, more or less, to the Place of Beginning and con- taining 0.378 acres of land, more or less. TO HAVE AND TO HOLD the same perpetually to the City of Friendswood, Texas and its successors, together with the rights and privileges at any and all times to entersaid premises, or any part thereof, for the purpose of constructing, reconstruct- ing and maintaining said sewer, and for making connections there- with; all upon the conditions that the City of Friendswood, • Texas, will, at all times after doing any work in connection with the construction, reconstruction, repair or removal of co said sewer or any lateral thereof, restore said premises to the condition in which same were found before such work was Ci undertaken, and that in the use of said rights and privileges C.47 Fin herein granted the City of Friendswood, Texas will not create . a nuisance or do any act that would be detrimental said prem- ises . Further, during the installation of the said sewer line, or any laterals thereof, the City of Friendswood shall have the unconditional right to use a strip of land adjacent to the above described permanent easement forty (40 ' ) feet in width, said forty feet being measured from the south extreme of the herein described easement. The grantee, City of Friendswood, shall confine its operation hereunder including its rights of ingress and egress to the said described forty foot strip and easement.
