HomeMy WebLinkAboutEasement Deed - Tony Banfield - 311 CAREY LN • 93521 EASEI1ENT DEED BDOF '(2d165 RAGE 401 THE STATE OF TEXAS KNOW ALL MEN BY THESE PRESENTS: COUNTY OF GALVESTON THAT I, TONY BANFIELD, (joined herein by my wife) for and in consideration of the sum of One ($1 .00) Dollar cash to me in hand paid by the City of Friendswood, Texas, receipt of which is acknowledged and the further consideration of benefits to be derived by me on account of the construction, and maintenance by the City of Friendswood, Texas of said sanitary sewer in and through my certain premises as hereinafter described, do hereby give and grant to the said City of Friendswood, Texas a municipal corporation of Galveston County, Texas, the right to construct, reconstruct and perpetually maintain a sanitary sewer line upon and across the hereinafter described easement out of Lot 22 of Lori Woods Subdivision, a 14.729 acre tract of land out of Lots 10 and 11 , Block 3 of "Friendswood" in the Sarah McKissick League, Abstract 151 , or J. R. Williams League, Abstract 151 , Galveston County, Texas , as shown on the map recorded in Volume 254, Page 9, of the Map Records of said county, and being further described as follows: BEGINNING at a 1 inch iron pipe at the most southerly corner of said Lori Woods Subdivision, said pipe also being the most southerly corner of said Lot 22; THENCE S. 45° 00' 00" W. a distance of 10.00 f'2et, to a point; THENCE N. 45° 00' 00" W. parallel and 10 feet at right angles to the southwest line of said Lot 22, a distance of 154.7 feet, more or less, to a point; THENCE N. 01 ° 06' 00" W. a distance of 59.1 feet, more or less, to a point; THENCE N. 50° 20' 30" E. a distance of 25.6 feet, more or less, to a point; THENCE S. 01° 06' 00" E. a distance of 67.0 feet, more or less, to a point; THENCE S. 45° 00' 00" E. to the southwest line of said Lot 22, a distance of 144.0 feet, more or less, to a point; THENCE S. 74° 49' 30" E. a distance of 2.1 feet, more or less, to a point on the southeast line of said Lot 22, said point also being on the southeast line of said Lori Woods Subdivision; THENCE S. 45° 00' 00" W. along the southeast line of said Lot 22, a distance of 11 .8 feet, more or less, to the Place of Beginning, and containing 0.099 of land, more or less. TO HAVE AND TO HOLD the same perpetually to the City of Friendswood, Texas and its successors, together with the rights and privileges at any and all cJ • 't times to enter said premises, or any part thereof, for the purpose of constructing, ra reconstructing and maintaining said sewer, and for making connections therewith; all upon the conditions that the City of Friendswood, Texas will, at all times after doing any work in connection with the construction, reconstruction, repair or removal of•said sewer, or any lateral thereof, restore said premises to the condition in which same were found before such work was undertaken, and that in the use of said rights and privileges herein granted, the City of Friends wood, Texas will not create a nuisance or do any act which would be detrimental to said premises. City of Friends wood will not remove or destroy any trees on or near the herein described easement or on the heurinafter mentioned temporary construction ease- ment without first obtaining the permission of the herein named Grantor. All sewer lines of any nature constructed now or in the future must be placed below existing ground level and no part of said line is to be exposed. Any and all manholes placed on the herein described property are to be flush with the existing grade and to be sealed so as not to permit any odor to escape which would create a nuisance or be detrimental to the surrounding area. Further, during the installation of the said sewer line, or any laterals thereof, the City of Friendswood, Texas shall have the unconditional right to use a strip of land adjacent to the above described permanent easement forty (40') feet in width, said forty feet being measured from the south extreme of the herein described easement. The grantee, City of Friendswood, shall confine its operation hereunder including its rights of ingress and egress to the said described forty foot strip and easement.
