A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
FRIENDSWOOD, TEXAS, ADOPTING OPEN SPACE GUIDELINES
APPLICABLE TO PROPERTIES ACQUIRED BY THE CITY PURSUANT
TO THE FEMA HAZARD MITIGATION PROGRAM.

BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FRIENDSWOOD,
TEXAS:
Section 1. The "City of Friendswood Open-Space Guidelines," a true and correct
copy of which is attached hereto and made a part hereof as Exhibit "A," and which establishes
policies regarding the licensing, maintenance and use of properties acquired by the City through
the Federal Emergency Management Agency Hazard Mitigation Program, is hereby adopted.

TO
CITY OF FRIENDSWOOD RESOLUTION NO. R2006-22
City of Friendswood
Open-Space Guidelines
The purpose of this document is to identify the minimum maintenance requirements to be
provided by each of the groups that have the potential to assume maintenance
responsibility for an Open-Space Property in the City of Friendswood. This is only a
general guideline in order to provide the entity with an idea of the associated cost, and is
in no way intended to be specific to a particular tract.
Properties that are licensed to a Home Owners Association(HOA):
• Nothing contained in any License Agreement shall be construed as limiting the
City's right to obtain future easements for Open Space Purposes.
• No improvement shall be made to any property without the prior written
authorization of the City.
• Any HOA that enters into a License Agreement shall be responsible for the HOA
fees for the subject property.
• The responsible HOA shall agree to maintain property in accordance with the City
of Friendswood ordinances, HOA policies, and deed restrictions.
• No property subject to a License Agreement may be sub-licensed.
• No License Agreement shall contain a term that exceeds ten (10) years in length;
provided however, the City may extend or renew a License Agreement for
subsequent ten(10) year terms as agreed upon by the parties.
Properties that are licensed to individual Home Owners:

• Individual licensees shall be responsible for any HOA fees that may be due for the
subject property.
• Any individual that enters into a License Agreement shall be required to maintain
the property in accordance with City of Friendswood ordinances, HOA policies,
and deed restrictions.
• No property subject to a License Agreement may be sub-licensed.
• No License Agreement shall contain a term that exceeds ten (10) years in length;
provided however, the City may extend or renew a License Agreement for
subsequent ten(10) year terms as agreed upon by the parties.
• Preferences for entering into License Agreements shall be given in accordance
with the following priorities:
1. Resident who is an adjacent property owner and resides in the same
subdivision;
2. Resident of same subdivision on the same street;
3. Resident of same subdivision in closest proximity to subject lot;
4. Resident of Friendswood in closest proximity to subject lot.
In the event of a "tie", preference will be given to the resident with the longest
consecutive Friendswood citizenship.
