DRAINAGE EASEMENT

§ KNOW ALL MEN BY THESE PRESENTS:

THAT WE, Joe Don Kirkland and Jacquelyn Kirkland,
hereinafter called "Grantors, " for and in consideration of the
sum of ten dollars ($10. 00) and other good and valuable
consideration, to us in hand paid by the City of Friendswood, a
municipal corporation of the Counties of Galveston and Harris,
State of Texas, hereinafter called "Grantee, " the receipt and
sufficiency of which is hereby acknowledged, have GRANTED, SOLD,
and CONVEYED, and by these presents do GRANT, SELL, and CONVEY
unto the said Grantee, its successors, and assigns, and legal
representatives, a perpetual easement and right-of-way for the
purpose of maintaining, constructing, reconstructing, repairing,
relocating, and removing storm drainage improvements over, under,
and through all of that certain 12 , 198 square foot tract of land,
more or less, situated in Galveston County, Texas, said drainage
easement being more particularly described on Exhibit "A"
attached hereto and for all things made a part hereof.
TO HAVE AND TO HOLD the above described easement and right-
of-way, together with all and singular the rights and
appurtenances thereto in any wise belonging, including all
necessary rights of ingress, egress, and regress, unto the said
Grantee, its successors, and assigns, and legal representatives,
forever. And Grantors do hereby bind themselves, their
successors and assigns, to warrant and forever defend, all and
singular, the said easement and rights unto the said Grantee, its
successors, and assigns, and legal representatives, against every
person whomsoever lawfully claiming or to claim the same or any
part thereof.
The Grantee may do and perform all acts necessary to
construct, reconstruct, repair, relocate, remove, or maintain
storm drainage improvements on said easement and right-of-way and
operate thereon all necessary machinery and equipment to
efficiently prosecute the work.

METES AND BOUNDS DESCRIPTION
20' DRAINAGE EASEMENT
12, 198 SQUARE FEET OUT GP
LOT 34 , WINDSONG
FRIENDSiJOOD, GALVESTON COUNTY, TEXAS
All that certain 12 , 198 square feet being a 20' drainage
easement out of Lot 34, Windsong an unrecorded subdivision out
of Lot 15 & 16 of the Burgess Subdivision out of Section 6,
B. S. & F. Survey (George W. Patterson Survey) , Abstract No, 645 ,
Friendswood, Galveston County, Texas and being more particularly
described by metes and bounds as follows;
Beginning at a found 1/2" iron rod marring the southeast corner
of Lot 34 ;
Thence N 80 06' 27" W -- 250. 00' with the south line of said Lot
34 to a point marring the southwest corner of said Lot 34 ;
Thence N 09 53' 33" E - 20. 00' with the common line of Lots 33 &
34 to a point for corner;
Thence S 80 06 ' 27" E - 230. 00' to a point for corner;
Thence N 09 53' 33" 2 - 360. 00 ' to a point for corner being on
the south right-of-way line of Windsong Lane;
Thence S 80 06' 27" E - 18 . 26' to a point for angle point ;
Thence S 45 00' 00" E - 2. 12' to a point for corner marking the
northeast corner of said Lot 34 ;
Thence S 09 53' 33" W - 373. 78' with the common line of Lots 34
& 35 to the POINT OF BEGINNING and containing 12 , 193 square feet
of land more or less.
