S KNOW ALL MEN BY THESE PRESENTS:
COUNTY OF HARRIS §
That Gail Whitcomb, hereinafter referred to as "Grantor",
for and in consideration of the necessity, the requirements, and
the benefits to accrue to the citizens of the City of Friends-
wood, Texas, has DEDICATED, GRANTED, AND CONVEYED and by these
presents does HEREBY DEDICATE, GRANT, AND CONVEY unto the City of
Friendswood, Texas, hereinafter referred to as "Grantee" , its
successors and assigns, a ten foot (10') easement and right-of-
way for the purpose of constructing, installing, repairing, and
maintaining an underground, and only underground, potable water
transmission line along, across and under that certain easement
and right-of-way in Harris County, Texas, described as follows:
See Exhibit "A" , attached hereto and made a part hereof.
The Grantee may do and perform all acts necessary to
construct, install , repair, and maintain the underground water
line within said easement and right-of-way.
This easement shall terminate and revert unto the Grantor,
his heirs, legal representatives, and assigns, if (1) the Grantee
does not place its water line at least five feet (5') below the
surface of said easement, or (2) at any time thereafter, Grantee
should encumber or attempt to encumber the surface of said
easement other than for such periods as are necessary for
maintenance of said water transmission line.
Nothing herein contained shall affect the right of Grantor,
his heirs, legal representatives, and assigns to use and enjoy
Lhe easement and right-of-way granted hereby zInd i - I . ,
the surface thereof, for any purpose, to the extent such use will
not interfere with Grantee's use of the easement and right-of-way
granted hereby for its intended purposes as stated herein.
TO HAVE AND TO HOLD the above described easement and right-
of-way together with, all and singular, the rights and appur-

tenances thereto in anywise belonging, including all necessary
rights of ingress and egress, unto the said Grantee, its succes-
sors, and assigns, for so long as said water line and this ease-
ment is JAL:Lively used for the purposes provided for herein, and
Grantor does hereby bind himself, his heirs, legal representa-
tives, and assigns to warrant and forever defend, all and singu-
lar, said easement and right-of-way unto the Grantee, its succes-
sors, and assigns against every person whomsoever lawfully claim-
ing or to claim the same or any part thereof, by, through or
under him.

FIELD NOTES ON A 10 FOOT WIDE EASEMENT FOR WATER LINE,
Being along F.M. 528 and immediately adjacent to the
Right-of-Way, and out of the Gail Whitcomb Tract in
the Sarah McKissick Survey, Abstract 549, Harris County,
Texas, and lying on the south side of F.M. 528, and Being
More Particularly Described by Metes and Bounds as Follows:
BEGINNING at a concrete monument marking the P.C. of a curve in the south right-
of-way of F.M. 528, and being approximately 2,200 feet from the intersection of
said right-of-way with Clear Creek and the Galveston-Harris County line;
THENCE N. 81° 12' 57" E. along the south right-of-way line of F.M. 528 and the
front property line of the Gail Whitcomb tract, a distance of 2751.86 feet to a
5/8 inch iron rod for corner adjacent to a drainage ditch;
THENCE S. O8° 47' 13" E. a distance of 10.00 feet to a point for corner;
THENCE S. 81° 12' 57" W. parallel to and 10 feet from the front property line of
the Gail Whitcomb tract and the south right-of-way of F.M. 528, a distance of
2751.86 feet to a point for corner;
THENCE N. 08° 47' 13" W. a distance of 10.00 feet to the PLACE OF BEGINNING.
