COUNTY OF GALVESTON X THAT TEE SERA COUNTRY CLUB,INC . , formerly known as THE SHELL EMPLOYEES RECREATION ASSOCIATION, hereinafter called TEE SERA COUNTRY CLUB, INC . , or grantor, for and in consideration of the sum of One ($1. 00) Dollar cash in hand paid by the City of Friendswood, Texas, receipt of which is acknowledged, and the further consideration, and maintenance by the City of Friendswood, Texas of said sanitary sewer in and through grantor's certain premises as hereinafter described, does hereby give and grant to the said City of Friendswood, Texas , a Municipal Corporation of Galveston County, Texas , the right to construct, reconstruct and perpetually maintain a sanitary sewer line upon and across the hereinafter described easement out of Lots 8 and 9, Block 8, of the Antoinette Voss Subdivision in the Sarah McKissick League or the J. R. Williams League, Abstract 151, Galveston County, Texas , as recorded in Volume 254, Page 72 of the Map Records for the said County, and being further described as follows: BEGINNING at a concrete monument in the northwest right-of-way line of Texas State F. M. 528 (90 feet wide) , said monument also being in the southeast line of Lot 8, Block 8, of the Antoinette Voss Subdivision and being in the northeasterly direction along the northwest right-of- way of said State F. M. 528, a distance of 2426. 7 feet more or less from the most westerly corner of that tract of land described in Fight-of-Way Deed from Sera. Country Club, Inc. to the State of Texas as described in deed recorded in Volume 1163, Pages 654-656 of the Deed Records for said County; THENCE N 40° 09' 07" E , along the northwest right-of-way line of State F. M. 528, a distance of 163. 11 feet to the place of beginning of the herein described easement; THENCE N 81° 31 ' 10" W, a distance of 553. 66 feet to a point for corner; THENCE N 51° 04' 30" W, a distance of 156. 47 feet to a point for corner; THENCE N 47° 38' 10" W, a distance of 23. 1 feet more or less to a point , said point being N 43° 35 ' E a distance of 308. 6 feet , more or less , from a 1" iron pipe located N 46° 25 ' W a distance of 20. 00 feet from the most southerly corner of Lot 1 , Block 8 of the said Antoinette Voss Subdivision; THENCE N 43° 35 ' E along said northwest line of Lot 8, a distance of 20. 00 feet to a point for corner; THENCE S 47° 38' 10" E, a distance of 22. 09 feet to a point for corner; THENCE S 51° 04 ' 30" E, a distance of 150.43 feet to a point for corner; THENCE S 81° 31 ' 10" E, a distance of 560. 6 feet more or less to a point for corner in the north- west line of State F. M. 528; THENCE S 40° 09' 07" W, along the northwest line of State F. M. 528, a distance of 23. 50 feet to the place of beginning and containing 0. 336 acres of land more or less. To have and to hold the same perpetually to the City of Friendswood, Texas and its successors , together with the rights and privileges at any and all times to enter said premises , or any part thereof, for the purpose of constructing , reconstruct- ing , and maintaining said sewer , and for making connections therewith; all upon the conditions that the City of Friendswood, Texas will , at all times , after doing any work in connection with the construction, reconstruction, repair or removal of said sewer , or any lateral thereof, restore said premises to the con- dition in which same were found before such work was undertaken, and that in the use of said rights and privileges herein granted, the City of Friendswood, Texas will not create a nuisance or do any act that will be detrimental to said premises . Further, during the installation of said sewer line , or any laterals thereof, the City of Friendswood shall have the uncon- ditional right to use a strip of land adjacent to the above des- cribed permanent easement Forty (40) feet in width; said 40 ' strip being measured from the southwest extreme of the herein described easement.
