inasmuch as the property described herein constitutes no part of their home--

stead, for and in consideration of the sum of One ($1. 00) Dollar cash in hand
paid by the City of Friendswood, Texas, receipt of which is acknowledged, 'i
and the further consideration of the benefits to be derived by the said BER-
NARD J. MURPHY, on account of the construction and maintenance of the
City of Friendswood, Texas of said sanitary sewer in and through his certain
premises as hereinafter described, does hereby give and grant to the City
of Friendswood, Texas, a municipal corporation of Galveston County, Texas,
the right to construct, reconstruct and perpetually maintain a sanitary sewer
line upon and across the hereinafter described center-line easement being
ten (10) feet in width and out of the Perry and Austin League, Abstract No.
55, Galveston County, Texas, the center-line of said easement being further
described as follows:
BEGINNING at a point on the southwest line of Texas State
Highway F. M. 518 (100 feetwide), said point also being S
49° 10' E, 5. 00 feet from a 1" iron pipe at the most easterly
corner of Lot 1, Block 1 of Annalea Section One, a subdivi-
sion recorded in Volume Page of the Map Records of
said County:
THENCE S 45° 00' W, parallel and 5. 00 feet at right angles
to the southeast line of said Annalea Section One, a distance
of 1064. 7 feet more or less
THENCE S 45° 00' E a distance of 543 feet, more or less,
to a point in a fence; said fence being the northwest line of
Friendswood Methodist Church acre tract of land as
described in deed recorded in Volume Page of
Deed Records for said County, said easement containing
0. 368 acres of land, more or less.
TO HAVE AND TO HOLD the same perpetually to the City of Friends-
wood, Texas and its successors, together with the rights and privileges at any
and all times to enter said premises or any part thereof, for the purpose of con-
structing, reconstructing and maintaining said sewer and for making connect-
ions therewith; all upon the conditions that the City of Friendswood, :.Texas, will,
at all times, after doing any work in connection with the construction, recon-
struction, repair or removal of said sewer or any lateral thereof, restore
said premises to the condition in which same were found before such work
was undertaken; and that in the use of said rights and privileges herein granted
the City of Friendswood, Texas will not create a nuisance or do any act that
would be detrimental to said premises.
Further, if said easement is discontinued by the Grantee and no longer
used for the purposes aforesaid, said easement shall revert back to Grantor.
Further, during the installation of said sewer line, or any laterals
thereof, the City of Friendswood shall have the unconditional right to use a
strip of land adjacent to the above described permanent easement twenty (20)
feet in width; said twenty (20) foot strip being measured from the southwest
extreme of the herein described easement. The grantee, City of Friendswood,
shall confine its operations hereunder, including its rights of ingress and egress,
to the said described twenty (20) foot strip and the hereinabove described center-
line easement.
