CONSIDERATION; Tee. Dollars ($10. 00) and other good and valuable
consideration.
EASEMENT PROPERTY:
A Ten foot wide utility easement out of the Sarah McKissick
League in Galveston County, Texas, according to the metes and
bounds description attached hereto as Exhibit "A" and made
part hereof for all purposes.
EASEMENT PURPOSES:
To function as an easement for utility purposes.
RESERVATIONS FROM AND EXCEPTIONS TO CONVEYANCE AND WARRANTY:
Easements, rights-of-way, and prescriptive rights, mineral
reservations, whether of record or not; all presently recorded and
valid instruments, other than liens and conveyances, that affect
the Easement Property.
GRANT OF EASEMENT: Grantor, for the consideration and subject to
the reservations from and exception to conveyance and warranty,
grants, sells, and conveys to Grantee an perpetual , non-exclusive
easement over, upon and across the Easement Property for the
Easement Purpose, together with all and singular the rights and
appurtenances thereto in any wise belonging, to have and hold it to
Grantee, Grantee ' s heirs, executors, administrators, successors and
assigns forever. Grantor binds Grantor and Grantor' s heirs,
executors, administrators, and successors forever. Grantor binds
Grantor and Grantor' s heirs, executors, administrators and assigns
to warrant and forever defend all and singular the easement to
Grantee and Grantee ' s heirs, executors, administrators, successors,
and assigns, against every person whomsoever lawfully claiming or
to claim the same or any part thereof, except as to the
reservations from and exceptions to conveyance and warranty.

CONSENT OF LIENHOLDER
Lienholder, as the holder of lien(s) on the Easement Property,
consents to the above grant of an easement, including the terms and
conditions of such rant, and Lienholder subordinates its lien(s) to
the rights and interests of the easement, such that a foreclosure
of the lien(s) shall not extinguish the rights and interests of the

Commencing at a 2" iron pipe marking the south corner of the Sarah McKissick Survey,

THENCE N 44° 54' 31" W, 1368.11' to the POINT OF BEGINNING, said point being the
southernmost point of the future Eagle Lakes Section Three;

for Eagle Lakes Section 3 . This will be a temporary easement
for Texas New Mexico to install power lines within for
service to Section 2 . When the plat is filed for Section 3
this easement will be dedicated by the plat.
