McCOY, and wife NAOMI McCOY, of the County of Galveston, fifteen hundred and State of Texas, for and in consideration of the sum of el-ght-HHHEI°ed-ap no/100 ($1500.00) miciv na 59-4 800;604 dollars to them in hand paid by the City of Friendswood, 4014 C.7 Texas acting by and through the City Council , receipt of which is hereby acknowledged, have this day sold, and do by these presents, grant, - bargain, sell and convey unto the City of Friendswood, Texas all that certain tract or parcel of land, situated in Galveston County, Texas,. and being a part of that certain tract or parcel of land conveyed to Trantors by deeds from George L. Darrow and wife, Laura B. Darrow, of Galveston County, Texas on the 4th day of June, 1957, said deeds being recorded in Volume 1209, Page 325 and Volume 1209, Page 328 of the Deed Records of Galveston County, Texas; said tract or parcel of land herein conveyed being subject to no liens, leases or easements and being more particularly described as follows, to-wit: COMMENCING at a point for corner, being the common corner of Lots 19, 20, 21 and 22 in the Hoidale and Coffman Subdivision-Perry Austin League, Galveston County, Texas and being also in the centerline of a 40 foot road (Melody Lane); THENCE S 45° 00' 00" East along the common line of lots 20 and 21 , a distance of 330 feet to the Place of Beginning; THENCE N 45° 00' 00" East, a distance of 40 feet to a point for corner, said point being perpendi- cular to the common line between Lots 20 and 21; THENCE S 45° 00' 00" East, parallel to and 40 feet perpendicular distant from the common line of Lots 20 and 21 , a distance of 330 feet to a point for corner in the southeasterly line of Lot 21 ; THENCE S 45° 00' 00" West, along the southeasterly line of Lot 21 , a distance of 40 feet to a point for corner, said point being in the center line of a 40 foot road (Melody Lane); THENCE N 45° 00' 00" West along the common line of Lots 20 and 21 , a distance of 330 feet to the Place of Beginning. TO HAVE AND TO HOLD the above described premises, together with all and singular the rights and appurtenances thereto in anywise p • belonging, unto the said City of Friendswood and its assigns, save and except the following reservations and provisions: Grantors reserve all of the oil , gas and sulphur in and under said lot, but waive all rights of ingress and egress for the purpose of explor- ing, developing, mining or drilling for the same; however, nothing on this reservation shall affect the rights of the City of Friendswood or its agents to use said land or other minerals and matters thereon, therein or thereunder for road purposes, it being specifically understood that CP the City and its agents and assigns shall be vested with the title to and the right to take in and use, without additional compensation, any stone, earth, gravel , caliche or any other materials or minerals upon, in and under said land, except oil , gas and sulphur, for the construction and maintenance of the street and highway system in the City of Friends- CC..d`' wood, Galveston County, Texas, and Grantors do hereby bind themselves, their heirs, executors and administrators to warrant and forever defend all and singular the said premises, unto the City of Friendswood and its assigns against every person whomsoever lawfully claim or to claim the same or any part thereof. And it is further agreed that the City of Friendswood, or its agents,. in consideration of the benefits above set out will remove from the property above described such fences, buildings and any other obstructions as may be found upon said premises.
