Lunney of the County of Galveston, State of Texas (called Grantor) in consideration of the sum of ten . ($10.00) dollars and other good and valuable consideration in hand paid by the 0 City of Friendswood, Galveston County, Texas, the receipt of which is hereby acknowledged, do by these presents GRANT, BARGAIN, SELL AND CONVEY, subject to the reservation herein after made, unto said City of Friendswood, Galveston County, Texas, the free perpetual and uninterrupted use, liberty and priviledge of passing in, along, upon and across the following described land situated in Galveston County, Texas , owned by us : Being a five (5.00) foot and a ten (10.00) foot wide utility easements over and across a 9.00 acre tract of land more or less conveyed to Glynn S. Lunney and wife Marilyn K. Lunney by the Missionaries of La Salette Corporation of Connecticut, a religious corporation and recorded in Volume 2248 page 875 in the office of the County Clerk of Galveston County, Texas, and being out of Lot 10, Block 3, Friendswood Subdivision, in the J. R. Williams or Sarah McKissick League Abstract 151 , Galveston County, Texas, according to a map or plat thereof recorded in Volume 254 page 37 in the office of the County Clerk of Galveston County, Texas, said 5 foot and 10 foot easements being more particularly described by metes and bounds as follows: Description of Five (5.00) Foot Easement Beginning at a point in the Northeasterly line of the above said 9.00 acre tract of land, more or less, said point being N45°04 'W a distance of 294.00 feet from the most Northerly corner of Lot 19, Block 2, Lori Woods Subdivision; Thence N45°04 'W a distance of 198.00 feet to a point for corner; Thence S45°00'W a distance of 5.00 feet to a point for corner; Thence S45°04 'E a distance of 198.00 feet to a point for corner; Thence N45°E a distance of 5.00 feet to the place of beginning. Description of Ten (10.00) Foot Easement Being a 10 foot wide sanitary sewer easement over and across a 9.00 acre tract more or less conveyed to Glynn S. Lunney by the Apostolic Administra- tor of the Diocese of Galveston-Houston and recorded in Volume 2248, page 875 in the office of the County Clerk of Galveston County, Texas, and being out of Lot 10, Block 3, Friendswood Subdivision, in the J. R. Williams or Sarah McKissick League Abstract 151 , Galveston County, Texas, according to a map or plat thereof recorded in Volume 254 at page 37 in the office of the County Clerk of Galveston County, Texas, said 10 foot sanitary sewer easement being more particularly de- scribed by metes and bounds as follows : Beginning at a point in the Northeasterly line of the above said 9.00 more or less acre tract of land, said point being N45°04 'W 284.00 feet from the most Northerly corner of Lot 19, Block 2, Lori Woods Subdivision; Thence S45°W a distance of 145.34 feet more or less to a point in the Northerly line of an existing 20 foot sanitary sewer easement; Thence N63°35 ' 50"W and along the Northerly line of said 20 foot sanitary sewer easement a distance of 11 .39 feet to a point for corner; OE 1. Thence N45°E a distance of 150.78 feet more or less to a point in the Northeasterly line of said 9.00 more or less acre tract of land; rvily '+ Thence S45°04' E and along the Northeasterly line of said 9.00 more or less acre tract of land a distance of 10 feet more or less to the place of be- ginning. The Grantor herein excepts from this easement and reserves for them- selves , their heirs and assigns , forever, all oil , gas and other minerals in and under the land covered by this easement, but said Grantors for themselves , their heirs and assigns , waive all right of ingress and egress to and from the surface of the land covered by this easement for the purposes of drilling, mining, exploring for or developing such minerals. For the purpose of opening, laying, repairing , constructing and maintaining a permanent easement upon and across said premises, with the right and privilege at all time of the Grantee herein, his or its agents , employees, workmen, successors and assigns and representatives having ingress, egress, and regress in, along, upon and across said easement for the purpose of making addi - tions to, improvements on, laying , repairs and replacements to said sewer and/or water conduits, latterals, lines and connections thereto, or any part thereof. TO HAVE AND TO HOLD unto the said City of Friendswood, Galveston County, Texas , as aforesaid for the purposes aforesaid , the premises above de- scribed. Lunney and wife Marilyn K. Lunney, known to me to be the persons whose names are subscribed to the foregoing instrument, and acknowledged to me that they executed the same for the purposes and consideration set forth ; and the said Marilyn K. Lunney having been examined by me privately and apart from her husband and having the same fully explained to her by me, acknowledged said instrument to be her act and deed, and that she had willingly signed the same.
