Gillies and Marjorie H. Gillies hereinafter referred to as "Grantors , " desiring to aid the City of Friendswood, a duly and legally chartered municipal corporation of the Counties of Galveston and Harris, State of Texas , hereinafter called "Grantee, " in its efforts to transport potable water have GRANTED, GIVEN, and CONVEYED, and by these presents do GRANT, GIVE, and CONVEY unto the said Grantee, its successors , assigns , and legal representatives , a potable waterline easement, such potable waterline easement being more particularly described as follows: See "Exhibit A" attached hereto and incorporated herein for all purposes . TO HAVE AND TO HOLD the above-described potable waterline easement, together with all and singular the rights and appurtenances thereto in any wise belonging, including all necessary rights of ingress, egress , and regress , unto the said Grantee, its successors and assigns. And Grantors do hereby bind themselves , their heirs , executors and administrators , to warrant and forever defend, all and singular, the said potable waterline easement and rights unto the said Grantee, its successors and assigns, against every person whomsoever lawfully claiming or to claim the same or any part thereof. 004-82-01 ?_ (. Grantors shall retain the right to construct driveways and sidewalks on easement surface, so long as no permanent structures are constructed on said potable waterline easement. Grantors shall have the right to include the potable waterline easement as a "greenbelt" area when necessary and dictated by the City of Friendswood Zoning Ordinance. BEGINNING at an iron rod found for the intersection of the new northwesterly right-of-way of F.M. 528 and the cut-off line with F.M. 518; THENCE N. 81° 12' 54" W.
