Home My WebLink AboutEasement without Warranty - Private Electric Service - Giesey - 15815 Blackhawk • • 08/28/2006 RP3 $24.00 '��` � ), rl /alb c PRIVATE ELECTRIC SERVICE EASEMENT WITHOUT WARRANT SEP CEIV 2006 ED r� RE THE STATE OF TEXAS § CATi OF yFS ICERREfn D § KNOW ALL MEN BY THESE PRESEN '•S2,,, 1/\�i✓ Q COUNTY OF HARRIS § �`:£Zztt THAT Philip Giesey and Lisa Giesey, hereinafter referred to as "Grantors," for and in consideration of the sum of Ten Dollars ($10.00) and other good and valuable consideration, in hand paid by Craig Anderson and Sandy Anderson, hereinafter referred to as "Grantee," the receipt and sufficiency of which is hereby acknowledged,have GRANTED, SOLD, and CONVEYED, and by these presents do GRANT, SELL, and CONVEY unto said Grantee, his heirs, executors, and administrators, a one foot ( 1') wide private easement for the placement of underground private electric service facilities, located inside the electrical easement of 15815 Blackhawk, along and under the tract of land described in Exhibit "A" attached hereto and for all things made a part hereof Grantors, for the consideration and subject to the reservations from and exceptions to conveyance, grants to Grantee the easement, for the one time entry and installation of the electrical service, which occurred in June 2006, without any expressed or implied warranty; and all warranties that might arise by common law and the warranties in §5.023 of the TEXAS PROPERTY CODE (or its successor) are excluded. Notwithstanding any other provision contained herein to the contrary, the easement granted hereby is subject to the following: 1. Grantors reserve the right to use the surface or the subsurface of the easement granted hereby for any purpose, and if such purpose requires removal of the underground private electric service facilities authorized hereby, Grantee shall cause electrical service to and through such facilities to be disconnected and removed within 30 days following notice to do so. Removal must restore the easement area to the same condition as before the remove takes place. If Grantee shall fail or refuse to timely cause such electrical service to be disconnected and removed, Grantors may do so at their option, and Grantee shall hold Grantors harmless for any such disconnection and removal. 2. If, for some reason, the electrical service facilities are damaged or become inoperable for any reason, Grantor or any third party that may be working in the area can not be held responsible. Except as otherwise provided herein, Grantee shall have no right to enter upon the surface of the easement granted hereby for further construction, maintenance, inspection, replacement, or removal of said underground private electric service facilities, or for any other purpose, without the express consent of Grantors.
