N/J�, Jam/` • ♦. • • 4 914 EASEMENT DEED THE STATE OF TEXAS X KNOW ALL MEN BY THESE PRESENTS: COUNTY OF GALVESTON j THAT THE FRIENDSWOOD METHODIST CHURCH, an unincorporated religious organization in the City of Friendswood, Galveston County, Texas, for and in consideration of the sum of One ($1. 00) Dollar cash in hand paid by the City of Friendswood, Texas receipt of which is hereby acknowledged, and the further consideration of the benefits to be derived by the said FRIENDS- WOOD METHODIST CHURCH on account of the construction and maintenance by the City of Friendswood, Texas of said sanitary sewer in and through its certain premises as hereinafter described, does hereby give and grant to the City of Friendswood, Texas, a municipal corporation of Galveston County, Texas, the right to construct, reconstruct, and perpetually maintain a sani- tary sewer line upon and across the hereinafter described center line easement being ten (10) feet in width and out of the Perry and Austin League, Abstract 55, Galveston County, Texas, the center line said easement being further described as follows: BEGINNING at a point on the northwest line of Edgewood Drive (100 feet wide), said point also being N 45° 00' E a distance of 5. 00 feet from the most southerly corner of the Friendswood Methodist Church'facre tract as described in deed recorded in Volume MPage /9y of deed records for said County; (i7a THENCE N 45° 00' W, parallel a 5. 00 feet at right angles to the southwest line of the said Friendswood Methodist Church `1,997 acre tract, a distance of 742 feet more or less to a point on the northwest line of said Friendswood Methodist Church y497 acre tract and containing 0. 170 acres of land more or less. / TO HAVE AND TO HOLD the sam e perpetually to the City of Friendswood, Texas and its successors, together with the rights and privileges at any and all time to enter said premises or any part thereof, for the purpose of construct- ing, reconstructing, and maintaining said sewer and for making connection there- with; all upon the conditions that the City of Friendswood, Texas will, at all � . P E J Boor . ..10 I Fl q- 61 i • t DEED times, after doing any work in connection with the construction; reconstruct- ion, repair or removal of said sewer or any lateral thereof, restore said prem- ises to the condition in which same were found before such work was under taken; and that in the use of said rights and privileges herein granted, the City of Friendswood will not create a nuisance or do any act that would be detrimen- tal to said premises. Further, during the installation of said sewer line, or any lateral there- of, the City of Friendswood shall have the unconditional right to use a strip of land adjacent to the above described permanent easement twenty (20) feet in width; said twenty (20) foot strip being measured from the northeast extreme of the herein described easement. The Grantee, City of Friendswood, shall confine its operations hereunder, including its rights of ingress and egress, to the said described twenty (20) foot strip and the herein above described center line easement. J , 192. fi1` :�' , P air,• • RESOLUTION OF THE OFFICIAL BOARD FRIENDSWOOD METHODIST CHURCH RESOLUTION OF THE OFFICIAL BOARD OF THE FRIENDSWOOD METHODIST CHURCH AUTHORIZING ELMO H. BRUNDRETT TO EXECUTE AN EASEMENT DEED TO THE CITY OF FRIENDSWOOD, TEXAS, AL- LOWING CONSTRUCTION AND MAINTENANCE OF A SANITARY SEWER SYSTEM UPON AND ACROSS CER- TAIN AREAS OF PROPERTY OWNED BY THE CHURCH. WHEREAS the City of Friendswood, acting through its official govern- ing body, has requested a ten (10) foot sanitary sewer easement out of certain property owned by the Friendswood Methodist Church in the James E. Perry and Emily M. Austin League, Abstract 55, Galveston County, Texas, the cen- ter line of said easement being further described as follows: BEGINNING at a point on the northwest line of Edgewood Drive (100 feet wide), said point also being N 45° 00' E a dis- tance of 5. 00 feet from the most southerly corner of the Friendswood Methodist Church acre tract as described in deed recorded in Volume , Page of deed re- cords for said County; THENCE N 45° 00' W, parallel and 5. 00 feet at right an- gles to the southwest line of the said Friendswood Methodist Church acre tract, a distance of 742 feet more or less to a point on the northwest line of said Friendswood Methodist Church acre tract and containing 0. 170 acres of land more or less. THEREFORE BE IT RESOLVED by Official Board of the Friendswood Methodist Church that the above described easement be granted to the City of Friendswood by appropriate instrument or instruments in writing and that ELMO H. BRUNDRETT be authorized to execute any such instrument as the official act and deed of the Official Board of the Friendswood Methodist Church. I, being the Secretary of the Official Board of the Friendswood Method' t Church, an unincorporated religious organi- zation, hereby certify that the authority was granted to ELMO H. BRUNDRETT as indicated above, to execute instruments to convey a sanitary sewer easement to the City of Friendswood, Texas in a meeting of the Official Board held on the day of , 1967 and that the results of such meeting are recorded in the Official Minutes of the Board.
