KNOW ALL MEN BY THESE PRESENTS :
COUNTY OF GALVESTON
THAT Fwd. Land Co. , Inc. , hereinafter referred to as "Grantors, "
for and in consideration of the sum of ten dollars ($10. 00) and
other good and valuable consideration, to us in hand paid by the
City of Friendswood, a duly and legally chartered municipal
corporation of the Counties of Galveston and Harris , State of
Texas, hereinafter called "Grantee, " the receipt and sufficiency
of which is hereby acknowledged, have GRANTED, SOLD, and
CONVEYED, and by these presents do GRANT, SELL, and CONVEY unto
the said Grantee, its successors , assigns, and legal
representatives , a utility easement, such utility easement being
more particularly described as follows :
FIELD NOTES ON A 0 . 6294 ACRE STRIP OF LAND, Said Tract Being
the 15-Foot-Wide Strip Adjacent to the Northwest Right-of-Way
of FM-528 Out of the Antoinette Voss Subdivision in the Sarah
McKissick Survey, Abstract 151 , and Out of the Southeast Side
of "The Park, " as Recorded in Plat Book 17 , Map 85 & Map 86 ,
Galveston County, Texas .
BEGINNING at the most southerly corner of the Replat of
"The Park, " said point being in the northwesterly
right-of-way line of FM-528 , and being North 43 degrees
48 minutes 32 seconds E. 1150. 07 feet from the northeast
right-of-way line of Winding Way;
THENCE North 46 degrees 11 minutes 28 seconds West, a
distance of 15 . 00 feet to a point for the most westerly
corner of this tract being described;
THENCE North 43 degrees 34 minutes 58 seconds East
15 feet from and parallel to the northwesterly
right-of-way line of FM-528 , a distance of 1056 . 47 feet
to an angle point;
THENCE North 43 degrees 03 minutes 59 seconds East
15 feet from and parallel to the northwesterly
right-of-way line of FM-528 , a distance of 170 . 26 feet to
an angle point;
THENCE North 40 degrees 24 minutes 47 seconds East
15 feet from and parallel to the northwesterly
right-of-way line of FM-528 , a distance of 600 . 83 feet to
a point for the most northerly corner of this tract being
described;
THENCE South 48 degrees 09 minutes 20 seconds East, a
distance of 15 . 005 feet to a point in the northwesterly
right-of-way line of FM-528 ;
THENCE South 40 degrees 24 minutes 47 seconds West along
said northwesterly right-of-way line of FM-528 , a
distance of 600 . 80 feet to an angle point;

THENCE South 43 degrees 03 minutes 59 seconds West along
said northwesterly right-of-way line of FM-528 , a
distance of 170 . 66 feet to an angle point;
THENCE South 43 degrees 34 minutes 58 seconds West along
said northwesterly right-of-way line of FM-528 , a
distance of 1056. 61 feet to the PLACE OF BEGINNING, and
containing 0 . 6294 Acres of Land, more or less .
TO HAVE AND TO HOLD the above-described utility easement,
together with all and singular the rights and appurtenances
thereto in any wise belonging, including all necessary rights of
ingress , egress, and regress , unto the said Grantee, its
successors and assigns. And Grantors do hereby bind themselves ,
their heirs, executors and administrators , to warrant and forever
defend, all and singular, the said utility easement and rights
unto the said Grantee, its successors and assigns , against every
person whomsoever lawfully claiming or to claim the same or any
part thereof.
