Land Co. , Inc. , hereinafter referred to as "Grantors , " for and in consideration of the sum of ten dollars ($10 . 00) and other good and valuable consideration, to us in hand paid by the City of Friendswood, a duly and legally chartered municipal corporation of the Counties of Galveston and Harris, State of Texas, hereinafter called "Grantee, " the receipt and sufficiency of which is hereby acknowledged, have GRANTED, SOLD, and CONVEYED, and by these presents do GRANT, SELL, and CONVEY unto the said Grantee, its successors , assigns , and legal representatives, a utility easement, such utility easement being more particularly described as follows : FIELD NOTES ON A 0 . 3960 ACRE STRIP OF LAND, Said Tract Being the 15-Foot-Wide Strip Adjacent to the Northwest Right-of-Way of FM-528 Out of Lots 5 and 6 , Block 8 , of the Antoinette Voss Subdivision in the Sarah McKissick Survey, Abstract 151 , Galveston County, Texas . BEGINNING at the most southerly corner of this tract being described, said point being the intersection of the northeast right-of-way line of Winding Way with the northwesterly right-of-way line of FM-528 ; THENCE North 46 degrees 11 minutes 28 seconds West along the northeasterly right-of-way line of Winding Way, a distance of 15 . 00 feet to a point for the most westerly corner of this tract being described; THENCE North 43 degrees 48 minutes 32 seconds East 15 feet from and parallel to the northwesterly right-of-way line of FM-528 , a distance of 1150 . 07 feet to a point in the southwest boundary of "The Park, " as recorded in Plat Book 17, Map 85 and Map 86, Galveston County, Texas, for the most northerly corner of this tract being described; THENCE South 46 degrees 11 minutes 28 seconds East, a distance of 15 . 00 feet to a point in the northwest right-of-way line of FM-528 for the most easterly corner of this tract being described; THENCE South 43 degrees 48 minutes 32 seconds West along the northwesterly right-of-way of FM-528 , a distance of 1150 . 07 feet to the PLACE OF BEGINNING, and containing 0 . 3960 Acres of Land, more or less . Morgan , With reference to our meeting concerning FWD Land Co . , Inc . granting an easement to the City of Friendswood for the purpose of installing one fourteen inch ( 14") fresh water line , it is agreed that the City of Friends- wood will : 1 . Bore all trees , streets , and fencing for the purpose of minimizing damage , 2 . Maintain and keep a clean entrance and streets in The Park, 3 . Cover all trenches at the end of each day and mound all trenches for settling purposes upon the completion of the job , 4 . Be responsible for any subsequent damages ' as a result of construction work, 5 . Not hold FWD Land Co . , Inc . or any of its share- holders liable for any accidents which may occur during the comstruction. Should you have any questions please let me know.
